Does the Pala Band of Mission Indians need the BIAs approval to hire an attorney? If so, is that stipulated in the governing documents? You do realize tribes do not have to get the BIAs approval for every little thing, especually since PBMI is a nonIRA governing tribe, they can follow or ignore any and all BIA recommendations. The US policy concerning tribes is currently pro tribal soverignty and self-determination.

However, if it states in the Bands Constitution that the Attorney's contracts must be approved by the Secretary of the Interior, then the Pala Tribe/ Band must comply with the rules and regulations of said Constitution.
And according to Pala's Constitution it does state the all Attorney contracts must be approved by the acting
Secretary of the Interior.
So if the BIA states that there are no approved contracts for the PBMI means that Robert Smith has lied again to the people at a recent Tribal Meeting stating that the Secretary of the Interior approved the latest Attorney contracts of, i think he said there were eleven
contracted Attorney's.

Robert Smith will probably amend the constitution again without the approval of the General Membership to say that the EC has the power to hire as many Attorney's as he see's fit without the General Membership approval.
If you look through some of the amendments to the Band constitution you will find that some of them were approved by Smith and only one other signature when they were sent to the Regional office for approval.
They were not signed by the entire governing body of the band for approval.
Most notably the signed ones contained only Robert Smiths signature and the other one being signed by Kilma Lattin as the Secretary of the PBMI.
Also on so of the amendments it states that they were approved at a General Council meeting, and that is also bullshit because the meetings are held on the second Wednesday of every month.
Some of the stated meeting were even dated for a Saturday, and other dates include Sunday and one on a Tuesday and non on a Wednesday.

Article III, Section 2, B of the Pala Constitution:

POWERS OF THE GENERAL COUNCIL
B. To employ legal counsel pursuant to federal law and subject to the approval of the Secretary of the Interior

Federal Register 7/26/2001 66 FR 38924:
"Consistent with the long-standing principle that the federal trust obligation may not be unilaterally terminated, the Act does not alter those tribal constitutions that require federal approvals for specific tribal actions, such as attorney contracts. Thus, the Secretary must still approve or disapprove attorney contracts if a tribal constitution so requires."

The Pala EC cannot employ legal counsel without General Council approval. The BIA must approve the contracts of attorneys employed by the Pala General Council.

The BIA has allowed attorneys to represent the PBMI that have not been approved by either the General Council or the Secretary of the Interior. This is a breach of the fiduciary trust obligation.

The Pala EC has employed unapproved attorneys and paid them with tribal funds. The Pala EC is guilty of violating the oaths of office and misappropriating funds.

These attorneys have represented the PBMI in court. Unapproved attorneys are in violation of the California State Bar Association for claiming to represent the PBMI when in fact they have no authorization from the Band. Their license to practice law should be suspended pending review.

The BIA is derelict in its duty for not requesting proof that the attorneys claiming to represent the PBMI have obtained General Council approval and that their contracts have been approved by the Secretary of the Interior.

Now the disenrolles may not be able to challenge the disenrollment, but they might be able to get the decision overturned if they attempt to re-open the appeal on the basis of legal violations by the Pala EC, the unapproved Attorneys that claimed to represent the PBMI, and the breach of trust duty by the BIA.

Okay General Membership her you have it in black and white as stated by the FOIA which according to the BIA
The Pala Band does not have any Attorney approved contracts.
So what are you going to do with the information.
What you should do is request a copy of all the Attorney contracts that Smith stated at the last meeting which were 11,and go through them one at a time and also ask for a copy of the approval by the Secretary of the Interior for each contract for each Attorney.
I am willing to bet that the EC can not produce any of this but will cover it up by continuing to lie.

And also request the minutes of the meetings that the general membership voted to approve all of these Attorney contracts.
Smith will turn to Theresa Nieto and get her to explain it to the members.
Nieto is not the one that was elected to have all the information, she was voted in to be the Treasurer not the Secretary which is Theresa Villa.
But he only turns to Nieto at the meetings and no of the other EC members.

An attorney contract has to be approved by a majority vote of the General Council. A resolution certifying the vote must be submitted to the BIA along with the attorney contract. Then the Regional Director has to forward the contract the Secretary of the Interior for approval.

