On February 24, 2012 the BIA recommended to Pala's Executive Committee that it reverse its disenrollment decision.

It’s all in black and white right here. The BIA states MB is 4/4 fullblood Cupeno so the disenrollments we’re wrong. You should also post the second letter for the 162 that were disenrolled which states we recommend to the Pala EC they remain on the rolls “as No Evidence was submitted by the EC to change MB blood degree” of course smith and nieto disenrolled anyway with no proof as stated by the BIA.

In my opinion these people that are siting in judgement
and disenrolling real Band members should be replaced and
never be able to sit on the EC board ever again and be banished from ever attending any and all Tribal meetings
and not be allowed to vote on any Tribal election or business dealings concerning the PBMI.
Also they should be made to pay a fine of $1000.00 for each disenrolled member.
This fine should be imposed on each EC member that voted to disenroll these members, meaning that each of the EC members would have to pay a fine of $162,000 dollars
each and it should be deducted from their per capita payout each and every month until the fine is paid in full by each corrupt EC members that fine total would be $648,000 dollars which is a very small price to pay for what they have done to real Band members. And if for some reason that any of these EC members should become ill or die then there surviving family members would be liable for the remaining balance of these fines until paid in full.
Also have an Audit of the Bands finances for the time that these corrupt EC members were in charge of the Bands finances and any findings of stealing or corruption by these EC members be given to the Department of justice for full prosecution permitted by law.

Why do people continue to vote for this man when he is so clearly mismanaging money? That is all that matters in pala, after all.

Anonymous said...

I have come to realize that he does vote himself in every election by stuffing the ballot boxes at the election site and at the postal annex.
After all one of his biggest supporters works at the annex, Kyle "ass kisser" Felt.
So it makes it easy as pie for Smith to do the stuffing
of the annex ballot box with the votes that keep him and others in their corrupt seats on the EC.
I hope that when smith dies and is no longer in charge that the new chairman takes action against the people that helped Smith steal from the people that he was supposed to protect.
Turn about is fair play to all involved starting with Kyle Felt and then Wells Fargo Bank.

Anonymous said...

Kyle Felt hasn't worked at the Post office for some time.

Anonymous said...

But5 he still caters to smith every wimp and call.
I believe that smith calls Kyle Felt before the meetings and lets him know in advance what needs to be motioned to pass and it seems that Felt is most always the one to make those motions when smith asked for a motion to approve.
Felt right arm needs to be cut off to stop the bullshit motions from being made before anyone can ask any questions about any details concerning the motion.
The same goes for Eric "pull my pants up" Garcia Ortega.
between those two and Jimbo Goodpasture no one has a chance to ask any thing about any thing.
That's just not right for these non blood of the band
Garcia and Goodpasture to even attend the meetings.
Just like Cindy Leal another non blood member that can motion to have someones blood degree investigated and
sit in judgement of true Cupeno Indians and no one is allowed to question her blood line, even after a DNA test shows that she is not a true Lavato.
But their time is coming soon when smith is dead and gone because there will be no one to protect them from the truth.

This coming meeting EVERYTHING has got to be addressed. The interactive, the jets, ALL the property (except Gregory canyon) was supposed to be sold, contracts bought out, but of course after the so called special meeting nothing has been said, instead the EC hides it under casino revenue. Rumor has it their going to lower the per capita again. Thank God I'm working and come from the generation of penny pinchers.

This statement made by the BIA's head of the department of the Interior proves that Robert Smith and Theresa Nieto have done this on their own and totally went against the governing documents of the Band.
They did this by using fake documents to disenroll these members, which in the words of the head man at the BIA
states that the BIA recommends that they reverse their
decision on the disenrollments.
Nieto and Smith should be made to reverse that decision
or be made to step down or impeached for the actions.
According to the BIA a Tribe/Band has the right to determine their own membership, however the Pala EC under the thumb of Robert Smith and Theresa Nieto acted
on this issue on their own and did not involve the Tribe/Band in this decision which is a requirement for
this action.
According to the way it is written it clearly states that A Band/Tribe has the right.
It does not state that the E/C has the right to do this type of action it the Tribe/Band as a whole not 6 people who has an agenda of greed and corruption and ill feelings toward certain members and their family.
This is an issue that the General Membership needs to address as soon as possible before the EC takes it upon themselves to hurt another family like they have the Britten family.
It needs to be brought up at a special meeting and have the leaders called out for their actions and if they refuse to reverse their actions then motion to impeach the Chairman and the head of PBMI, Theresa Nieto.
Their action are directly hurting all the businesses
that the Tribe/Band has here on the Reservation and on the outside where the Tribe/Band does business with other businesses.
It is time to take back you Tribe/Band and stop all the bullshit that these two corrupt people are causing.

