Guest Post - So, who is Robert Smith?

Guest Post - So, who is Robert Smith?

The government and fools have chosen to refer to Robert Smith as Honorable. They do so even with the knowledge of his far-ranging criminal activities. They do this either because they are the beneficiaries of his ill-gotten gain or simply admirers of power without regard of it source.

Robert Smith is the grandson of Henry Smith, the son of a German Immigrant who homesteaded lands adjacent to the Mesa Grande Reservation. Henry Smith was a persistent German who pushed the BIA so hard that they finally gave him Indian status as being a quarter Indian from Mesa Grande. He married a Moro woman and had Robert Smith’s father, Victor Smith.

The Moro family was originally from Northern California. Adolpho Moro, who was half Wappo Indian and Spanish, moved to Warner Springs. Adolpho Moro’s real last name is unknown. The name Moro was confused by the census takers with the name Morio which was a prominent Cupeno family of the time. It is how the name Moro came to be in Warner Springs. Domingo Moro was Robert Smith’s other grandfather and who also was without any real ties to the Cupeno tribe.

There was a real confusion as to who the real Cupa people are. They were notably peace loving and sharing. They considered the hot spring, Cupanga, to be sacred and did not engage in its commercialization. They lived along the Agua Caliente Creek where they blended the hot water from the spring with the cool fresh waters of the creek for various purposes.  The adobe village was not part of the true Cupeno village.

Several interlopers settled at Warner Springs in hopes of taking possession of the spring itself and benefiting from the hot spring baths and other tourist trades. These families included the Moros of Northern California, the Garras of Yuma or San Luis, Mexico, the Nolasquez families also of Mexico and the Barkers. Alexander Barker was a white man who married a Cahuilla woman and laid claim to the hot springs.

Domingo Moro filed an Indian Homestead no. 25506 and perfected his homestead in 1908 and therefore becoming a citizen Indian and surrendered his right to any benefits as an Indian person. The homestead is adjacent to the hot springs at Cupa. Domingo later sold the homestead for $20,000. Because of this action none of the heirs of Domingo Moro should have been allowed to participate in any benefits granted Indians.

So, these are some of the historical facts that surround Robert Smith. Most notably is the fact that he has no Cupeno blood. His mother is of San Felipe, a village that was known as a traditional enemy of the Cupeno people.

Is it possible that this tribal enmity survives even to this day? Yes, it is.

It is easy to justify your own wrongdoings when you consider that the acts are intended to harm your adversaries. It was common knowledge that Robert Smith’s mother was a thief and dishonest. She was  a known drug dealer and used her sons to do the same. At one time, the people voted to ban the Smith brothers from ever participating in tribal government. This did not deter Robert Smith from seeking and gaining power within Pala.

He became the Fire Captain of Pala and used his office to intercept information vital to the people of Pala and this his how he began his political ascent. Cal-Mat often ignored the will of the people by making side deals with the Smith family so that they would favor some of the malfeasance at the sand and gravel operation. In exchange they were given money, televisions, VCR’s and other treasures of the day in exchange for their loyalty to Cal-Mat. The Smith family successfully blocked any raise in the royalties owed to the people for more than 10 years resulting in hundreds of thousands of dollars in loss to the people of Pala.

Robert Smith, after serving for a short period on the Executive Committee, was elected chairperson of Pala. Although being illiterate, Smith was and can masterfully manipulate people and resources to his complete advantage. He is willing to use any extreme necessary for his own personal benefit, including murder, and without any regard for the people. To him people are disposable and often in the way.

With the election of the Robert Smith as chair, began the criminalization of the Pala Executive Committee. He was often making side deals and if an Executive Committee member opposed him he just kept the deal secret. He stole thousands of dollars from acorn sand and the propane business. He gained complete control over the distribution of illicit drugs within the community, an enterprise which he continues to this day.

He has developed a solid following of loyalists who are dependent upon him for illegal drugs and jobs. This is bolstered even more by family loyalty and therefore giving him an invincible block of votes at meetings and elections. This has given Robert Smith free reign and even worse, complete sovereign power. His sovereign power is respected by the United States, the State of California, local governments, the Courts and without regard for the heinous crimes that he has committed.
So what crimes has Robert Smith committed. He is a known drug dealer. That career almost came to an end when an ATF sweep of known drug dealers resulted in the arrest of 66 people including Robert Smith. The drug ring was suspected in generating moneys for terrorist activities and providing support for terrorists overseas. It is said the Robert Smith avoided prosecution by turning state’s evidence and assisted in the locating of other suspected drug dealers in this operation.

Robert Smith is suspected of either committing or participating in the murder of eight people to include the murder of Rainey Williams and the campground murder. This does not include the murder of his constituent drug users that made the mistake of turning against him. Many would find them themselves victims of intended drug overdoses.

Robert Smith was caught red-handed taking bribes from the wake board project. It was also discovered that he and the treasurer were receiving $10,000 each per month for the race track deal with no benefit to the people.

Robert Smith engages in the daily management of the Pala Casino which is a violation of the Indian Gaming Regulatory Act. The Casino maintains two sets of books. The Black Book contains the accurate record of the Casino earnings and the Green Book is the numbers reported to the people. The Black Book revenues are skimmed and distributed to Robert Smith, Howard Dickstein and others.
The Casino self-banks the atm machines and therefore creates a digital highway to move moneys outside the casino and making them free of the NIGC jurisdiction. These moneys are not reported in the Green Book and the actual location of these transfers is not known to the people.

There are a series of illegal loans taken under the signature of Robert Smith and therefore obligating the people to pay back these loans. No one knows where the moneys go. That is except for Robert Smith.