Redelegated authority is not valid for the PBMI because the Pala Constitution does not recognize redelegated authority. The Pala Constitution would have to be amended to accept redelegated authority for the Regional Director's approval to be valid. Each contract must be approved separately. Approval of all contracts is invalid because that means the GC was not able to review the specific terms of the agreement.

Robert Smith has been circumventing the authority of the GC, and the BIA has cooperated. The federal government has a duty to approve attorney contracts in order to protect the Band from unfavorable terms. Unapproved attorneys are responsible for the disenrollments. They advised Smith on the drafting of the Enrollment Ordinance that gave the EC disenrollment powers. They advised Smith to withdraw from the Southern California Tribal Court so there would be no recourse for the disenrollees.

They drafted the Gaming Ordinance that turned over ownership of the Casino Hotel Resort to Smith. They have helped Smith usurp the power of the General Council, directly harmed members, and assisted with the embezzlement of over a billion dollars that should have been distributed to tribal members.

There is proof of conspiracy to commit fraud. Smith has submitted falsified documents to the federal government. The attorneys have protected Smith from prosecution for his corruption. The BIA has approved numerous illegitimate actions of the Pala EC under the pretense of tribal sovereignty.

Just recently the BIA issued a correction the date of the approval of the Pala Constitution. This is the same approval that the Ninth Circuit ruled was time barred to challenge due to the expiration of the statute of limitations. Smith submitted falsified minutes from the Special General Council meeting of 11/19/1197 to support the date change. His attorneys from Denton's, who have not been approved by the General Council or the Secretary of the Interior submitted an Interested Party comment to undermine the standing of the appellants, and the BIA dismissed the appeal.

The design of the conspiracy is blatantly obvious. Smith is paying off BIA officials. The BIA rubber stamps his requests. The attorneys serve his personal agenda and have never consulted with the General Council. Smith owns the Casino, and uses the revenue for discretionary spending.

Wise up Pala members.

The important issue here is the cover ups by the EC and not the condition of the Pala Store.
the EC represents the entire Band ,the Pala Store is privately owned.
It is the stores task of keeping it clean and not the EC's task.
You are just trying to cover up the misdeeds of the EC.
If you want to call the kettle black then look at the Pala Mini Mart first.
The whole Mini Mart is dirty beyond reason because it is being run under the corruption of Robert Smith and his partner in crime Theresa J. Nieto.
And the only way to clean it up is to get Smith out and put in a new council that cares about the resources that support the entire Band as a whole and not just a few people that skim off of the top.
So quite the cover ups and pay attention to the real problems that are getting worse day by day because of one sided people like you who think that Smith and Nieto are your Gods and can do no wrong.
Why, because they can turn on anyone even you and your family and friends, then what are you going to do.
Can you produce all the records and backing of the U.S. Government to stay in as members like the Britten's have done.
With all that this family has endured because of hate and greed, and all the evidence that proves that they in fact belong still have to fight for their rights because of Robert Smith and Theresa Nieto being one sided and corrupt.
And she (Nieto) thinks that she will enter the pearly
Gates when she dies to be with her mother is totally wrong because you can not fool the Creator up above.

I just did a little research on these 3 different companies and you can also do it by googling there companies names.
Do it and compare there findings to what the EC tells you at their so called special meeting dated for June 5, at 5 PM.
Don't go to the meeting and get blindsided by the lies of the EC.
Go to meeting prepared and ask questions.
Also find out if Smith or Nieto have any ties to either of the investment companies listed and if the sit on any of the boards connected to these companies.
Ask to see the contracts that were signed by the EC for the investments of the minor trust accounts.
And a copy of the interest paid to each trust account.
If Theresa Nieto says that the interest is paid in a lump some then divided, ask for proof or a statement from each company as to whom received the interest and when.
Ask for detailed statement from each company as far as where, when and how much was invested and into which category it was invested in.
I will bet she cannot or will not answer these questions for you because it will prove that she is a liar like everyone suspects that she is.