Also people get ready for this, it is rumored that Robert and Nieto are going to try to take some kind of action on the Howrad Diaz home where Bonnie Diaz lives.
This cannot be put in the hands of the EC because we all know how Rob feels about that family.
Also if they try and make any kind of demands on Mrs.Diaz
then they better take the actions against Nieto's father
who still lives in the home on Owlinguish rd. next door to Pete Trujillo sr.
According to the original move agreements when the people moved in these homes through AMHIA it clearly states that a surviving spouse is not a member of the Band/Tribe that he/she can remain living in the home until he/she dies as long as he/she does not remarry or decides to move out on their own accord.
So please back up Bonnie Diaz if the EC tries to do ant thing about her home.
Her and Howie were together for almost 50 years even though there were only married for 2 days before he passed away.
This EC has no respect for anyone and it's time to take action against them before they end up being the only 6 people left in the Tribe, which is what the want.

Anonymous said...

All the AMIHA homes have been long paid off, like Howie's. HOWEVER whatever Tribal ordinance that was in place at the time the home was new still stands as LEGAL AND BINDING. It CANNOT be broken by ANYONE,
only the homeowner has the legal right. Most of the AMIHA homes came into play when the land ordinance allowed non-tribal spouses to remain in the home until their death, but cannot move in another person. THIS IS WHY ROBERT WAS TRYING TO GET PEOPLE TO RESIGN THEIR HOUSING CONTRACTS BECAUSE THIS ORDINANCE IS STILL IN PLACE! Not him, high paid lawyers , NO ONE except the homeowner can change this.

Reinstatement_Restitution said...

Oh yes, rush to protect non Indian, non members because they live in deceased spouses homes. But it's okay to disenroll the Britten descendants, demolish their homes, evict them from the reservation, threaten anyone who talks to them.

Sorry, but I am beginning to think think that Pala Members are more to blame than Chairman Porky. Please show me some common sense, and pin the tail on the donkey.

All of it is wrong. Act now to get rid of Chairman Porky and Treasurer Petunia. Put it in perspective. If you think Bonnie Diaz should keep her residence, why don't you think the disenrollees should also be supported?

Anonymous said...

It's easier to fight the EC concerning the housing authority because it is in black and white and it cannot be broken only by the homeowner.
Granted the disenrollments were done for hate and corruption against the Britten members.
However if they would have gotten the membership and demanded that this be brought to the attention of the general membership maybe things would have turned out different for them.
There is still time for the people to get behind the Britten family and support them and make things right.
However the membership is to afraid to act because of the way that Smith will punish them.
I don't like to wish bad or ill feelings against anyone but i hope and pray for Smith and Nieto to die soon for what they have caused in Pala.
I truly hope that the next time that the death bell rings in the village that it is for Robert Smith or Theresa Nieto.

Anonymous said...

You know RR, I always read your posts, and respect your opinion. I was only pointing out that some things are out of Robert's hands, and his high paid lawyers. Not once in my post did I say anything about the disenrolled.

Anonymous said...

Pay attention to the dates on these documents. Robert and the EC already had planned to disenroll the whole Brittain family before the BIA ever responded to them, the rest were disenrolled Feb 01, 2012. Plus we all received our letters in October of 2011. That whole time between, Robert kept reassuring the family not to worry, it would never happen. No need to raise up against the EC, because he is not going to go against the family. Then they wanted the paperwork sent in within 30 days. He said it was just a formality. But when the paperwork was gathered together and sent to them via registered mail, somehow they never received any ot the packages, but none of them were ever returned. We still managed to get them there, by re-sending them without using Pala's annex. Obviously that was part of the whole plan to get rid of the family ASAP. The Pala EC has been so destructive to so many people, they clearly lack any inkling of goodness, they cannot be anything but evil, the devil wears the EC's clothing.

Reinstatement_Restitution said...

There EC is responible for many evil deeds. It is difficult to single one out without others rearing their ugly heads. This particular thread begins with the BIA recommendation that the Britten descendants remain enrolled. Discussion of other evil actions may be perceived as a diversionary tactic even if sincere and there is no other thread on the subject. Apologies for my desire to stay on topic.

To the PALA EC,
Don't worry Robert Smith, Theresa Nieto and Dion Perez
you time is very near when you will suffer for your actions.
Did you all think that this was over, guess again you BASTARDS, its just the start for you and that onion breath lady at the Regional office of the BIA.
How could you even think that she would cover your asses if this ever came out and she was investigated by the DOJ
for her actions.
She is singing like a bird and soon all of you will see what it feels like to have every thing taken away from you and your families like you caused to happen to the Britten family.
Sure you think that its all under the rug by now but it isn't.
Soon you beloved Amy Douchbag will be made to show all the documents that she approved for you and the shit will hit you all directly in the face.
Then you all will be taken off the EC and then kicked off the Pala Reservation with disenrollment papers in you back pockets.
I can not wait for this day to get here, and also before i forget this will also apply to your kids and your Grand kids alike.
You have all earned it now you can live with it.
P/S good luck on finding work because these days no will hire a person with a felony record but there are welfare programs that you and you kids can apply for.

But is this true or just another smokescreen?