Rumors of Robert Smith’s illegal activities could fill a book. They are cleverly created and when challenged he simply screams sovereignty through his million-dollar attorneys. It is funny how attorneys are supposed to defend what is right but will often defend what is most money making. Oh yes, the attorneys are paid for by the people of Pala.

There are rumors of pay day type loan businesses which were established through a Montana Reservation contact. This was noted by several private jet flights to Montana. What business does the people of Pala have in Montana?

The Robert Smith “Black Credit Card” is a known commodity by vendors throughout the Temecula and San Diego County regions. The Black Card is the property of the people of Pala and whatever Robert charges on this card is obligated for payment by the people of Pala. If you don’t know what the status of a Black Card is it simply means that he charges any amount to the card without question. Yes, that means that he can charge a million dollars to the card and the people of Pala must pay the bill.

So why is it that the people of Pala remain loyal to Robert Smith? That is not entirely true. There have been wrinkles in Smith’s ascent to power. Former and well-respected chairman King Freeman often opposed Robert Smith. For this Robert Smith disenrolled many of King Freeman’s family and therefore rid himself of much of his opposition.

Robert Smith was openly opposed by the famous 11 who are now banned for life from participating in tribal government. The BIA refused to recognize the valid action by the people of Pala to remove Robert Smith from power. This was the final signal Robert Smith needed to fully realize that he can commit whatever crime he wants and not be punished.

Now his party of loyalists are governed by fear. Robert Smith can have you evicted from the Reservation just for looking at him wrong. He can have your  house bulldozed. He can punish your relatives as a message that you better keep quiet and not talk about him. He can take away your per capita. He can have you fined for entering your own Reservation lands. He can destroy or block your road to your property. If none of this works, he will have you murdered just as he did in the Joe Scott incident.

All these activities are sanctioned by the Secretary of the Interior, the Bureau of Indian Affairs, the National Indian Gaming Commission, the Federal Bureau of Investigation, the Office of the Inspector General, members of Congress, State and Local Governments, the District Attorney of San Diego County, the Sheriff’s Department of San Diego County, and the Courts.

So what hope is there for the people of Pala? Absolutely none. All the people can do is hope and pray for the demise of Robert Smith. Even that is proving to be difficult because his criminal cohorts are determined to keep him alive. He has had his veins and arteries scraped to remove blockages. We do not know if he has a real or artificial heart, kidney transplants or a liver transplant. We do know that he has undergone several medical procedures to keep him alive and able to continue his criminal activity.

The people of Pala are suffering a long and slow death. It is nauseating, suffocating, drowning, a slow poisoning, a death by a thousand cuts, deprivation and disregard. If you want to feel completely helpless and hopeless then just come to Pala. Correction! Come to Robert Smith’s Pala.

The people of Pala used to be good and caring. They still are. It may be too late for the people of Pala if Robert Smith is allowed to continue with his criminal activities. Yes, this is a cry for help. It is very doubtful that the agencies with the power to thwart Robert Smith will come forward. What is their price. I hear some sell us out for a mere ride on Robert Smith’s private jet while others are rewarded with retirement benefits beyond imagination.

The one known fact here is that Robert Smith will eventually die. We all do. How much damage will he cause before his death? As much as he can and as much as his mind can conceive. The people of Pala will be left penniless and no one will care because we let it happen to ourselves. Why would any taxpayer want to bail us out after we allowed Robert Smith to squander away billions of dollars? They won’t. Realize that. They won’t, and we will be done as people. Good bye to Pala.

I'm going to start this off by not blaming rob for anything. The people of Pala are to blame for everything. This isn't an issue of what rob has done. This is an issue of the people letting him do it. There is no care for future generations of Pala, if there was there would be outrage. Venezuela for example people are rioting for their families future. Once the people of Pala start taking responsibility for everything that has happened, is happening and will happen if nothing is done. You adults have to think of 10 years from now and how everything is going down right now it doesn't seem like there will be anything from 10 years from now. When i think of my kids i think of them being MY responsibility. I have to make sure they have clothes, food, and a bed to sleep on. Why would i put those responsibilities in someone else's hands. The world can be ugly and the world does not care about your problems as it should be. So elders, Parents, Aunts Uncles whoever look at your young ones sons daughters neices nephews and go through hell for them so they never have to. What needs to be done is getting the corrupt people out of office, term limits, and power back to the people. If its your tribe why do you have to be scared to say anything or be disenrolled. that isn't right! i can only imagine how much money rob has hidden whether its offshore, other businesses or false employee incomes. i do not believe any payment breakdowns that he shows you guys. i feel he knows he can show a BS breakdown and nobody will question or no what the actual numbers are and he just skims off the top into an offshore or just to gamble/personally invest in. I also believe he has a major gambling problem have you guys ever thought how much he could be gambling online with his Pala interactive venture or how much money hes cleaning through the laundromat? so the more you guys lay down the more hes going to take advantage of it. Rob is thinking of his family and his generations when will you start thinking of yours?

Adolpho Moro has his kids from a sivimut.

Adopho Moro's kids were chutnicut not sivimoot. Even if that were true, does this make what Robert smith does okay? Don't understand your point. Chutnicuts were a mix of luiseno and digueno but not cupeno. Chutnicut means charcoal in luiseno. Ask then why was it necessary to adopt Johnny Chutnicut if they were from Warners. Let me see, I am Nowlet so I guess that means I can kill, cheat and steal from the people.

Every family from Kupa and Wilkalpa are mixed, either with Luiseno, Digueno, or Cahuilla. The Cuoeno peoole are a mixture of different lineages, there are no full Cupeno lineages.

