JULY 14, 2018 - Irvine, CA - Fox Racing, the global leader in MX and MTB gear and apparel, announces a partnership with the Pala Band Of Mission Indians to create "Fox Raceway." Located in Pala, CA, the Fox Raceway features world-class motocross tracks, an all-new Fox Racing retail store, and many other features that make it the premier motocross track in Southern California.

In addition to six beginner to pro-level motocross tracks, Fox Raceway has an all-new covered patio area, a fully stocked Fox retail store complete with product demo and jersey printing capabilities, the first "Jeff Emig's Learn To Moto" center, and a year-round schedule of consumer activations.

Fox Raceway is located at 12799 California Hwy 76 in Pala, CA.

Hours of operation are Monday-Tuesday and Friday through Sunday from 8am-5pm.

Here we go again.
Another business deal made behind the backs of the General Membership
and having to find out this info second hand is bullshit.
The main reason that these types of deal are made by the EC are because this is how Smith makes his side money which he share with the EC, sometimes.
He will tell the General Membership that they voted to approve this deal at a meeting 6 months ago and the GM will do nothing but sit there and scratch their heads.
Show us the contracts signed by the EC and the Fox Raceway so we can judge for ourselves on this venture.
Its ok because the Feds are already looking into it.
Trying to find out how much Smith got in the envelope he received.

We need an AUDIT as soon as possible if you want to know the truth
about all the financial transactions of the Pala EC.
Motion to have one done and in you motion make sure that you state that the outcome be given to the General Membership before the EC has a chance to alter any of the findings.
This would prove the EC's guilt or innocence of the charges against them.
Every Tribal member knows that Smith and Nieto will fight this 100%
because of their guilt.

Someone said that his share was around 30 grand on the fox racing deal I will try and confirm this amount through my sources and see what they came up with.
Also I was told that he also received some shares in the deal.

Okay Mr. Honorable Chairman show the contract to the General Membership between the Tribe and fox racing and let the General Membership have an Attorney review it and see who is the real liar and the corrupt ones in this bad deal that was never brought to a meeting for a vote by all adult members of PBMI.
It should a given that these kinds of deals should be approved by a special meeting for a specific purpose until we get an honest EC that we can trust to make decisions for the best interest of the Tribe as a whole and not just 6 people who are proven crooks and corrupt and only out for the good of their greed.

File an appeal to the Regional Director of the BIA, include a request that the sitting Director recuse herself becausemail of a well known personal bias in favor of the Pala Chairman. Appeal a blatant act to circumvent the General Council and an attempt to generate revenue that is not accounted for in the revenue distribution agreement in order to embezzle from the Band. Cite the PBMI Constitution which requires that the General Council approve contracts entered into with the Band as a party. Or is the Band a party in the contract? It might be a personal agreement, but unlikely since Smith uses the Band's sovereign immunity to shield him from lawsuits.

Do it right though. Make sure it is against tribal law to enter into contracts without GC approval. For all I know there is an ordinance or resolution empowering the EC to act without GC approval. However, the gaming ordinance does extend to contracts outside of gaming, and its language authorizes monetary and funding decisions, not a contract with an outside business to operate on trubal trust land only for the benefit of the Chairman.

He received $20,000 and 150 shares in fox racing for his getting the contract signed by the rest of the EC and the General Memberships approval which no one remembers voting on at a meeting or even being discussed at a Tribal Meeting.
This is nothing new anyway, because they (the EC) never brings up any ventures like this at a meeting because it would open up the subject to be discussed and the EC does not want that to happen because it would expose their corruption at the Tribal level.
By the time the General Membership out about these deals it to late to ask questions anyway because the contracts have already been signed by the EC and the phony minutes from a never held meeting will show the General Memberships approval.
So guess who wins this battle.
You are right if you guessed Robert Smith and his supporters.

Ever wonder what takes place on the very top floor at the Casino hotel.
That's where Smith and the G.M. count the money and skim off the funds that he needs fast.
And he thinks nobody knows about it.