That's is very true.
A paid education is a great asset in today's world.
If any thing the Tribe should invest in the minors of the tribe to better their education by giving them the option of earning a degree and help them find better employment for their future instead of giving them a lump some of money at any age.
Help them learn the value of the dollar in today's world.
A large amount of money at any age will only make them more dependent on the Casino's for an income.
And that's not good because if for some reason the Casino
shuts down all of these minors will become homeless and most likely be on the streets with nothing.
At least a degree in college of some sort will be like having a savings account that you can fall back on just in case.
I believe that a one time payment of $10,000 dollars into a trust account for the minors and the promise from the Tribe to finance their education for at least 2 years of college or Trade school would be better than any lump sum at the age of 18- 25- or 30 years of age.
You figure that a ten thousand dollar investment in a good investment company and let it ride for 10 years, it will bring in a large amount for that investment.
After they turn 18 they will get their per capita anyway.
At least with a degree or a trade school certificate they have a chance to better themselves.

Yes, the children should get nothing from the tribe. Who cares if it is required to set aside money for minors in the IGRA? The important thing is that all adult members get as much as possible, and send the kids to school. Since most of them are brain dead, they will flunk out and turn to drugs. That will keep the drug money flowing, and then there will be another revenue stream for the Pala EC.

One issue not being brought up are the TRUST FUND PREDATORS, adults, family members who can't wait for the kids to turn 18 to steal their money. I know of one aunt who has preyed on all of her Pala enrolled nieces and nephews trying to steal a big chunk of their trust monies, using the excuse that she did everything for them so they owe her. It's people like that, we need to protect our children from.

The disenrolled minors accounts are still being payed into by the tribe to be cashed out by the tribal treasurer when the minor turns 18. The bank the monies are being held in do not know about enrollment and who still is or is not enrolled or entitled to said monies. They just hold the money under what ever name or account they were set up as. We are all being lied to, those account should have been closed and put back into percap funds since that was it’s original purpose. The chairman and treasurer are using these 84 accounts which now has less since some have turned 18 since 2012 and had their trust accounts pulled by the tribal treasurer to supposedly pay out to said minors but in truth they are keeping the money.
That being said paying minors is not an NIGC policy since not all tribes do it. It was something we decided to do and put it in our policy. So shouldn’t we be able to change it some it was our decision? Smith and Nieto will not allow this because of what I have stated above. They will lose their way of pulling money from the tribe to cash out at future dates . They will lie and tell us anything of why we can’t stop paying into the minors accounts.

WHEN Kink Freeman and Willy pink opposed the EC and called them out for their wrong doings against certain members of PBMI, the EC made open threats at a meeting to Kink telling him that his kids were going to disenrolled.
This is where it all started and every thing was headed down hill like a snow ball headed for hell.
So then the EC disenrolled 8 members of Kings family.
And then they went after willy Pink and dienrolled another 162 members of that side of his family.
This was all done by Smith and Nieto who persuaded the other EC members that they were right and that the BIA and the U.S.Government were wrong.
Now the EC has made even a bigger mistake by not fixing this problem that has hurt more than just the Britten family, it has affected the whole tribe because the tribal members that support this family are threatened
and bullied about what could happen to them or their family if they openly support the Britten family.
However what the EC doesn't realize is that have created a rule of thumb that can and most likely will be used to oust their family members in the very near future The EC does not give a shit about what they have done or who it will hurt after they are no longer in charge.
They only care about showing the outside people and their family that they are powerful people and nobody can hurt them.
But they have no clue what patient people can do.
I hope and pray everyday that they either die or that the people of PBMI will take a stance and oust the dirty evil bastards.
Then its on.
Their family members better have saved up some of that gravy money because they are about to suffer for what the did to the people of PBMI.
They will soon be without any income and most importantly they will be without a Tribe because an honest Chairman would do they right thing and kick them to the gutter without any doubt.

This the way i see it.
There should not be any minors trust accounts.
The parents support these kids through the years and during school months.
They provide them with room and board,clothing, school supplies and sometimes even a car and insurance.
The monies put into the trust accounts should have been paid to the enrolled parents of the enrolled minors.
Especially today where the EC has cut the Per Capita , this extra money would come in handy for those that are still supporting there minor children.
I would be different if the parents were allowed to tap the accounts for certain items that the minors need.
But the parents aren't even given the information as to where the money is being invested without going through a bunch of red tape.It's the parents that are responsible for their kids not the Tribe.