@ 1:08 PM
It doesn't matter who Domingo Moro knocked up whether it be a Sivamot or even his own sister the children from this man can not claim his bloodline to be enrolled in any Reservations Tribal Roles.
So also the fact that on Marie Smiths birth cert. it is listed her father is unknown and so in the words of Robert Smith himself that makes her 1/2 white and who knows what else.
As for Robert Smiths father Victor, he can not claim the bloodline of his Grandfather because of his grand father being a citizen Indian.
So your honorable Chairman Robert Smith DOES NOT HAVE THE BLOOD OF THE BAND to be enrolled in Pala.

I am tired of hearing this obscure, undefined, hidden "citizen Indian" law. Where exactly is this law in the US statutes, I have looked and have found nothing. Where is the law so I can read it word for word an understand how Indians cannot claim their bloodlines because of this law. Please post the law, or at the very least provide a statute number or a link to where we can all read it, otherwise that remains an unproven opinion and is just bullshit.

The Homestead Act. This letter was written on November 25, 1918 and states:

Dear Mr. Wadsworth:
In response to your letter of the 18th, concerning Domingo Moro, you are advised that he is a fee patent Indian; his fee patent, dated Oct. 29, 190u8, covers Lot 1 and NE1/4 NE1/4 Sec. 25 and Lot 4 SE1/4 SE1/4 Sec. 24 in T. 10 S. R. 3 E. S.B.M., containing 138.52 acres. His name appears on no census. His fee patent calls him a Copeno (Copa) Indian. His name was dropped from the census when he became a citizen by virtue of the fee patent cited above.

Now that this has been posted and we all know Robert Smith should not be enrolled since his families rights were given up to be a citizen does that change anything. NO” because he has the power over enrollment and he will not correct his own blood degree. The more of the info that gets posted it seems every family has a doubt that could be used against them for disenrollment. That’s why enrollment should be left alone. Reinstate the Brittens and then make an amendment to stop this from happening in the future. This will not happen and nothing at Pala will change for the better or start on the path to be fixed until Smith and nieto are out. The problem is they have a fear they will be disenrolled if they are not in power because the Remijo Lugo and Citizen Indian stuff can be used against them to correct the rolls. Their family also knows this so they will keep on voting them back in along with the people they allowed to be enrolled without the blood in order for votes. I don’t see anything changing for the better until smith dies or they both get arrested. Or which is a big IF the people get together and demand answers !!

I am still confused. I just read the Homestead Act and the Dawes Act, both can be found here
https://www.ourdocuments.gov/print_friendly.php?flash=false&page=transcript&doc=31&title=Transcript+of+Homestead+Act+%281862%29 and here https://www.ourdocuments.gov/print_friendly.php?flash=false&page=transcript&doc=50&title=Transcript+of+Dawes+Act+%281887%29 The Homestead Act excluded Native Americans. The Dawes Act, sometimes called the Homestead Act for Indians, does mention Native Americans who have lived separate from their tribe as being declared citizens of the United States, but also states that the said citizen Indian does not lose any rights to tribal property and any other property. Section 6, the last sentence of the Dawes Act specifically states that Indians declared citizens DO NOT LOSE their rights to tribal property. Since membership into a tribe and all the rights that are afforded to members of a tribe are and can be considered property, Indians who have lived off the reservation, who have bought fee status land, and who also have allotments, are not any less Indian than Indians who live on the reservation or who have allotments under the Dawes Act. In fact, the Dawes Act protects Indians who have gained US citizenship from losing tribal rights and property. The letter posted above from the Superintendent of the Pala School dated 1918 is nothing more than a misinformed teacher, who has no idea how the law wold be applied, understood, and presented in Domingo Moro's specific case. I am not defending anybody, I am defending the interpretation of the law, the understanding of the Dawes Act, and it application to Southern California Indians. Understanding how laws work, whether they be from the 1880s or 2019 is important, because all laws are written new, and the consequences and varying circumstances that follow the law through misinterpretations, conflicts, and legal arguments ultimately shape how the law is interpreted. A further analysis of the history of the Dawes Act over time since its inception through the legal record of the Supreme Court can reveal a discourse, or way of talking, about how the law is shaped, changed, interpreted, and re-interpreted over time as it is applied to various cases involving American Indians, American Indian tribes, and US citizens. That is how law analysis works, and is the cornerstone of Supreme Court decisions, which take into account, all prior cases, opinions, histories, and narratives whether they derive form case law, court law, or university scholarly research. I think it is important to understand the law, because once it is used to try and gain something over another, through a re-interpretation of the actual intent, then that interpretation can be wield to harm and have power over others in the future, which can harm this community in more ways that we can predict. Also, if your main argument centers around a misinterpretation of a law, then your argument becomes a fallacy and can never be a valid point or argument through which to gain support for your cause. Sounds like you guys have a better case in determining Domingo Moro's bloodline, rather than whether his citizenship status, property status, and rights to tribal assets, property and rights is valid through his heirs. In other words, check his bloodline rather than whether his bloodline should be counted in the first place, because the Dawes Act specifically protects Indians who are viewed as citizens.

Reinstatement_Restitution said...

Here is part of the Dawes Act you are attempting to interpret:

"[E]very Indian born within the territorial limits of the United States who has voluntarily taken up, within said limits, his residence separate and apart from any tribe of Indians therein, and has adopted the habits of civilized life, is hereby declared to be a citizen of the United States, and is entitled to all the rights, privileges, and immunities of such citizens, whether said Indian has been or not, by birth or otherwise, a member of any tribe of Indians within the territorial limits of the United States without in any manner affecting the right of any such Indian to tribal or other property."