Nobody is disputing a tribes sovereign right to determine its own membership which means a tribe can set the criteria for enrollment and then every member must qualify based on the enrollment criteria. In Pala that’s not what’s happening and the BIA should be able to step in and not trample on Pala’s right to determine its own membership. You see Soboba, Cahuilla, Morongo, and Pala all enroll Margarita Brittain descendants but only Pala enrolls with MB listed as 1/2 Cupeno and the other 3 tribes enroll with her as 4/4 Cupeno the way it has always been. So even tho a tribe can determine the qualifications for enrollment who determines natives blood degree?? Isn’t the BIA suppose to be the record keepers of all natives and have a central data base where each original allotee and every native has their blood degree on file? This should be the final say on natives blood degree and then each tribe can enroll members using whatever qualifications they like but all have to use the same data base for Native Americans blood degree. Pala has enrollment qualifications which are a direct descendant of an original allotee in the 1895 or 1913 rolls and at least 1/16 Cupeno. In order to make the disenrolled not meet these qualifications they lowered Margaritas blood degree and never gave the tribe or BIA a reason why??? So the BIA is not interfering with Pala’s enrollment by demanding they list MB as FULLBLOOD like the BIA,Dept of Interior records state. They are not telling Pala to change their enrollment criteria just that they have to be correct and accurate when using natives blood degree and lineage. A birth certificate and census is not something you can just change it is fact and every tribe should have to use the correct data. Imagine your state Governor made a law that only Mexicans can live in California. That is California setting the rules for who can live in their state (like a tribes membership). Your mom is Mexican and your dad is white so you could live in California but then the Governor says no your not Mexican your only white you need to leave the state. Even tho you have documents and census records stating your race over the years the Governor doesn’t have to accept it or even look at it. Or he does look at it and says this is incorrect you are only white not Mexican so you need to leave California. Same thing that is happening in Pala. If the Federal government said its California’s choice to decide who can live there and they can’t interfere. The Federal government isn’t really interfering in California’s law by looking at your records and telling California you are half Mexican and it is a fact so they need to list you as such. Now then if California has to except the truth that you are Mexican and can stay in the state then it is also their right to change the law so that only Irish can live in the state and the Fed’s can’t intervene that is California’s right. As long as they use the correct census for every person and not change them to suite their needs like in Pala.

Was this venture approved by the BIA?
Aren't they supposed to approve the use of Tribal land leases to these outside businesses before a contract can be signed by the EC.
because of the land being held in trust status by the government.
Show the signed contract to the General Membership and let them decide on the lease terms and see who is screwing who.
I wonder how many other ventures that the EC has made that can harm the Tribe in the future.
What does Shasta G. have to say about the impact report.
What about Caltrans report on traffic conditions.
I remember once that an event at the Racetrack backed up traffic clean down to the I-15 freeway that caused many headaches for people going east on highway 76 trying to get home during this event. WHAT About emergency vehicles trying to get to medical emergence during times when events are taking place at the Track.
Lets see the CHP reports and their view on road conditions during events at the Fox Racetrack.
Just wait and see how much this will cost the Tribe, and it will not be cheap.
You think rush hour traffic is bad now just wait and see what its like when this shit gets going full on.
And don't forget who put us in this venture in the first place.
If you guessed Smith and Nieto you guessed right.

It sure isn't the members of the Tribe because they are the ones that will have to put up with all the traffic headaches that will be coming with deal.
And for Shasta g. not providing an impact report to the General Membership to view is not acceptable after all doesn't work for the TRIBE or is she just another fraud put in place to please the chairman
and his corruption.
She should be fired.

You are correct about the traffic coming through Pala at rush hour and the headaches that this new venture will cause Tribal Members.
Sometimes you can not even pull out of your own driveway because of the current traffic.
And the contract that the Tribe supposed to have with the CHP just doubled and will probably triple after this track is opened at full speed.So the Tribe as a whole will have to pay extra for more CHP officers to direct traffic on top of the one hundred and eighty six thousand dollars that we now pay for them for only 2 days a week.
What is the Pala security officers problem anyway can't they do the traffic control instead of the CHP.
After all they are all paid good wages to work for the Tribe.
Or should I say SLEEP for the Tribe.
Tim Ravago stinks like ass for him sitting in it so much.
The flies enjoy it when he is stationary, which is most of time.
There is no reason to have to pay for a contract with the CHP when Tribal Security could or should do the same job.
At the very least this might make them earn some of their pay.