That's part of the problem, parents or other family members prey on the kids turning 18, stealing all or part of their trust fund monies. Instead the kids need to learn about how to balance their bank accounts, about how to build up their credit (God knows how long per capita will last), etc. The kids need to learn how to be self sufficient, use their money to go to school, get an education or learn a trade.

If you are really sincere about helping the next generation get educated and position them for life with or without per capita then the trust fund payout should be conditional. One third at age 18 if they graduate high school. One third if they complete two years of college or get an associates degree or equivalent trade certification. The final third for completing college and getting a bachelor's degree, or for working two years in the trade for which they are certified.

Then the trust money not paid out could be used for any college graduates that wish to pursue masters or doctorate degrees. Sure sounds a lot better than having the money stolen by corrupt parents to me. And there might be a few Pala members with higher education and leadership abilities.

I dont think the tribe should tell anybody how to live or spend their money. If you are going to regulate how new adult members recieve their share of their rightful income, then the tribe should do the same to all adults. The tribe should have resources available for education, whether it be higher education or vocational, but also resources available for employment. Not everybody can go to college, people barely graduate high school. Forcing people into positions that they are not qualified for, and then taking money away from them when or if they fail or dont comeplete is wrong. What about people who want to work and not go to college? what about people who go to college and then dont work? What about people who dont do either? How many current adukt members work, go to college, or dont do either? Social regulation never works, especially if you depeive segments of so iety from rightfully guaranteed rights. If you think per capita is not a rightfully guaranteed right for minors, and then tey to take that mo ey away from them when they are adults, what is stopping the teibe from stopping all per capita. Remeber, the majority of gaming tribes do not give members money, Southern California is unique in that they represent a small percentage of gaming tribes that distribute a portion of gaming revenue directly to members, the majoeity do not.

First of all, the Trust funds is a privilege not a rightful income. The current and past 18 year olds have shown no knowledge of how to manage their trust funds. True, a few have actually done something with it, but the majority literally waste it. They have no clue as to how to survive in the "real world " where the majority of people live paycheck to paycheck. The per capita is NOT guaranteed. With the way things are going downhill it's becoming more important to teach them how to manage their monies. I know of some younger people that have tried to get jobs but were denied because they had never worked anywhere. Working is extremely important, building up their Social Security is extremely important because once again the Per capita is not guaranteed.

All per capita is a privilege, whether you are 2 years old or 69 years old. Since the tribe distributes the per capita to members of the tribe, the minors have just as much "right" to income as you do. If you think deciding who gets income from gaming and who does not based on education attainment, employment, and/or the ability to balance a checkbook, then all members should be held and judged to that same standard. Why should the adults be the only ones deserving of distributed tribal wealth and the youth denied. The standards through which they are being judged are not even, how is that leading people to success. Set examples...

I come from the generation where both parents worked, still lived paycheck to paycheck. If we wanted anything we had to work for it, learning the value of a dollar. I agree it's a learning process, and yes, some of the adults need to grow up. I'm grateful for the values my parents instilled in us because all of us worked our whole lives, some are retired now. The important thing is we have our social Security built up along with our retirement so we all have experience budgeting. These are the values not being taught to our younger generations.

Of course that opinion is based on the lies he tells so its impossible to know anything about his financial skills except that there is a lot of money wasted.

Just think where the tribe would be if he had invested the economic development fund in Apple stock instead of throwing it away at stupid stuff that never payouts?

All of these problems will go away if everyone would just come together and vote for impeachment of the three main members of the EC that are set in their minds to destroy the PBMI.
Those EC members are Robert Smith, Theresa Nieto and her first cousin Dion Perez.
These 3 EC members don't even have the blood line to be enrolled in the PBMI.
They are guilty of so many crimes against the members of PBMI that they should be hanged by the neck until every last breath is gone from their body.
But they will continue to do these things until the day they die unless they are impeached or die from ???????.
Those that attend the meetings can see what they do when questions are asked about any thing that has to do with the finances of the Band.
Robert will look at Nieto and she will make up some excuse as to why they can't answer the questions or they will lie to the people over and over again.
They need to be shut down in their tracks and impeached now, not 30 days from now, NOW.
Everyone needs to get together and take care of this problem or it's going to get worse before it gets better.
So if you people want things to change for the better you better do something now before the next per capita cut, which is coming real soon then it will be to late.

