Attention True Agua Caliente Cupeno and Warner Ranch Evictees

Notice to all the True Agua Caliente Cupeno and Warner Ranch Evictees out there.  Robert Smith is trying to organize people at Pala to go to protest a hearing about Warner's Hot Springs development.



This is laughable since Robert Smith is Chairman of the Luisenos.  



Not only does Robert Smith claim to be the Chairman of the Luisenos but he also has a track record of harassing Agua Caliente Cupeno descendants.  He lead the charge on disenrolling 168 Agua Caliente Cupeno.  Later when Cupeno elders tried to hold a meeting they were punished and not allowed to ever vote or participate in meetings again.

Robert routinely orders Pala Security to harass Cupeno descendants.  Many family members who live off the reservation cannot visit their family members who live on the reservation without fear of reprisal.  Robert Smith takes action and fines Cupeno for just trying to visit their family and routinely threatens to take their per capita away.

Robert Smith destroys Cupeno land and refuses to pay what is rightfully owed.

Robert Smith has stolen the per cap of 168 Cupeno for the last 6 years.  Hundreds of millions of dollars stolen.  Robert Smith has altered the blood degrees of all the Cupeno trying to erase their memory.

Robert Smith now has the BIA changing Pala to Luiseno affiliation only.

Robert Smith and Theresa Nieto stole the Cupeno Children's Trust Funds.

Robert Smith and Leroy Miranda tried to play cute when they had opportunity to buy the Warner's Hot Springs Resort (Kupa).  Instead of just buying Kupa, the ancestral homeland of the Cupeno, he and Leroy tried to buy membership shares so they could drive the resort into bankruptcy which they did.  There they thought they would buy Kupa cheap but the judge refused to sell to them because of their actions.

It's a good thing the judge did that because Robert Smith hates the Cupenos.  This is because Robert Smith is from San Felipe while now claiming to be Luiseno.

This is a sick joke that Robert Smith is playing where he would dare to organize a group to "save Kupa" when he could have bought Warner's 4 times and each time he balked.  He routinely takes action to hurt Cupeno people with disenrollments, sanctions, fines, banishments, and evictions.

To all True Agua Caliente Cupeno and Warner Ranch Evictee Descedants please attend the meeting.  See the flyer below.  Do not let the Fake Cupeno Robert Smith continue to destroy our heritage!

And don't forget!  Robert Smith is the one who put that fence around the Cal Rossi Trust next to Kupa.  In the process he destroyed all sorts of Cupeno artifacts and violated the land.

Robert Smith is no friend of the Cupeno and should never be allowed to set foot at Kupa (aka Warner's Hot Springs/Agua Caliente) ever again let alone try to organize a protest?

What is Robert protesting?  There is nothing more that Robert Smith loves than seeing the destruction of Cupeno sacred sites.  Robert is probably secretly in favor of the developments and is just trying to shake the money tree of the owners.

The Cupeno in Pala, just don't get it, they do not understand their history is slowly being altered to erase their Native Existence. I already saw a post of the flyer above by a Cupeno to go to the meeting to support Robert, they are just helping the process to go faster, so f....ing sad. They do not believe us when we tell them stuff and some of them won't even talk to us anymore, even sadder. What did we do wrong? We are trying to preserve our blood and blood line, while we watch our relatives help Robert destroy our heritage.

It actually is the best time to catch him off the Reservation and provoke him into committing a felony, he can't cry sovereignty there. It needs to be something to keep in jail just long enough to call an emergency meeting and have him ousted. Or something that keeps him away without being able to come once he hears about it. He has his spies everywhere, who are hurting their own people for more money in their pockets, they are lining their pockets with their relatives' blood.They are just as guilty, they will have to answer for the many that they have helped to hurt and destroy. I seen a recording of the meeting on Facebook. Seems like most people there wanted the resort stopped and Warner's Ranch protected. Then somebody named Murraffo spoke, claiming to be on the committee of the Agua Caliente Tribal council. Although I understand your guys fight, he totally made you guys sound pathetic. He did nothing but use that space to berate the Pala Band of Mission Indians, Cupeno people in Pala, and the Pala community in general. He spoke nothing of protecting sacred sites and the ancestral home of Cupeno people, but instead started talking about dis-enrollment, and started reading a newspaper article. For real, if the Agua Caliente Band of Cupeno Indians want to be taken seriously, then you guys need a new spokesman. Not only did Mr. Maruffo speak unintelligent, but he did so in a Mexican/Latino accent. I know not everybody was raised on the reservation, not everybody learned to speak English first, and not everybody learned Cupeno, but he sounded inauthentic and really made you guys look bad in front of Pala tribal members, the County Board of Supervisors, and the general public. He makes you guys look fake as a tribe, and even crazy as a spokesperson. I was taken aback, embarrassed for you guys, pissed off, and then amused all throughout his "statement."

