The Pala Band of Mission Indians didn't agree to shit.
The general membership didn't know ant thing about this until it was posted on the news wire.
It should read as Robert Smith has agreed to sell Pala Interactive to Boyd Gaming.
If it is the pala band then that money should be paid to all members of the band because the band is the ones that funded pala interactive with Casino funds.

Oh that’s right a long time ago Robert had us vote to give the EC the power to make business decisions for the tribe and not tell us about it. The latest rumors around the res in pala is that Rob wants to change the chairmanship to either "President" or
"King" of the pala band of mission Indians.
But what he doesn't understand is that the only "KING" of
the Pala Band passed away about a year and a half ago.
KING FREEMAN the KING of the pala reservation and Robert can never be "KING" or even close.
Maybe he can be the "QUEEN" of pala.
There was a MOA (Memorandum of Understanding) between PBMI and NexGen/S3 where $100 million was raised to finance the development of an online gaming platform. NexGen/S3 was committed to 28.5% of the investment after PBMI guaranteed a $70 million investment. The GC was not required to approve this investment since the Pala Gaming Resolution approved by the NIGC says that the Pala Gaming Authority has financial control of the Casino and can make investments and obligations using the Casino revenue as collateral. Robert Smith is the Chairman of Pala Gaming Authority and all that is required to enter into these agreements is his signature.

So if Pala owns 71.5% of Pala Interactive then they will receive around $121 million from the sale right? So if this is tribal income should it be divided between general welfare, operations, percap, etc….. as approved by the tribe? Or better yet reinvested or put into high yield accounts, anything that benefits the entire tribe financially.
First thing though is for the EC to even bring this up to the tribe at a meeting so we know uwhat’s going on. I know most of us agree that the monthly agenda should have an “open floor” part for members to speak about anything or ASK about anything instead of the way it’s been for years “if it’s not on the agenda it can’t be discussed” and for something to be on the agenda you know who MUST approve it. Even if several members start asking or yelling out questions and demand answers he will just stop the meeting instead of answering since several of his front row supporters/yellers/ threateners have passed on and aren’t there to shut everyone up. Those same front row supporters do or did run several Pala departments. So there is a benefit to blindly supporting his agenda.
There could be other benefits to blindly supporting someone. For example getting a cushy job or your unqualified children on the rolls maybe. Thats why some tribes have their own “Tribal Enrollment Specialist/Chairman’s Assistant “ to certify family history or blood degree only for that tribe. They could just be going by what they are told or shown, who knows. They may not even know what they are necessarily doing and just going by what they are told or presented with. Those same people may have a higher blood degree on that tribes books but still can’t get a CDIB from the BIA because the BIA checks their government records/documents to verify when issuing CDIBs. So if someone you have known for years is all of the sudden enrolled or recently when they weren’t the last 20 years or the majority of their lives because they or their parents found out they have more Pala blood please think for a moment or hey tell them they should send in for their CDIB. They have updated them in recent years now and are like birth certificates for native blood degree. Hey I’m not saying this can’t happen and I’m sure a family could find out years later one of their parents or relatives has more native blood than previously noted.
The BIA has decades of history, documents, census, and will take more if you have some they don’t from extensive archive research so I’m sure their CDIBs are more accurate than say Pala who is the only tribe that has Margarita Britten as 1/2 CUPENO and will not acknowledge her descendants CDIBs that show she is full blood or submit any documentation a certain person claims to have but nobody else can verify to determine the change of MB CUPENO blood!!! Even a member of the EC at that time has spoken out and said the documents a certain person used were not valid to use by any tribe or even the BIA but they still managed to get a couple people to agree with him which overturned years of extensive research and a final decision by the BIA. But that means when someone is not in a position to block it and MB is looked into again they will see what’s what and a correction will be made.
Robert Smith will not live forever and the same goes for Nieto.
What Smith and Nieto don't realize is that they have set an agenda for future E/C members concerning enrollment in the tribe.
This will without any doubt backfire on them when they are no longer on the EC.
When a new chairman is seated on the EC he/she may want revenge for the way tribal members were treated by the current chairman and nieto and use the same things/documents that were used against the Britten family, and use it to disenroll there family members
and there is not a damn thing that they can do to stop it.
I learned a long time ago from older members that said don't get mad, get even.
I PRAY that the NEW E.C. will not be a person who is focused on the Brittan Family. There is way to much that needs attention !

there are a lot of problems in the RC that need fixing and some major problems started when Smith and Nieto did wrong by targeting the Brittan family for disenrollment.
So you are wrong by your statement.
A new EC needs to fix "ALL" the problems not just pic and choose which problems to fix fix.
I thing that it should be a priority to start with the fix of the Brittan issue because whats right is right and this would be whats right.
The disenrolled count for a major voting block and for sure were a target to keep the leaders in place and it was unfair to do what smith and nieto did without even giving the general membership a chance to be involved in the decision
against that family.

and the Brittan family issue was the start of the division of the tribe, therefore this needs to looked into in order to fix the wrongs that were unjustly put upon this family and make to where it will not happen ever again behind the backs of the general membership as was done in this case.