Maybe Smith is trying to get the GC to vote in favor of eliminating the Minor's trust because he already stole the money and needs to cover his theft. That would explain why there are no financial statements of the fund. Je probably just comes up with the payouts. Any proof that there is any money in the trust? It would expose them for covering all these years for Robert Smith.
The only true way to get the information that you all want is to stand up at a meeting and motion for an Audit of all the finances of the Band and motion to request that a certified copy be given to the general membership.
This may sound like a lot but it is the only way to get your answers concerning the trust accounts and other questions regarding the finances of the Band.
The people have to be very firm with this motion and don't take any excuses from Nieto or Smith as to why it can't be done.
Get the name of the firm before hand and do a little investigating on them and see what kind of firm they are.
This is the only solution to get the right answers and not the lies that the EC wants you to believe.
By the way the last meeting went you should all know that you are being bullied by Smith and Nieto and if you take what they are telling you then it's your fault for believing their bullshit.

Investments are reported as expenses on the PBMI financial statement. The treasurer shows the operating costs of investments without reporting any income from operations.

From the members viewpoint investments are not investments at all. They are just costs that require revenue. Any income derived is mysteriously lost.

The General Council sits back and let's Smith and Nieto use tribal fund to invest in ventures that show no return to the tribe. Presumably any return on investment is embezzled by the EC. Any losses are charged to the tribe.

That's a lose lose situation. Always. Going back almost 20 years now. The tribe has not benefitted from any of the ECs investments. That is the corruption that the General Council supports by failing to follow the law and require an audit to verify the financial statement.

I need clarification I an not a member however I have a grandson who is minor of the Pala Tribal. Speaking to his mother this evening she tells me they no longer have insurance because this was cut off. Is this true? Also that her per capita was cut by 2500. Has all of this truly taken places? As I said I am not a member but absolutely willing to do what I need to for my grandson and his tribe. Can non tribal members attend meeting I just what to know whats in my grandson's future as a member.

3/4 of a billion dollars a year and about half of that is spent by the EC on bullshit investments and other worthless shit that the Band doesn't know about.

and the people don't question it.

The Pala Casino Resort and Spa is owned by the Pala Gaming Authority. This is expressly stated in the Pala Gaming Authority Ordinance:

"Section 102 Purpose:
The Authority is organized for the purpose of designing, developing, constructing, owning, leasing, mortgaging, guaranteeing, operating, managing, promoting and financing Licensed Gaming Establishments and Other Businesses and any lawful activity related thereto, subject to any limitations imposed by any contract, indenture or other instrument by which the Authority is bound. The Pala General Council intends that the Authority may assume all obligations, responsibilities and duties of the Tribe under gaming law existing at the date of enactment of this Ordinance, as assigned by the Executive Committee, with the sole exception of the power of gaming regulation, gaming licensing and enforcement of applicable law, which
powers are reserved to the Tribe."

The Pala EC fooled the General Council into adopting a resolution that turns ownership of the Casino over to the Pala Gaming Authority. The Gaming Authority is operated by the Management Board. The Management Board is the Pala EC.

"Section 108 Management of the Authority:
(a) There is hereby established a Management Board of the Authority the purpose of which is to carry out the duties and powers of the Authority as set forth in this Ordinance.
(b) The Management Board shall consist of all of the members of the Executive Committee."

This is part of the plan devised by Robert Smith to steal the Casino from the Tribe. I guess nobody read it.

The language means that the body "owns" the business, the authority to act as the owner rests with the body that was given that power. In other words, individual members who sit on the specificed body that is granted ow ership do not "own" anything. In 5 years if new people are elcted and sit on the body that does not mean the old members still own the casino, the power of ownershio rests within the entity designates as owner, not the individuals. Get a life!

If the tribe elects different people to the EC, then ownership changes hands. It still is not owned by the tribe until the Ordinance is revoked or superseded, and the NIGC approves the change.

