It says “adopted by ballot vote” was there a ballot vote ever done to approve the Constitution or was it done at a regular meeting with only a few tribal member there? Even the BIA states it should have been by ballot vote. So if it never was approved by the band then we are run by the Article’s of Association and if we still can’t agree then we revert back to Custom and Tradition. Either way the EC doesn’t have the power.

Well then why is the BIA not doing their job and Remove the EC members aka Smith and Nieto for forgery charges.
They have forged so many documents that are considered official
government documents that they should be in Prison for years.
Stop dragging your asses and at least earn an honest pay check for once, if that's even possible.

Also look at the dates. Why did it take 4 months to submit the fake documents to the BIA?
There was NEVER a ballot vote as indicated by the BIA response.
The BIA says that they received the amended document on 3-21-95,
the EC states that it was approved on 11-22-94.
Why the 4 month delay in filling the documents.
The BIA should file charges against Smith and Nieto for forgery, after all we are still governed by the Articles of Association.

According to the Articles the EC "DOES NOT" have the power to disenroll anyone.
If the current EC had any brains they would re-enroll the Britten
Family as soon as possible so the Tribe/Band can start the healing process to make the Tribe/Band as strong as it once was.
There has to be away to press charges against them for stepping outside their scope of authority for the disenrollments along with the BIA for their part in the scam against the Tribal Members which they are supposed to protect.
They the BIA approved documents knowing full well that they were forged by someone on the EC.

There already was a lawsuit filed against the EC for overstepping their authority. The case was dismissed because the court ruled that the EC was acting in their official capacity and were protected by sovereign immunity. Embezzlement is a criminal activity and tribal members could swear out a complaint against the EC with the California State Attorney General. It would take evidence. The FBI is a federal agency. California is a PL280 state. There might be jurisdictional conflicts that have prevented the FBI from indicting Smith. Sure would be nice if information filtered down to the General Council, but the EC withholds all information and lies about everything.

PL 280 only applies to criminal and civil proceedings. If the crimes he is accused of are federal then the FBI has complete jutisdiction, if they are not federal, then the County Sheriff has jurisdiction.

County sheriff is in Smith's pocket. Crimes against the Band would be federal jurisdiction. Crimes against private citizens like disenrollees could be prosecuted by the state. The jurisdictions can get a little fuzzy. First you need better evidence than hearsay.

The FBI has all the info on Smith using the Tribes credit card at these shops so why isn't the FBI pushing for prosecuting him.

Using the tribes credit card for purchases is not a federal law violation. If anything that matter should be brought up and handled within the tribe.

You guys need to go around and talk to the families on the Rez that feel the same way about dissenrollment that you feel. Make sure you have more then half of the enrolled tribal members. Then coordinate with them and all of you go to a tribal meeting and demand "not ask" that the brittians be re enrolled. Regardless of how you feel about the brittians, dissenrollment is wrong. You guys have opened a door that could lead to future dissenrollments. Settle this as a internal tribal matter. The general counsel is pala not Robert. If you have over half the members on the same page you won't be shouted down at a meeting. And Robert can't dissenroll half the tribe. Dissenrollment is a shameful act and any tribe that does it is weak and should be ashamed. I also feel that anyone that Robert has enrolled should also stay enrolled. As I said before no dissenrollment is okay.

Has anyone seen the monster truck on display at the Casino entrance
that belongs to the "Pala Band".
Who authorized the purchase of this truck?
I can tell you for sure that the cost was at least $125,000.
Hell I bought a 4 wheel drive ford truck last year also black and it cost nearly 50,000 after every thing was added up.
So I know that this Monster Truck is at least double that plus the extras.
I guess that black American Express card is getting a good work out.
We over heard some employees talking about the truck and they said that it belonged to the Chairman.
I guess the post earlier was right about his spending the Tribes money with out anyone caring.
What's next? hopefully a new or used Coffin for the Chairman.
Shit I know some Members would probably pay for that.

The time has come for everyone to face the truth.
Robert Smith is a fraud and a liar as well as being corrupt.
Knowing all the evidence and proof against him and Theresa Nieto, you
still don't care enough to get him out.
So where do you stand with the way that the PBMI is being over run by these bastards?
What about your family, don't you care about what they will endure
when you are no longer able to protect them.
So you are not willing to speak up and defend your family's rights as Tribal Members as long as you get the little check every month.
Well what about when you die and your family gets disenrolled and kicked off the Reservation where you and them grew up.
Doesn't that matter to any of you?
Come on now you cannot be that stupid.
Can't you see what is going on around you while you sit there with your thumb up your asses.
Can't you put 2 and 2 together and come up with 4.
It's just a matter of time when Smith and Nieto get tired of you or your family and decides its time to banish you from Pala and take everything away from you and your loved ones.
It's like you never even existed.
That how the disenrolled must feel, knowing that they are cupeno and have a right to belong in Pala.
But they also know that you are the ones that are sitting there and letting this happen to them by not speaking up against Robert Smith and Theresa Nieto.
Wouldn't you expect the members to help you or your family if the were to endure the same treatment as the disenrolled have?
This may very well be your last chance to speak up before you
die or are disenrolled yourself.
Are you willing to take that chance and leave the future of your loved ones in the hands of Robert Smith and Theresa Nieto.
If you are then I feel sorry for you.

Print this shit out and hand it out before the next meeting and demand answers from them. If they don't respond motion to end the meeting and shut it down and leave. He cancels meetings all time so now it's your turn and don't give in to them anymore.

It's already in the works, fliers are being made and will be handed out in a day or two.
There is so much shit that's about to hit the fan that you should wear
a mask to protect your health.
It's really deep.
So deep that Law enforcement will wish that they stepped in before now.
But it's to late for that.
Everyone is so sick and tired of the EC's bullshit.