This section of the Dawes Act says that Indians that leave the reservation, and live separate and apart from any tribe can be declared U.S. Citizens. As US Citizens they are no longer tribal members. In those days Indians were forced to live on reservations. Tribal membership was determined by a census of the Indians living on the reservation. Living off reservation meant renouncing tribal membership. Citizen Indians did not relinquish their right to tribal property, however, Citizen Indians could not receive land allotments because they didn't live on reservations. Allotted land by definition is federal trust land on a reservation that is patented to Indians.

So the wording about retaining property rights to Indian land is ineffective. Reservation land is owned collectively by a tribe, allotted land is patented to individual Indians, and Indian Citizens did not participate in either.

Now Let's clear up the part about descendants. Descendants of Citizen Indians do not retain the same "right of any such Indian to tribal or other property." There is nothing in the Dawes Act that allows Citizen Indians to pass on rights to tribal property to their descendants. Descendants of Indian Citizens are US Citizens by birth, and are not members of any tribe.

Domingo Moro was not allotted land at Pala like the Agua Caliente Cupeno Indians. He was awarded homestead land near Warner's Springs in exchange for the renunciation of tribal affiliation and the promise that he would live on his homestead and give up Indian ways. He lied. He went to Pala after the removal and attempted to gain whatever benefits the federal government offered. He was considered a progressive Indian who cooperated with the BIA. In exchange for this cooperation, his daughters were allotted because the BIA did not strictly enforce the provisions of the Dawes Act.

The Pala School was a BIA Office on the Pala Reservation. The Superintendent of the Pala School was a BIA official located thereon. There was also a Farmer and a Teacher that were federal employees stationed at the reservation to assist the Indians.

Domingo Moro lied well. He was even appointed to be the Tribal Policeman at one time despite the fact that he pledged to live off reservation so he could have land. He and Henry Smith partnered together and attempted to start a business on the reservation. They were bad businessmen and the Store they operated failed.

The point of all this is that Domingo Moro's daughters should not have been allotted land at Pala. They should have been required to live off reservation as US Citizens since their father was a Citizen Indian. Resources were in short supply at the time, and should have been restricted to the Warner's Ranch Evictees.

On Domingo Moro's 1928 CIJR he says his father, Adolfo Moro, was born at Sonoma, near San Francisco, yet both he and his father claim to be full blood Cupeno. Once again he lied. The lies were intentional, designed to allow the liar to obtain federal benefits.

Henry Smith was a liar too. He lied to the BIA that he was 1/4 Mesa Grande Indian. Then when he wanted to go into business on the reservation he said he was white to get an Indian trader's license. The pattern of lying to get benefits has been passed on the their descendants, and reached a ludicrous apogee in the character of Robert Smith.

Smith is such a habitual liar that he really doesn't recall what the truth is anymore. He will probably lie and say he does know what the truth is, however telling the truth never got him anything so he doesn't do it.

Whatever. We have covered this territory over and over again. The cheaters always seems to think the truth is open to interpretation, and prefer the lies that justify their criminal actions. Is that why you want to argue about Citizen Indians?

The bottom line here is that Robert Smith knows full well that he does not have the bloodline to be enrolled on the Pala Reservation Roles and he will do whatever it takes for the real truth exposing his lies and his corruption from coming out.
His mother was 1/2 white and who knows what else and has no real ties to the original Warner Springs Cupa Tribe.
The blood degree is just not there antway you look at it.
The only thing that she has passed on to her kids is the ability to lie and cheat their way into places that they don't belong in.
Being that her birth cert. states that her father is unknown makes her 1/2 white in the eyes and the statements brought forth be her own son, Robert Smith when he used this formula for the disenrollments against the Britten family.
With her bloodline as is with 1/2 white and being from
another Reservation like Mesa Grande and having no direct linage to the Kupa Tribe from Warner Springs means that none of her children have the blood degree to be enrolled on the Pala Reservation.
And for this reason Robert Smith can not afford to be ousted from the chairman seat he now holds because without any doubt a new chairman can use this information to disenroll him and his family members if that is the will of the people.
And also the fact that Theresa Nieto's blood line is also in question makes her and her family members a target also when a new chairman is seated and that why they can't afford to lose an election and fix the voting to go their way.
I think that a special meeting should be held and fix the Tribal Roles Tribal and put the Britten family members back on the Roles first and then motion to leave the Roles as they are and no more disenrollments ever.
Because if this is not done there will always be more problems and more hate to come when new people are elected to serve on the EC.
This problem is very fixable now but might not be in the near future.

I say go a little further, DNA testing. Give Tribal members 30 days to complete a DNA, with a company that has no affiliation with the tribe or EC, keep it confidential, hire the geneoligist who worked on Pechanga to determine whether or not the person is actually a Pala Tribal member. Remember, some were enrolled using both parents blood even though 1 was enrolled at another Tribe so Robert established a precedent for all.