The meeting was not with the Board of Supervisors and the video of the meeting is not yet available. Good one. The only fake is the Pala Tribe. The history is clear that the Yaquis, Cahuillas and Diguenos have taken over the Warner Ranch Indian Reservation and they have pushed the Cupeno aside. Yes the County needs to know that because there are specific laws that deal with who has rights and who doesn't have rights. Yaquis from Mexico have no rights at Warner Springs. San Felipe Digueno have no rights at Warner Springs. Cahuilla have no rights at Warner Springs. So the Yaqui, San Felipe and Cahuilla expression of sacred values at Warner Springs is of no value and by law and the owner does not have to respond to these unwarranted claims. Great job Vincent. The sad fact is the Robert Smith has had several opportunities to purchase Warner's Resort. Back in 1994, again in 2008, and again in 2012. Each time he deliberately scuttled the deal. The PBMI is a Luiseno tribe, and has no interests in Warner's Ranch. There are still PBMI members that descend from the Warner's Ranch Evictees but most of them have turned their backs on the Cupeno heritage.

Now the question is why are these PBMI members pretending to care about the Cupeno homeland? We all know all decisions at Pala come from Smith. He has already proven that he doesn't care about Cupeno heritage. The BIA told Smith that PBMI is a Luiseno band, and had to prove Cupeno descent in 1996 and Smith didn't care. He was content to let the BIA dictate the tribal affiliation of PBMI and didn't even tell the GC about it.

So it is just a big show. I guess some Smith supporters think Kupa is important and so Smith is putting on this show. The truth is that he could care less. He only cares about money, power and hurting people. He only talks like an Indian when he needs the protection of sovereign immunity. Otherwise everything he does is motivated by his lust for wealth and power.

I am not influenced by anyone. I am just state one opinion on the way his comments made me feel. I have lived in Southern California my whole life, and yes accents usually help people determine who people are and where they come from. How is Vincent Maruffo bad mouthing Pala people, the community, and the tribe standing up for his heritage. He said absolutely nothing about or any concern for Kupa, its sacred sites, what they mean to him and his family, or any other relevant comment. All his comments were directed at dis-enrollment. I am Cupeno, my family is Cupeno, and I have live in Pala my whole life, but after hearing Vincent Marruffo speak I was offended, he does not represent me or my family, nor did anybody else that spoke. There really was nobody there representing the tribe, just tribal members. I am also offended that because I offered some criticism of the Agua Caliente tribal spokesperson, because that is what he claimed, that I am automatically categorized as a Smith supporter. Separating the community into dichotomies is what Whites/Western societies do, to non-tribal society, everything is either yes or no. I resent that you claim to speak for Cupeno people if you cant even speak to somebody who criticized one speaker and gave some constructive criticism. Also, why is Vincent Marruffo even talking about dis-enrollment, I though his family was just trying to get money from the tribe for the sewer, not because they were dis-enrolled. The last time was when PHG offered to sell the entire ranch to robert for $100,000 over their purchase price and robert refused. So I am going to stick with my guess. You have got to be Doug Elmets. I know Robert used to pay you $5,000 per letter and press release. Does he pay you the same for every post you make?

It's true that Vincent lacks eloquence, but he has a lot of passion and he is not stupid. His family has been through so much with Robert and some other people from the tribe. He is frustrated and determined to get people to listen. He is right. What Robert is getting away with is ludicrous and the members are allowing because of their own reasons, but Vincent is standing up to him. True that he should have focused more on the heritage at the meeting.

How has it gotten to this point? How much suffering must people have to go through at the hands of another, who continues to harass, seek out, and destroy many people's lives? How many people in Pala would be alive today if the Casino, the money, the disenrollments did not happen?