I just received the new letter from the Tribe regarding our properties whether they are allotted or assigned properties. Someone in housing did NOT do their homework. If you're an alloted person whose home is paid for this letter does NOT legally pertain to you at all, unless you're conducting a business which does have to be approved by the Tribe. If you are on an allotted property which has a new home built through loans from the Tribe, you must abide by Tribal housing rules listed on your ORIGINAL housing contract until the home or other paid by Tribal loan is paid off. Do your research people, those ORIGINAL housing contracts (allotted or assigned) are LEGAL AND BINDING! They CANNOT be broken or changed unless YOU the homeowner requests it. As for porches ect. if they are not attached to the original home the Tribe has absolutely no say about it. Standard contracts require the property be maintained and kept free of trash and debris. Find your ORIGINAL contract (you should have a copy). Remember you and you alone has the LEGAL right to change it.

Doesn't matter. The old AMIHA contracts are still legal and binding. Whatever Tribal ordinances that were in place of the original contract signing are also legal and binding. At that time if the homeowner passes but their spouse or long-term partner is alive, they are allowed to remain in the home until they pass or move out. If they try to move another person in the home (Tribal or non Tribal), they must move out. Non Tribal persons living in an AMIHA home not a spouse or long-term partner located on assignment must vacate the home. The Tribe cannot interfere with AMIHA homes on allotted property unless the individual living in the home is considered a threat to the community.

$192,461 for preservation of language revitalization.

Robert Smith is at it again. He is seeking new authority to disenroll people through a proposed constitutional amendment. I guess it is his nuclear option. Well, if he goes through with it there will be dire consequences for the Pala Band of Mission Indians. There is now enough evidence and records detailing the criminal activities of Amy Dutschke. Dale Risling, Harley Long and others working for the BIA that can be brought forth and force the closure of the casino. Robert knows what the real deal is here. He knows that he used the BIA to get his criminal way in the first round of disenrollments. Now he again turns to shitswallow to formulate a new scheme to disenroll even more. Understand this. If this amendment passes then every action will be taken to force the closure of the Pala Casino. Robert knows it can be done. He understands how it can be done. He has been hiding the truth from the people but if he wants to push this button then the switch will be turned on and the process will begin to close the casino. You chicken shit assholes that wouldn't stand up for the Brittains because you thought your per cap would go up, well if you pass pigfaces amendment then you will experience what the Brittains experienced as you watch all your money go away. Agreed that there is a conspiracy to commit fraud between the PBMI and the BIA based on conveying the land, assets, and revenue of the Pala Reservation to the PBMI (formerly the PBLMI). Changing the Constitution to disenroll more members is the power that Smith wants the General Council to give him. He already has that power, but if the GC votes to amend the Constitution to formalize it then all are fair game to the hatchet.
I don't belong to the tribe, but maybe only those willing to kiss Robert's ass will belong in the end.
So Pala people can belong to another band but not another tribe.

There is no way that two thirds of the voting membership will show up at a special meeting to amend the constitution.
If there is a special meeting requiring that two thirds of membership need to be present does that mean that that if two thirds don't sign in can they still hold a special meeting on that subject?
Section 2. Future Amendments
This Constitution may be amended by two-thirds vote of the voting members of the Pala Band at an election duly-called for this purpose in which not less than half of the eligible members of the Pala Band cast their ballots.
It says that the constitution can only be amended at a duly called election for this purpose.
It means Robert cannot use the regular election to amend the constitution.
It then says May be amended by a 2/3rd vote of the voting membership which means if there are 900 eligible voters then at least 601 will have to vote in favor of the amendment. Then it says the election is not valid unless not less than half of the eligible voters vote in the election. So even if 450 people vote in the election it will not be enough to pass the amendment because 601 votes are needed to pass the amendment.
Remember this is Roberts constitution. He now has to live with it. He just can't make changes on a whim. In order for him to utilize the regular election for amendments he would first have to amend the amendments section. Roberts attorneys REALLY SCREWED THIS UP.
Isn’t this like letting the state get involved in tribal affairs. So showing state recognized is same as federally recognized. States going to love this precident.