Your interpretation of the Dawes Act is dangerouse. The law states that Indians who are considered US citizens do not lose their "rights to tribal or other property." The Supreme Court of the United States continually views tribal membership as a right that can be viewed as property. Not all property, in the US Supreme Court law, is tangible land, it also includes other property, such as rights that being a tribal member will afford. I do not know what else to say to you. Fee land is any land in the US not owned by the US government or State government and is taxed. Trust land did not exsist until the Dawes Act, in so far as tribes and its members are concerned. The letter from the superintendent states that Domingo Moro's fee land is from 1908, how is that part of Warners unless he has other land elsewhere. My point is, that the status of the land is irrelevant, whether it was obtained through Homestead or Allotment, Indians are protected under the Dawes Act to tribal property and other property, which is interpreted by the Supreme Court as any right afforded to membership. That is how the law is interpreted in 2019, not 1880s or 1908. Also, all enrolled Indians in the United States are considered US citizens, and hold dual citizenship with the US and there respective tribes. You argument is ijnvalid and fulk of fallacy, but if you want to misconstrue the law for your own gain go ahead. I am just suggesting to go another rout via bloodlines and blood quantum, but that will also need to be addressed because in 30 years the tribal membership blood quantum will need to be addressed or their will be no tribe. So, if the blood quantum is changed to lineal descendant or 1st and 2nd descendency, everybody arguing with eachother will still be eligible for enrollment. All anybody would have to prove is continual lineal descent to an original evictee of Warners and the surrounding areas of landless Indians that make up the current Blood of the Band. DNA can only prove family connections paternity, not blood quantum or tribal affiliation. I will stop bringing up this point. In reality, the tribal community in Pala will discuss and vote on the things that they deem important, sometimes is is good and other times it is bad, but that is what governance is, the ability to make decisions and live with the consequences.

One more thing I forgot to mention. All Indians received an allotment, whether they were adults, orphans, head of households, widowed, or children. Just because someones father was living off the reservation and deemed a "civilized citizen of the United States," does not mean that he/she nor his children should not be entitled to an allotment or access to tribal property. The only way an individual would not receive an allotment is that they were not part of the tribe, if you re-read the Dawes Act there are sections that explain how to provide all members lots depending on their social status (widow, head of household) and age. Also, according to the Dawes Act, all individuals were allowed lots and access to resources, if anything was short, then it was adjusted so the above allotments were given out. Remember, the purpose of the Dawes Act is to break-up tribal cultural beliefs concerning communal property, to Americanize all Indians, and to free-up land for white settlers. I understand all of the other issues of your argument about not being Cupeno, about lying about blood quantum, and about being an overall asshole, but the point about "Citizen Indians" not being able to access tribal property and other property is wrong. If that was the intent of the Dawes Act and the interpretation of the law, then everybody would not be able to access tribal property and other property because the main purpose of the Dawes Act was to convert Indians into Americans, by destroying traditional beliefs over land and introduce individual property ownership, farming, and--with the introduction of subsequent policy and laws like the Indian Re-organization Act--destroy traditional leadership and ties to old ways including ritual/ceremony, religion, language, hunting/gathering, traditional healing/medicine, and the reliance of the older traditional intersected social/political/economic/religious society that distinctly governed Southern California tribes for generations.

@ 11:43 PM You are barking up the wrong tree. R&R has no say over the situation. It is in the enrollment ordinance of the Pala Band. If you are a Citizen Indian then you do not get their tribal rights. It is not up for our interpretation, it is up to the those who enroll and their laws. Since you are so well versed on the issue, you should know this. You complaining to R&R about your opinion is pointless. It is like you are scolding the disenrolled for following the laws of the tribe, while the leaders do as they please. The disenrolled have been non-stop in their battle, they have gone over every bit of evidence, every approachable angle, every court, every Government entity. One day Robert and Teresa will pay, unfortunately they will take many down with them. But they will fall. Thanks for your help, but you need to go to the DOI and tell them to change their laws, or their interpretation of the law.

Reinstatement_Restitution said...

It is quite common for people to conflate modern tribal law with that of the past. The Dawes Act is no longer effective law. The Indian Reorganization Act supersedes the Dawes Act, and extends the patents on allotted land indefinitely. Citizen Indians no longer exist. All Indians were declared citizens by virtue of the Snyder Act of 1924. The historical actions of the BIA still have some impact in the present, but you have an erroneous view of tribal property and property rights.

There are hundreds of decisions issued by the BIA that state the same thing: Individual Indians do not have protected property rights in tribal land.

Tribal land is the jurisdiction of a tribe; it does not belong to individuals. It is land held in trust for the benefit of a tribe. The interest in tribal land is shared by all tribal members, and only members of federally recognized tribes can participate in the shared interest in tribal land.

Allotted land is patented to individuals. It is also federal trust land, but the tribe does not have jurisdiction over individually allotted land. The Tribe would be trespassers if they violated the property rights of allotted Indians.

The interpretation that you say is dangerous is the federal government's interpretation, not my own. The federal government created Citizen Indians in the hope of enticing Indians to renounce their tribal affiliations and become assimilated into "white" society. Sorry if you don't agree, but the children of Citizen Indians were born as US Citizens and did not have tribal affiliations. That was the whole point. Relinquish tribal membership, stop practicing tribal culture, get some free land, become a citizen and gain access to all the rights that were denied Indians, and your children would enjoy those privileges and rights from birth.

Allotted Indians lived on reservations. Citizen Indians were awarded off reservation homesteads. Why is this so hard to understand?

I know. You probably think that Citizen Indians should be allowed to be tribal members and US Citizens at the same time because that is the way it is now. It wasn't like that when the laws were introduced.

Land was held in trust by the Federal Government long before the Dawes Act. The first reservation was created by European Colonists in 1758 and the practice continued as the US Government sought to expand its jurisdiction westward.

@11:43 you sound like you work for Dumton's Law Firm. Sounds like you are getting training from Ms. Shitswallow. There is no logic in your arguments because the facts have already been settled. Domingo Moro was a citizen Indian, he was not allotted at Pala, he is not affiliated with any tribe and his patent WAS NOT ISSUED UNDER THE DAWES ACT. So you can talk Dawes Act all you want but it does not apply in this case. So please please please explain why your arguments are forgivers for all the wrong Robert Smith has done to the Pala. Forget that Dumton's is getting rich from wrongly representing Robert Smith instead of Pala. When Smith goes down look for your time to be coming as well. Obviously you are defending Robert Smith because you are complicit and no that is not a fragrance. Yes it is, you both stink like crap and that is your complicit fragrance. One day soon you will be stinking up a court room wearing orange jump suits. See you then.

