So not only is all the economic development fund for 18 years gone, all of the surplus funds are gone, and all of the per capita saved through disenrollment is gone.

And none of it went to the members. Well, they did get a $500 per month increase, but that was after a $1000 a month decrease. Pretty good record of financial mismanagement. Going from large surplus to missing payment on the bond for the Casino.

Gotta hand it to the Pala EC. And keep handing it over and over and over again.

The EC lost the almost $150 million in surplus we had? Well actually more since I’m sure it grew a little more since then. Also $350,000 for 2 “for 2” law enforcement officers??! WTF we payed them each $175,000 a year on top of what there regular job salary was to patrol the Rez? That’s way to much for a side job. Seems to me Nieto doesn’t really know what she is doing it just seemed like it but anyone with access of millions a dollars a year can look like they know what their doing until they blow through all the money. They should have told us sooner instead of trying to hide it for so long until we were bust. Also is there a way you can find out how many enrolled member we have?? I truly believe the only way the EC keep getting re-elected and why percap is down is because rob has falsely enrolled many more people who he now has to pay percap to just to vote him back in every year. He is enrolling his supporters families and kids who don’t qualify and they know this so they vote him back in knowing that’s the only way for them to stay enrolled and any percap to them is better than no percap. The rest of us who have always been enrolled and not just the past couple years know the difference.

Also could you look into how many enrolled members we have. I know we had about 900 adults and kids and then they disenrolled around 160 people? That would make 740 members. When asked in announcements they say anywhere from 900 to 1300 members? So either they aren’t counting the disenrolled and left them on the rolls or they have enrolled another 160 people in the past six years which seems like a lot for a small tribe. For the big Pharma lawsuit announcement they stated 1300 members and for the election results announcement in November they stated 900. Which is it ?

on these vehicles with Tribal funds.
Put non blood members on the Tribal roles and gives them per capita benefits, build homes for these fake Tribal members for their votes to keep him and his corrupt partner, Theresa Nieto in charge of all the financial aspects of the PBMI.
So this is the kind of Chairman that you Pala people want with this kind of track record to run your Reservation.

it couldn't be simpler. make the motion to rescind the resolution 01-07 and Resolution 01-10 and that will strip all the power away from the EC and the casino moneys and return the authority to the General Council. Please notice Resolution No. 01-10. This is a good example of one of Smiths illegal resolutions. Notice how the signature page is separate from the main resolution. This signature page has been attached to several phony resolutions allowing smith to completely ignore the General Council and do whatever he wants. Take the power away. move to rescind. IT IS THAT EASY. All the BS by RS would come to an end.

Why didnt anybody complain about "Pala Band of Mission Indian" in 2001. The above documents show that is the name of the tribe. Why complain and say its not a tribe now?

In 2001 The Pala Band was still listed on the Federal Register as Pala Band of Luiseno Mission Indians.

It was not until 2014 that Pala changed its name and was put on the register as the Pala Band of Mission Indians.

The PBMI is not a tribe and has never been one.

In 1893 the Pala Band of Luisenos were granted a reservation at Pala.

In 1903 the Cupeno Tribe and other Warner Ranch Evictees had land purchased next to Pala for a reservation.

In 1961 the Pala Band of Luisenos and Warner Ranch Evictees formed an association in order to conduct business. But it was never a federally recognized tribe.

In 1978 the Pala Band of Luisenos was added to the Federal Recognized Tribes list. The Cupeno were left off by error.

The PBMI is not an historical entity whereas the Pala Luiseno is an historic band of the Luiseno Tribe and the Cupeno are an Historic Tribe as well.