Luiseno, San Felipe, Yaqui, and Cahuilla should have never been allowed to disenroll True Cupeno. It is against Santa Clara Pueblo vs Martinez which is Supreme Law of the USGOV. Very soon none of this discussion will matter because the question as to whether the Cupeno people even exist is before the Courts now. If Robert wins the Cupeno will be forever terminated and it will be noted that the Cupeno never existed as a tribe. There are a lot of legal issues in defining who is and who is not a tribe. The BIA has taken a very strong position against the existence of the Cupeno as a tribe and as a people. At the same time the BIA and Robert Smith worked together to make Pala a Luiseno tribe. The BIA is satisfied that this served to terminate the existence of the Cupeno and are making that argument in court. It will be a special day of mourning if the Courts rule that the Cupeno do not exist. What is not being said in all of this is that the Luiseno tribe, the real one, has had their tribe stolen out from under them. All of this has not gone unnoticed and as said before the matter is now in the hands of the Courts. If the Courts decide against the Cupeno then the Cupeno will have never existed and Old Pala will not have existed either. So the BIA will be succesful in terminating (illegally) two tribes in one court decision. Only Congress has the authority to terminate a tribe but the political influence of money ignores that fact. Real protection for Kupa will come from the real people of Kupa. Yes we are standing on the edge of the abyss but we are willing to face the consequences and take the necessary chances to preserve the Cupangawichum. By the way, Cupangawichum doe not mean the people that sleep here. It means "people who sleep in the water". It was the practice of the Cupeno to sleep in the warm waters of the spring on cold nights. If you are really a Cupeno you would know that.

I do not think the BIA nor the Courts are trminating the exsistence of Cupeno people. Also, if the Agua Caliente tribe does not get recognized as a real tribe, I do not think that will terminate the Cupeno people either. The facts are this: according to this website, the EC is not representing the best interests of the tribe, one family out of many were diserolled, and the EC is representing the tribe according to your opposition. The battle in the court room will not determine the fate of Cupeno people or Old Pala Luiseno people, because they are one people under the Pala Band, and that is still a recognized tribe. If Agua Caliente is not recognized, then the EC will need to be changed, but that is it. Cupeno people are still enrolled in the tribe, the majority of tribal members are Cupeno, and their history will live on. 100 years from now, Cupeno people will still be around, and a new EC will be in charge. How do you want that generatjon to relresent who they are and where they come from?

The Pala Band of Mission Indians resolved to change the name of the Pala Band of Luiseno Mission Indians and identified itself as a Luiseno tribe. The BIA agreed and granted the name change. PBMI members are now Luiseno. Some PBMI members might think they are Cupeno. Both PBMI and the BIA disagree. Everyone is just descendants of allottees. Not Cupeno or Cahuilla or Diegueno, or whatever Smith enrolled so he could get a majority vote. Your CDIB will say Pala, and that is Luiseno.

Um, we had term limits. It actually passed via Constitutional Amendment. I don't remember the year, maybe 2003.

At any rate Robert brought in his attorney Barbra Karshmer in a General Council meeting and she basically reversed the amendment that was voted on by the people.

The elections are always rigged. Kenny Johnson won one time and they just threw out a bunch of ballots and filled in a few extra for Robert. I think Kenny lost by just a few votes after the rigging.

I remember at a meeting someone asked the Chairman about the 20 million dollars that was set aside to buy Warner Springs and the answer given by Smith and Nieto was it was put into a special trust account and that was it.

Well the first and one of the most important steps to voting in a new chairman is to have a FAIR & HONEST ELECTION COMMITTEE. So the meeting in October when they have nominations and vote in an election committee is the most important meeting. Work on that and plan to have all your people at that meeting. There are more members against Smith than you know. When I bring up disenrollments Or the tribes money not adding up other members start talking when they realize you feel the same. Many members are against the disenrollments and know by the way it was done something shady went on. They also believe something fishy is going on when it comes to the tribes finances. Most people stay quiet because they don’t know where others stand with opinion but once you let them know your side they will speak up. People are tired of being afraid. NEW CHAIRMAN 2018!! A NEW START FOR PALA!