Robert Harrison Smith and Theresa Jo Nieto are just plain and simple SEWER RATS.
Sorry sewer rats i didn't mean to insult you.

Anonymous said...

I hope this talk about the Rainy Williams girl is true.
Every one in Pala knows that Andrew Smith killed her and his Pig Face brother Robert helped him cover up the crime.
One is as guilty as the other.
They need to be found guilty and sent to Prison for the rest of their life.

Anonymous said...

Robert is up to his old diversionary tactics again. He tried to draw the attention of the people away from himself and onto the agua caliente cupeno. It is quite funny that he says the millions and millions of dollars is being used to pay attornies to defend pala in court, when the truth is the agua caliente have never sued pala. All of the cases were and are against the BIA. Yet the people believe his lies and turn their attention to the people He has already disenrolled, bulldozed their house, banned them from meetings, took their per cap and so much more and for what, for trying to inform the people of Roberts ways and betrayals to the people. You the people of Pala need to wake up and turn your attention back on Robert because its not the agua calienti cupeno that started this, its all Roberts fault. He is to blame, none of this mess would have happened if it wasn't for his greed and hate. Pala you need to become people again and stop being steeple.

Anonymous said...

@ 12:59 am
What do you mean Robert is blaming Agua Caliente for costing the tribe millions? When was this brought up? Defending Pala from what?

Reinstatement_Restitution said...

The Agua Caliente Cupeno Tribe has never sued the PBMI. The PBMI is not a party to the suit being decided in the 9th Circuit Court of Appeals. Smith is a liar and proves it whenever he opens his mouth.

Anonymous said...

He is running scared because he knows that the information given to investigators working the Rainy Williams case is true and factual about him and Andrew.
He is trying to get everyone to put their focus on some
other bullshit so people won't focus on him and his dirt
bag brother Andrew for covering up the facts about their
involvement with the Williams little girl who they abused
on a daily basis.
Just think how DNA has improved over the years scene the
little girl died back in 1989.
And give praise to Law Enforcement personal who had the bright idea to keep samples of DNA over the years.
Unless Robert and Andrew are 100% sure that they can beat the pending charges of their involvement they better high tail out of town real soon because they are going to arrested and dealt with.

Sad to say but another person has passed away in Pala about an hour ago.
After going to jail for 6 month and having his home bulldozed while he was in custody by by your honorable
chairman Robert Smith and having his vehicles impounded
Andrew H. Castillo AKA HAWKA passed away this afternoon.
Instead of the EC giving him the help he needed they
choose to ignore his cry for help and have him locked up and now he is dead.
They offered him nothing but sorrow and grief instead of helping him.
Who will be next on the EC's list to go.
How about going to the peoples list and take the two top names and bury them in Gregory Canyon away from the
Pala Indian Reservation AKA Land of the Cupeno.
If you guessed #1 Robert Smith and #2 Theresa Nieto then you are the grand prize winner.

Anonymous said...

@ 5:17
Sounds like another threat to Smith and Nieto has died.
Robert Smiyh was afraid that Kawka would do something to him or Nieto for having Hawka's house bulldozed while Hawka was locked up.
That is a chickenshit way of doing something like that,
bulldozing a seniors home and impounding all of his personal property without even notifying anyone especially a Tribal Member who needed help for his problems.
But everyone knows how the EC operates when it comes to people/members that they want gone.
When its their family members that are in trouble they use Tribal funds to bail them out and Tribal Attorneys to defend them and the Tribe pays the bill.
And who the fuck does Jimbo Goodpasture think he is by impounding this mans vehicles.
No law enforcement authorized the impounds of Mr. Castillo's vehicles but Goodpasture did it any way.
That is considered vehicle theft and he should be charged as such.

Anonymous said...

Jimbo Goodpasture is nothing but a big ass crybaby and doesn't belong in Pala .
He is a fraud and a liar and will do so to get what he wants no matter who it hurts.
He should banished from Pala Reservation for life.
Him and his good for nothing kids that he adopted.
How in hell do they get to be on the Bands Roles with no blood of the band, not one tiny drop.
You see Jimbo was adopted by his parents when he was an infant he has no blood line connecting him to the original Kupa from Warner Springs yet he is enrolled along with his kids.
I guess that's what sucking Smiths little dick will get you.

Anonymous said...

Howka would never threaten Robert or Theresa, he had too much other stuff to worry about like that slutty casino whore Liz ????. You Rincon peeps keep an eye out for her, she is no good and likes to latch onto per capita men. She brings in the low life druggies, has committed identity theft, fraud, bigamy, and God knows what else. She did Howka wrong.

Anonymous said...

That's true about liz.
Howka told me that she even got a hold of his tax return one year and cashed it and also one of his per capita checks got taken by her and that's the time she was gone for about 2 weeks and cried like a little bitch to come back when she ran out of money.
Howka was a good guy and would give anyone who needed help what he could and never expect anything in return.
And for someone to take advantage of him like that needs to get her ass whip up.

Anonymous said...

I agree with the two prior post however i think that the EC members did wrong by having Howka's house bulldozed and his vehicles impounded by the Tribe while he was locked up.
They should have tried to see their options concerning
what they could have done to help him.
That's where i think that the EC acted to quickly to destroy his home and belongings.
That was every thing that Howka had and things that meant
something to him and the EC invaded his live and turned it up side down.
And that's just not okay to do something like that to a senior member of your Tribe.
Tribal members in Pala are treated like shit by their so called leaders.
Robert and Theresa Nieto treat outsiders better than they do their people.
Either of them will rarely say no to an outsider that needs something or some kind of sponsorship from the PBMI.
But when it comes to the seniors or the Elders of the Tribe everyone knows what the answer is going to be.