Your interpretatiin of history is way off. The Pala Band of Mission Indians is made up of various landless Indians moved to Pala. The Luiseno at Pala were adopted into the tribe, at the chagrin of many elders. The US has recognized the Pala tribe as a federally recognized tribe since there conglomeration through removal. The Pala tribe refused the IRA in the 1930s so they remained without a federally recognized or acknowledged paper document, but they kept there traditional Cupeno leadership roles up into the 1940s. The US government still recognozed and conducted business with the tribe during these times up until the 1960s when they demanded the tribe adopt a Constitution governing document. By then, the traditional Cuoeno ledership system and religion was no longer practiced so the government to government model was used to create the Articles of Association establishing a formal paper recognition. The Old Pala Luiseno followed their traditional/religious leadership which has nothing to do with Pala Cupeno people, they are only included in the government to government formal paper leadership established in the governing documents. The name on the register has nothing to do with anything. If anything, your distorted history and back uo self written document states that the name was changed from Luiseno Band to Pala Band, which is the original name, meaning, and association established in 1903 with the removal. Today, 2019, the Pala Band of Mission Indians is a federally recognized tribe made up of individuals decended from the original rolls. That does not mean that the Old Pala Luiseno are the tribe and that the Cuoeno dont exsist. You can change the name to whatever you want, the federal government will always revert to and reference the establishing documents of the tribe and the history of how that govt to govt relatiknship was started. Since most tribes started relationship with the US government through treaty, the Court, Congress and the President have always used those first documents to resolve issues between tribes and the government. In Californias case, since the trwaties were never ratified, each tribe has to use there governing do uments and histories with the US governemnt as the reference points through which to resolve issues. The federal register was created in 1935, that does not mean every tribe peior to the establishment dont exsist. In fact, many tdibes chnage there names all the time to reflect accurate histories and trajectories. Stop trying to change histoey to suite your own needs, and keep Pala histoey accurate. The federal government courts will look at the whole story, which is linked back prior to the Treaty of Guadaluoe Hidalgo, and establish when and where the Pala tribe was established as a govt to govt entity.

Go back to 1793, you'll find the Cupeno at Warner's (Kupa) and the San Luiseno, but you won't find a "Pala Tribe".

There are 2 reservations at Pala, there are no "Pala Indians", Pala is not a tribe.

Back up everything you said with documentation, The BIA would love to see it since they haven't been able to find a single page supporting what you said. They would have loved to have had them for court. Can't do that since they don't exist. Have you seen the original roles. The original roles are comprised of the Warner Ranch Indians (1913) the Old Pala Indians (1895) and the adoptees. So if the BIA meant for everyone to be one big happy family then why did they distinguish the groups in the original roles. Why does Robert Smith refuse to recognize the adoptees and their heirs as legitimate members of Pala? Because Pala is not a tribe. It is a place with a Spanish name derivative. Pa-La just like Temeku-La. Pala doesn't mean water in Luiseno but Pa or Pah does. Pala is shovel in mexipino as per those Mexican citizens living across from the casino. And if you really want to get in to history then try reading the Treaty of Guadalupe Hidalgo. You will find that there is a clause in there that prevents Mexican Indian Citizens from joining up with Indians in the US and that they are banned from receiving any benefits intended for the Indians of the US. Whoops! There goes Pala's Mexican corner. Won't be difficult to reclaim those lands intended for real CupeƱo people. There is case law supporting such actions. It will happen and sooner than later.

Remijo Lugo wasn’t a Landless Indian. He was a member of the Morongo reservation. It was founded in 1876. Look at their roles back in 1902 and previous. He’s on them. Why should the Warner’s ranch evictees have to be sharing with his great great grandchildren like Nieto’s kids or Dion’s kids?

Did anyone notice that the Pala EC reported allocated revenue of $204 million in 2008, but now reports $108 million? That means the Casino take is down almost half from 2008.

That also means that the money invested in the Casino actually caused the revenue to go down. So the 2012 expansion that cost $120 million, and the 2018 expansion that cost $175 million, and the RV Park and Wine Cave that cost $5.7 million actually made things worse financially.

Revenue decreased $96 million over ten years. That is not a one time loss. That is just the difference in reported numbers from 2008-2018. Each of the years between 2009 and 2018 the Pala EC reported less than $204 million. Even if you report a gradual decrease of $10 million per year, it totals out to $545 million in reduced revenue over the last 10 years.