Another problem that i see with the so called Tribal Attorney's is that Smith uses them to hurt members of PBMI and that is a conflict of interest because they are paid with tribal funds which belongs to all tribal members. So how can the attorney's that represent the PBMI be used to go against tribal members?

The GC has never challenged Smith on the attorneys he uses. The GC did not oppose the Pala Gaming Authority Ordinance. The GC did not overturn the disenrollments, even though the GC voted that Margarita Britten was full blood Cupeno in 1984. The GC did not demand an financial audit.

There is no doubt that Smith is a criminal, and that he has implemented a years long plan to usurp the power of the General Council, to remove BIA approval over amendments to governing documents, attorney contracts, and enrollment appeals, and to control the Casino and the revenue. The GC has slowly been transformed through the death of elders, the restriction of certain members right to participate in tribal government, and the enrollment of supporters that assist Smith in controlling meetings and elections.

Now the GC is not a governing body even though the Constitution says it is. The GC is not the arbiter of enrollment, the authors of laws, or the owner of the tribe's main source of income. The GC is the owner of the Chairman's debt. The PBMI will be paying off the Chairman's debts long after he is gone.

Simple things like checking with the County Recorder for properties that the PBMI pays taxes on seems beyond the courage of PBMI members. No one has even tried to obtain any public information regarding federal funding provided to the PBMI to see if Smith is reporting it to the General Council.

That is the easy way to prove that the PBMI financial statement is phony. If the PBMI receives federal funding and it is not reported as income on the financial statement then the statement is fraudulent. If the tribe is paying taxes on properties and those properties are not shown as assets then the financial statement is fraudulent.

Members can complain all they want. If they aren't willing to do anything about it then their complaints as meaningless.

What a minute....the tribe does not need BIA approval for anything! The PBMI is a non Indian Reprginization Act (IRA) tribe, meaning they did not accept the federal governments conditions to create governing documents and organize under BIA guidelines in the 1930s. The PBMI resisted that until the 1960s when the Articles of Association were created. The BIA has no power over the tribe so long as the tribe does not designate or transfer that soverign right...wake up and do not give away what our ancestors fought against and basically had nothing to keep their soverign rights of self rule and governance.

The only way to control an out of control EC is to get them out of office asap.
That's why there is a word called impeachment make that motion and go through the proper channels so it is legal
and effective.
If you are considering this action be sure to follow your Tribes/Band constitution for this action.
It is an easy thing to do at a meeting where you have the backbone on your side just motion to impeach and take the vote according to your Tribal constitution.
That way no one can question if it was done properly.
According to Pala's constitution to vote should be either by a show of hands,and not by those voting machines because the machines were never approved to be used for voting at any meetings and they can be fixed by a push of a button by the person in charge of the computer that connected to the devises at the meetings.
So be sure to request that the vote be taken by a show of hands, you should have no problem getting this passed if this is the action you want.
It would be a great start for your Tribe to begin the healing of your tribe.
Just make sure that you have the votes behind you from family and friends that out number the other side, meaning Smith and Nieto followers. GOOD LUCK AND GOD BLESS YOU.

The BIA formed the PBMI out of two groups of allottees, Old Pala and the Warner's Ranch Evictees, because the two group rejected organization under the IRA, but couldn't do business without a governing document. The BIA drafted the Pala Articles of Association. The Articles required BIA approval of amendments, enrollment, and attorneys contracts.

The Pala Constitution removed BIA authority over amendments and gave the EC the authority to draft an Enrollment Ordinance. The Pala EC Enrollment Ordinance removed BIA authority over enrollment appeals. The BIA can now only make recommendations on enrollment appeals. The Pala Constitution still requires BIA approval of attorney contracts. The BIA politely ignores the requirement to approve attorney contracts and lets Smith hire any attorneys he wants and pay them with PBMI funds even when they harm the members.

Look it up. The information is all on the blog. People keep saying things that are wrong. They probably want to believe something that is not true. The Constitution and Articles of Association are posted here on this blog. Also the scheme to remove the requirements for BIA approval has been thoroughly discussed.

Maybe it is better to go through life with blinders on. Then you can't see how wrong you are.