Anonymous said...

She’s a percap trap

Anonymous said...

Can someone tell Liz that Robert Smith wants a second chance at their romance.
She is the one that Robert Smith was caught kissing at the Casino Hotel Lobby by Casino security last year.
He will probably enroll her in Pala.

Anonymous said...

Any woman in her right mind wouldn't touch Smith with a 10 ft pole. He is so gross and inarticulate, not a man or anything resembling a manly person in my book. He lacks any kind of sex appeal, if you want to put lickstick on a pig, that would be more appealing.

Anonymous said...

How about sticking an apple in his mouth and a cucumber
up his ass and roast him over a fifty gallon drum so that all the grease won't contaminate the ground water.
That's why he needs so much money, he has to pay for sex.
All of his cousins have cut him off, including his wife.
" Go back to San Felipe Chief little pee pee."

Anonymous said...

If Liz the casino whore has any brains she'd stay away from Pala. The family doesn't want her there for anything since the bitch never told anyone he was sick much less in the hospital. He was there for days before anyone knew. So any tweakers reading this, tell your casino whore buddy to stay away, she's not welcome.

Anonymous said...

What is her last name?

Anonymous said...

I have no idea, she's stolen so many peoples identity she probably doesn't know.

Anonymous said...

Robert Smith is the enemy, not this Liz person. Maybe in your eyes, she has hurts a few people, but in my eyes, Robert Smith has hurt hundreds of people by denying them their birthright and the worse part is he is enjoying every second of this. Im sure the woman you are speaking of has done wrong, but she probably did it out of necessity and did it to survive the only way she knows how. Don't vilify someone who may have or may not have taken advantage if one person, then on the other hand say nothing about the number one enemy of the Cupeno people, that troll named Robert Smith!!! He is a sub-human who has done nothing to empower the people, but has instead raped people of their God given rights. Just let her be and remember who the true enemy of the people is, Blobert Smith. He the one who has stolen hundreds of million dollars, siphoning casino profits into Pala Interactive, he's stolen money from the coffers and used money for his own selfish purposes, so put the blame where the real blame belongs!

Anonymous said...

WE need her last name so we can have banished from the Pala Reservation for life.
So if anyone knows her last name please let someone know
okay. Thank you .

Anonymous said...

d.n.a. does not mean anything to Robert smith, mel gave Robert smith the d.n.a.said that cindy leal is not a lavato, robert lost the papers.

Her supposed name should be on file in the housing department because he would have had to put her full name on his family occupancy.

Anonymous said...

Both are thieves in their own rights. This woman is as vile as they come and needs to be banned.

Anonymous said...

Didn't Hawka marry her, so her last name would be Castillo.

Anonymous said...

Nope. He was/is still married to Chris.

Anonymous said...

Wouldn't it be smarter to go directly to his brothers and sisters to ask them these questions vs visiting an online forum to ask these questions?

Anonymous said...

I am closely related to him. He is still married to Christie. Jokes on that Casino tramp Liz. My family found paperwork that confirms this. I agree ask his family, but nowadays you have to have a valid reason with evidence to back it up to ban someone from the Reservation. I would say her crime filled background would be enough.

Anonymous said...

Typical pala, all worried about a woman who Andrew seemed to like & have no problem with, worried about what or who she is going to do next when it's none of anybody's business. Trying to conceive a plan to have her banned, REALLY? THATS ALL pala does anymore, kick people out. Why don't you worry about the REAL problem in pala? Like how many millions is Robert going to steal from your "BROKE" band this month, yeah that right, "band" , cuz no matter how many times you call yourself a "tribe", the reality is your not one haha. If you all would try getting rid of the real problems in pala, ( Robert, Theresa, & dion), maybe it would be a better place to live. But at least the next G.C. meeting should be nice and short with just a eviction on the agenda hahaha

Anonymous said...

Well what do you except, Pala needs something to put on their agenda.
If it wasn't for evictions the agenda would be blank.
Why, because it seems that talking about business is against the bylaws of the Tribe/Band.
I guess the General Membership voted to not talk about any business at Tribal meetings only FAKE FINANCIAL REPORTS and FAKE STATEMENTS FROM FROM CHAIRMAN
ROBERT UN SCHMITT AND THERESA HUMP NIETO.

Anonymous said...

DON'T FORGET THE TOWEL BOY DION "WIPE IT CLEAN" PEREZ.
AND ERIC "PULL MY PANTS UP" ORTEGA/GARCIA.
AND JIMBO "LICK MY NUTS"GOODPASTURE.
AND KYLE "OPEN THE BACK DOOR" FELT.
Going to a Tribal Meeting in Pala is like watching a
rerun of the THREE STOOGES.
I WOULD LIKE TO STAND BEHIND THE EC AND SLAP THEM IN THE HEAD EVERY TIME THEY TOLD A LIE.
I WOULD HAVE ONE HELL OF A SORE HAND.

It is important that people put up here as much information as they may have on the criminal activities of Robert Smith as well as his brother Andrew. BIA and other government offices read this site and they need to know the real Smith brothers and they need to quit supporting them. I reviewed the list of criminal activities in guest bloggers post and they forgot to mention the multiple rapes that Robert and Andrew were involved in. What is so honorable about that. I guess Robert pissing in a hallway of the casino really isn't crime. The only reason Robert freaked out was because it was on video tape that he couldn't find his dick. The camera caught all dimensions and it can only be described as almost non-existent. So Robert fired the security guard so she couldn't tell everyone what she saw or should we say what she didn't see. So whatever crimes you may know that the Smith brothers have committed, open up and let the world see what loathsome creatures they really are.