Now look at the Economic Development fund. The Pala EC reports budget items to show how the $5.5 million will be spent, but there is never any income from the investments. It is just a pit where they toss in money and nothing ever comes out. You can see the Raceway, Robert's Ranch, the Avocado grove, and I guess the Vineyard, but they are not investments because they never generate income. They are expenses. So you can add $180 million in losses to the $545 million lost revenue.

Now add in the $120 million for the Casino remodel, and $175 million for the expansion. That makes $1,020 million, or over a billion dollars for those of you that are math challenged.

And it's all easy to see. If anything this calculation is an understatement. The real numbers are worse. And we left out the lobbying money to promote online gaming in California. We left out the contributions to the FBI retirement fund, the payouts to the San Diego Sheriff's Dept to keep Smith supporters free to harm members. We left out the money paid to the San Diego District Attorney's Office, the parties for California Legislators, the bribes to BIA officials. We left out Pala Interactive. We have no way of knowing how many Pala employees collect paychecks without working, or how many members were enrolled that don't have the blood. We know there are a lot of real estate investments and properties that Smith and Nieto bought under fake names, and mansions in Maui and Ireland.

The list goes on and on. But I just put a price tag on how much it costs the members each year to keep their pig. And this also doesn't include casino comps, and private jets, and personal vehicles, and no limit American Express card, and cash from the casino.

No wonder why the Band is broke. It is impossible to feed a pig that is so greedy.

Maybe so. Just saying that the Casino added 500 slots but managed to lose $94 million in revenue last year. It's a head scratcher. There would have been more money without the added slots.

Or the other explanation is that the report is phony. What a surprise! The great and wonderful Chairman decided the best way out of his current message is to blame Casino management and take it out of the member's pockets.

Seems familiar. Like the $16 million settlement Dickstein owed to Rumsey Rancheria that was paid with the money saved by disenrolling the Brittens.

Yet she is the one who whenever Robert wanted would make motions that allowed Robert to steal even more money, hurt more people, take away individuals per capita, ban members from tribal business and evict persons for associating with persons who have been evicted. It goes on and on. Now though the shoe is on the other foot. There is an old saying, "Everyone loves the Vikings until it is you they are coming after." Well the Viking is now coming after you and it is too late. You were told and warned and you did not listen. The final stage has been set and all the lavatopinos and lugoshits couldn't line up fast enough to vote the way Robert wanted them to vote. The casino will be bankrupt before the year is over. You have been warned and you are responsible for letting it happen. Best start worrying about what you are going to do now because tomorrow it will be too late. You didn't want to believe the truth Sayers when the truth was being spoken and people willingly sacrificed everything in attempts to protect the tribe. And now on the lighter side, Pala Interactive CEO Jim Ryan says they have 90 days to comply with the Interstate Wire Transfer Act. The regulations bar interstate payments for online gaming. It is hard not to laugh. Chairman Porky sunk a $100 million into this venture for the software. Another $70 million in start up costs. The another $35 million for operating costs. And not a cent went to members. Instead they got a paycut.

The Pala EC really is expert at mismanagement.

With all the post that say Robert Smith and Theresa Nieto are stealing the Bands money what will it take to have a complaint against them through the Federal Government to have arrested?
Won't an Audit have to be done first to see if all the facts are true and then file a complaint with the FEDS.
Or how does that work with an Indian Reservation?
I know for a fact that there was a complaint filed with the FBI and the IRS, who has not acted on it as of yet.
The FBI has had many people call them and complain about there no acting on the complaints and all they ever say is that it's an on going investigation and that they can not give any information to the people even the ones that signed on the complaints.

There was a new complaint filed about 20 days ago and it was backed up with a lot of verified evidence concerning
the spending by Smith and others including but not limited to copies of checks through Well Fargo bank and the Corner Stone Bank in Carlsbad.
Also a copy of the signature cards that were on file at these banks.
We are just waiting for an answer to see if there will be
a yes or no from the Grand Jury.
It should't be very much longer.
Just keep praying that it will be enough to get the ball rolling in our favor.