I heard that Tim Ravago is getting a brand new security vehicle that is supposed to fitted with a lic. plate reader to see who is coming around the Rez.
His old vehicle smells like ass from him sitting in it so much.
The only one that enjoy Tim's vehicle are the flies that it attracts when he is parked somewhere sleeping.
Do not disturb him when he is sleeping or he might shoot you in the back when you are walking away.
They do not need new vehicles for security, if anything they should get new bicycles to ride around during the day this would keep them from sleeping on the job and keep them healthy.

They are protecting Smiths personal dumping grounds off and on the Reservation and the Tribal Members are paying for this, not Smith.
Why are they so protective of the ponds west of the Casino towards the old dairies.
Is there something in the water that they don't want found by anyone.
They are always parked there, why?
Is the Joe Scotts grave.
Or is the old Ashley property where they buried him.
Either site could be the gravesite, they won't let the Ashley property be searched by anyone they say because of scares plants on this site which is bullshit.
This property is and old mining site that George Ashley mined for many, many years.
Maybe by them saying that there are scared plants they mean something else is planted there like bodies.
And for them to patrol the pond area on Hwy 76, the Tribe doesn't even own that property.
Why is no one questioning these types of doings by the EC and their so called Security patrol.
Its a waste of Tribal funds for sure.
You figure the gas used, the wages paid, the cost of maintaining the vehicles and see how much this cost on a Tribal members.
Its a lot of money every year paid out for what.
Nothing that concerns the Tribe, so it must be something personal that they are protecting.

Just talked to San Diego sheriffs death unit commander gave him the info of some of the thoughts that some people have on the Joe Scott missing person story and they were also told that the Ashley property was a scared place because of the Native plants on the property
but they will try another approach with the BIA, being that the property was originally owned by a non Indian and was never placed into trust status until just recently.

Also other tribal members that allowed him to set a new standard will suffer because he has made disenrollment ok at Pala and whoever comes to power next might hold a grudge or look into other families and it will be ok to disenroll with no recourse because it has already been done. He has made it ok to have no term limits and over rule the general membership which has also been done. People don’t realize by allowing the current EC to do these things you are also allowing future EC’s the same power.

The EC said something like to help cover charges for the new add-ons at the Casino.
However didn't the EC borrow the millions needed for the expansion
cost? so why did they put it the Members for this when they don't bother to involve the General Membership in making other decisions.

Robert Smith and Theresa Nieto do not deserve to breath the same air as other humans do. They need to be hung in the Pala park for all to see what corruption will do to you when you cheat the people that you are supposed to protect.
They seriously need to die so everyone can get on with the life that they deserve and that our ancestors built for everyone.
They have gotten away with so much while serving on the CUPENO peoples EC.
They will never stop the corruption as long as they are alive.
The Feds can't seem to find enough evidence to lock them up or they are told by their higher ups to take the hands off approach because of all the Tribes money that gets donated to there funds and the major players in the State and Federal governments as well.
So the only thing for the Tribal Membership is to do away with the two main corrupt EC members once and for all.
I an totally surprised that no one has even attempted to kill them so far but I think that this could be the game changer for them lowering the Members per capita for no other reason except for their corruption and greed.
What happened to all the other investments that someone was posting about saying that the other investments would take care of the Tribal Members for a long time.
THIS IS ALL BULLSHIT, ITS ALL ABOUT GREED AND CONTROL OF TRIBAL MEMBERS.

Anyone have their copy of the invalid Revised Pala Constitution handy?

Article V, Section 9, Part D, Treasurer: "All Financial records shall be audited at least once each year and such other times as may be directed by the General Council."

Make a motion for an independent audit by an accounting firm chosen by the EC with reporting responsibility to a committee not chosen by the EC. I suggest a committee of elders of families directly descended from the 1913 and 1895 allotment rolls.

Like Robert Smith will even let people talk at a meeting, much less make a motion. All I can say is waiting for another rigged election is not a good strategy. Doing the same thing over and over again but expecting a different result is the definition of insanity.