Anonymous said...

That explains why he walks around with a cucumber in his pocket.
He thinks that it looks cool when women sit next him at the bar.
I wonder how many women have be disappointed when they see what "Big Chief Little Pepe" is really packing.
That's why he has to rape women/boys because everyone would laugh their asses off because according to the video it's so small that it can't even get past a women's lips.

Reinstatement_Restitution said...

Before the point is lost in the insults, it seems that Pala members are ready and willing to evict people from the rez, but they refuse to confront Smith and Nieto for their mismanagement of the Band. Where is the sense in that?

Really. Evictions don't put a penny in anyone's pocket. But Smith's mismanagement is taking away from everyone.

We know you are greedy. That is why you put up with Chairman Porky. Aren't you greedy enough to make him accountable for stealingress so much money from you?

Anonymous said...

After all the bad news about people dying in Pala lately
finally some goods news to report.
Chairman Porkey Pig Smith was rushed to the Hospital today with a possible Heart attack.
It was said that he was holding his chest and saying that it hurt when the Fire Guys were putting in the
Ambulance.
Prayers do get answered.

Anonymous said...

Okay 6:17 is this a bad joke or is it as serious as a heart attack. Want to know when we can start the celebration. Keep us informed. Best news ever if it is true.

Know it true and as i hear anything i will let the site know.
Our Ancestors are very pissed off.
The EC is their target.

It's the truth about him going to the Hospital.
I hope they took him to the Hospital in Temecula because the Doctors that work there are not very good.
I wonder if we can bribe them to pull the plug.

Gregory Canyon Graveyard, are ready for your fist grave

Now is the time to call an emergency meeting, legally, you give him prior notice and he can't come to break it up.

Anonymous said...

I think that the investigation of the little girl being reopened is the cause of Robert being taken to the Hospital complaining of chest pains.
The stress is going to kill him and it should because him and his brother are guilty of taking that little girls life and really need to be punished for it so she can rest in peace.
Don't you agree.

Anonymous said...

Hey Andrew how are the night mares going.
Are they still haunting you like they were.
Are you still losing sleep over them ?
You are GUILTY OF TAKING MY LIFE, is that what she says to you in the night mares?
How about Andrew.
Can you still see the image of her after you and your brother abused her?
I truly hope so, and i truly hope that it takes it's toll
on the both of you.
There is no way out of this one boys, you will be charged real soon.
Have a nice nap.

Anonymous said...

Turns out it is true. Robert was transported to the hospital yesterday. No one seems to know if he had a heart attack or other problems but it should scare the shit out of him that God can take him at any time and he has not made things right with the world. Doesn't matter to us. Once he is gone we can reclaim Pala and make it what it used to be and for the people again. I hope the truth about Robert is putting stress on him and that he collapses under the truth. If we can't vote you out Robert God will do the work you have prevented us from doing for so long. No shame here. Wishing you dead. Really wishing you dead. Go away. May God take you and send you to hell where you belong. Go away.

Anonymous said...

And take your fucking low life Brother and Daughters with you if you don;t want them to suffer for your treatment of the Cupeno people.
Because when you are gone they will suffer along with Theresa Nieto and here family.

Anonymous said...

Unbelievable!!! How can someone be so bad that even hell doesn't want him. Yes the asshole is home from the hospital. So if hell doesn't want him what does it mean that Pala does? What does that say about Pala. More misery to come. More cuts in per capita. More millions stolen from the people. Pala is hell.

Anonymous said...

Going to have to shoot him in the head to get rid of him.

Anonymous said...

Well if that's what it's going to take then so be it.

Anonymous said...

Robert Smith is the biggest fraud now playing at the pala drive-in movie.
Watch him as he steals all the money from the quiet ones,
AKA Pala Band Members.
I think that when they are called Band Members they think that they should learn how to play a guitar or a sax, or trumpet or some kind of other instrument in order to be a Band Member so they just sit there and never learn what it takes to be a real Band Member, that's how brain dead these people are.
Better wake up real soon because the the conductor is going to steal every last penny that he can.

Anonymous said...

If you Pala Members are to chickenshit to go after Robert Smith and Nieto at least have the balls to back up the ones that are not to chickenshit to go after them.
By you hiding and staying quiet is just adding more power
to the EC's agenda to hurt other families.
I cannot believe that all of the members are afraid of
Robert Smith, you know that fat little German so called man that is destroying the entire Pala Indian Reservation
along with his mom blood of the Band Theresa Nieto and Dion Perez.
These corrupt money grabbing lowlifes need to be gone from Pala ASAP and move3d to Morrongo where they belong.
Actually anywhere but Pala would be okay. but prison would be my first choice.

Anonymous said...

To the blog owner,
Can you please forward a copy of this post to the
Carlsbad office of the FBI.
Address it to the Agent in charge of the Pala Case.
They will be expecting it ASAP.
They will look into the allegations of the post.
It is not important to name the source of the post just the allegations is all they are interested in.

Reinstatement_Restitution said...

Is the FBI internet challenged? They can get a disabled placard for that I think.

Anonymous said...

Why can't you just go along with requests R&R.
Everyone knows that Smith reads these post and the more info that is requested by someone at least shows that things are still going on.
Who's side are you on anyway.
Maybe it makes the EC nervous when they see that any law enforcement is wanting information on them and they will slip up.
I know its hard to believe that the FBI will do anything
about Smith and Nieto however i have some knowledge that there will be an arrest warrant coming in the very near future so i am not going to give up and it doesn't matter which law enforcement agency wants info on the EC
I will do my best to give it to them if they request it.