At 8:26 AM according to someone close to the check writer
he did not pay any taxes on that check.
It was considered a bonus pay out and Smith didn't want taxes withheld and stated that he would take care of it when he files his taxes.
He also claims big losses under the Pala Tub business.
He always uses the laundry mat as a write off when he files his taxes.
At least that's what his brother Andrew says.

I wonder why some of the Members that have lost a loved one that was enrolled doesn't question why they never received the life insurance payout from the Tribe after there loved one passes away.
Some that have died didn't owe the Tribe and still no life insurance money from the Tribe.
Do you think that Robert Smith or one of his followers are listed as the the one who gets the money in case that member dies.

You have to sign up for the life insurance and name an heir, it is not an automatic thing. The life insurance ws set up to cover funeral/death expenses and needs to be opted in by the member. Orthwise, they get nothing.

Who sets the pay scale for the EC members, and who approves it.
And also who sets the pay scale for Tribal employees
ans who approves it.
Why are Tribal employees started out at such o such a high pay scale for their jobs.
In a normal working field employees are started out with the with the min. wage and then receive pay raises as they progress in that field.
This is an area that should be brought up and let the people have a say in the pay scale of Tribal employees.
Most of the jobs through the Tribe start out at between 12 to 18 dollars per hour and they earn pay raises on top of that.
That's a lot to pay someone to just sit around and do nothing all day but hide and sleep.

Today i attended a funeral for Mr. Diaz and while there i could not stop from thinking about the death of Robert Smith and Theresa Nieto and why the wrong people are dying before them.
I also imagined how happy Pala would be if either of them were to die for whatever reason.
That may sound a little harsh but it got me through the service and something to look forward to.

I think people are upset simply because how many homes are still sitting empty that should have been torn down (the meth labs), the occupants passed away over a year ago and is STILL filled with their personal belongings....on and on....what the hell is wrong with this tribe. They take away the home from 2 elders, 1 seriously ill who did not have the capacity to make their own decisions. We need to rethink our housing department and policies because obviously it only applies to select people and families.

She was with Howard for almost 50 years and that should mean something.
The home in question was done through Amia and should not be included in the Pala housing project.
When the leases were signed by the people moving in the lease agreement states that if a spouse of the head of household passes then the remaining spouse can live in the home as long as the remaining spouse did not remarry
and have a new spouse move in.
That's what the original leases state.
So leave these people alone and move on to more important issues like the financial status of the Band.

You're absolutely right, the original AMIHA contracts still stand. Legally only the homeowner can change the contract. However, AMIHA has to abide by each Tribe's ordinances as to how remaining non Tribal spouses are or are not allowed to remain in the home. So in other words, it was PALA's ordinances that allowed the spouses to remain, not AMIHA.

No the original contracts are binding unless THE HOMEOWNER signs an agreement to change it, however AMIHA must comply with the Tribe's ordinances. Each Tribe's different but I would assume legally the original ordinances would apply as "grandfathered" in as it was in place at the time of the original contract signed. However the newer homes do not have this protection unless the ordinance was the old one still in place. Same thing applies as the AMIHA contracts, even if it's through the Tribe, the original contract is binding. The ONLY way the original contracts can be broken is if the HOMEOWNER, OR PERSON BUYING THE HOME changes it with a new contract.

Way back when he tried to change the contracts it was good no one fell for it. When Andrew Moro tried to have people sign a "new" contract to build onto their original AMIHA homes there could be a plausible argument he did not fully disclose the circumstances which would make those "new" contracts null and void, the original contracts still binding. No matter if it's an AMIHA or new home the original contracts are still binding.

You need to understand family facts. Domingo Moro the citizen Indian is Robert's grandfather. Andrew Moro was his brother (who did NOT give up his rights) was Andrew Moro's grandfather. Yes Robert and Andrew are DISTANT cousins. What Andrew did was a disgrace, his family is not happy with him. He was a product of not being raised on the reservation and no clue as to customs and traditions. Pala was duped and made some serious mistakes re-electing Robert. I understand your frustrations but you really need to get your facts right as to whom each family is descended from.