You have to wonder what it is going to take to get Pala Members motivated enough to make a change in tribal government? Disenrollments, Pala Interactive, entering into contracts without GC approval, phony financial statements, rampant crime and corruption, per-capita reduction, meetings where no one can talk, Pala Security that protects the criminals from the good members, FBI and IRS investigations, favoritism and extra money for those that participate in the Chairman's crimes, enticing members to spy and turn in their family members, making PBMI into a Luiseno tribe, etc. The bad news just doesn't stop coming.

Is the money that keeps getting less really worth all this? Especially when the real money that comes from the Casino is supposed to be all for the members. It looks like Smith and Nieto keep upping their share of the revenue and lowering the members' share.

In the end Pala Members will have to blame themselves for all the damage done, and the good members will suffer just as much as the bad members for not doing something about it.

OPEN MESSAGE TO THE FEDERAL AGENTS THAT ARE READING THIS BLOG.
This issue that is taking place on the Pala Indian Reservation is a serious violation of many Federal Laws and State Laws also.
So why are you allowing this to even take place where you have the jurisdiction and the authority to stop it.
This is no Monday morning joke told at the office, it is a real crime that no one seems to care about.
What is it going to take to have justice for these people that are on the brink of taking this into their own hands to settle this problem.
There is so muck evidence on here and on the other blog that it is mind bogging that you are not taking this serious.
They are being threatened, kicked out of their homes, losing their healthcare, losing their income, and even dying all because no one not even the FBI will step in and help these people.
Aren't you and you Government Bosses supposed to protect and serve all of these people and not just the ones that control the money.
This is why some people choose to take matters into their own hands,
because they feel that you don't care enough to even do your own job.
The U.S.Government says it can't do anything because of the sovereign
status of Tribes.
However we are also considered U.S. Citizens so why can't you help them.
Do you believe that it is okay for the Leaders of these Tribes to continue their corruption and hurting of these people by doing whatever they please to them, even having then beat up or even Murdered, if so then maybe it is a waist of time by depending on you for any help.
I have never seen or heard of anything like this where there is no justice for victims of these types of crimes especially violating their civil rights as is done on a daily bases.

It is a difficult question to answer: Why does the federal government support an evil tyrant like Robert Smith and turn its back on anyone that tries to challenge him? Sovereignty protects tribes from lawsuits, but why does the Court bend over backward to extend sovereign immunity to proven criminals like Robert Smith? Why does the BIA reject appeals from Pala members trying uphold tribal law and give deference to tribal the Pala EC when they consistently act outside tribal law?

For example, the General Council is supposed to approve contracts before the tribe enters into agreements. The EC has entered into a bunch of contracts without GC approval. Attorney contracts are supposed to be approved by the GC and the BIA, but Robert Smith has more attorneys than you can shake a stick at and who can name them all? None of them has been approved by the GC, but all of them were approved in a blanket motion at a GC meeting without knowing who the attorneys are, what services they provide, or how much they charge the Band.

Then there are federal funds which the Band receives as grants and targeted funding that should be accounted for as income. Does anyone know how much the Band gets, what it is supposed to used for, or how it was actually used? Just try to complain about it to the feds. You get no response. FIle a FOIA request for the records associated with the funding. The BIA lost them or sends you redacted e-mails or sends unresponsive documents.

It keeps going on and on. Loans using casino revenue as guarantees purchase assets or enterprises that the Band knows nothing about, and only benefit Robert Smith, like Pala Interactive or Pala Raceway. Why does the federal government let Smith earn personal income from tribally owned businesses? When you complain about it, or provide evidence it becomes part of some larger investigation that never ends. Each one of the examples is an easily provable crime that would result in an indictment if it was a private citizen scamming American Citizens. But if the Honorable Robert Smith commits a crime it is swept under the rug because he is only stealing from his own people, and they should stop him themselves?

Well we can complain until we are blue in the face but it doesn't matter. Indian on Indian crime doesn't matter. The feds let it happen because either they don't care, or it is part of an agenda of genocide. It is racism of the most egregious kind, but has been going on for centuries.

The only goal that this venture will be is to screw up the traffic more than it is already.
The tribe should have given the General Membership a chance to vote on this and possibly find a different place to have a track of this size. Maybe like Gregory Canyon, or the Roberts Ranch property that the Tribe purchased in Pauma Valley.
This site is to close to the village and will be a problem for all the people that live in the nearby area.