Witness the "honorable" Robert Smith in action. He purposely manipulates the disenrollment situation at the tribal level and LIES in the local news, then acts like a baby when he gets called out. He LIES when he states that the original 8 were expelled for failing to file their appeal in a timely manner, but the truth is made public in a letter from Amy Dutchske that "the eight (8) appeals were received at the Pacific Regional Office on June 29, 2011 and were timely filed." So, if anyone wants to know the character of this man, you need to look no further than this. He straight out lies to anyone and everyone. THEN, WHEN CALLED OUT ON HIS LIES, HE VISITS THE PALA STORE TO RIP OFF THE PUBLICIZED LETTER TO CONCEAL HIS LIES. What a sad, pathetic man. I wonder what lies he is telling you today.

I have an real good source that tells me that the D.O.J.
is in fact investigating 3 of the employees at the Regional Office of the BIA concerning FOIA , and other complaints concerning known false information concerning official documents that have been discovered concerning land that was into trust for 3 different tribes that did not go through the proper procedures.
One of the properties in question is for the Pala Band of
Missions.
And another was for a tribe in San Bernadino county.
As i find out more i will post here.

If they are investigating the land into trust issue i hope they investigate the Chairman of the land into trust California which is none other than Robert Smith.
I think its called Calif. Land into trust consortium of
California.

Just received an Amended Agenda today for the May 8, 2019
meeting.
#8 Request approval for a leasing ordinance, which will apply to all business site leases approved to the Hearth act of 2012, for governing leases on Tribal Trust Land, and to all actions and decisions taken in connection with such leases, and includes the environmental reviews.
Maybe the EC is trying to control the lease of the Pala Store and the Lavato trailer park.
The EC wants full control of every aspect of the people in Pala and wants to have full control of the entire Reservation.
Vote it down and leave these issues concerning leases to the BIA and do not give the EC anymore power to use against the members that they want gone.
And #10 concerning Howard Diaz's home, don't let the EC bullshit you.
Bonnie Diaz has the legal right to live in that home that her and Howard Diaz have lived in since it was built and is under the original contract which states that surviving spouse can live in the home even if they are non tribal members in the event that head of the house hold dies as long as the surviving spouse does not remarry and move a new spouse into the home.
So everyone please go to this meeting and support Bonnie Diaz and her family to remain in this home until she either dies or gives it up on her own accord.

Also if the EC is so concerned about property on the Reservation then have them come clean on the property that Jimbo Goodpasture says is his property on Pala Temecula road.
And the other property in Rainbow and all the other properties that the Band supposedly owns.
Including the warehouse property in Temecula and the office buildings in Orange County.
And oh yes the house in Fallbrook on green canyon by the Fallbrook High School that is listed under the Pala band of Mission Indians.

Anonymous said...

I am sorry to hear about them trying to take Bonny's house. Someone said they would and Pete Trujillo chimed in saying he did not think they would do this. I am so sorry Pete, I know you want to only see the good in people. Unfortunately any good that the members of the EC had at one time has been gone for years now. They have succumbed to evil and they are bringing Pala down. As long as the members keep hoping things will change, they won't change unless you do something, or unless GOd intervenes and rids the world of them. Since you won't do anything like complaining at the meetings or getting a petition going, why don't you all get together and pray really hard. Maybe God will bless the people with the ending of the whole situation.

Anonymous said...

As for the so called business leases, Pala store and Lavato trailer park are on ALLOTMENTS. The Tribe CANNOT force a lease on someone's personal property...how dumb do they think the Tribal members are. As for not just Howie's home, but ALL the old AMIHA homes (as long as they didn't sign Andrew Moro/Robert Smith's ILLEGAL new housing contract), you are absolutely right. No one, not Robert, the Council, the Tribe or high paid lawyers can break those contracts.

Anonymous said...

Also, will this so called business lease cover Robert's tub? Again people, these are allotments, unless it's an illegal business not approved by the BIA, there is nothing the Tribe can say or do, this also pertains to any ingress/egress. Everything is set in stone.

Anonymous said...

Also i remember years ago when the Band was in talks with
the Pala Mission concerning property swaps for the expansion of the Cemetery Robert some how got the extra piece of property where he now lives.
That piece used to belong to the mission and somehow Robert Smith ended up with it so he could put his prefab home on it.
How did that happen if it was the PBMI that was making the deal with the Mission.
And also the fact that Robert Smith states that he was the only surviving heir to the property where the Pala Tub was built was also a lie.
His aunt Kathrine Moro Trujillo had a son before she married Alvino Trujillo and she gave her son to a relative to raise.
So if that son could be found and proven that he is the son of Kathrine Moro then he would have interest in all of the said property that belonged to his birth mother.

2 items on the agenda has literally NOTHING to do with the Tribe unless it's considered a detriment to the Tribe. 1. Business leases-If the business is on Tribal land, then yes leases are needed. If it's on ALLOTTED land, NO the Tribe has NO say. 2. Old AMIHA homes. All of the old AMIHA homes were paid off, however the land ordinance at that time were as described in the above posts. Unless the homeowner signed another contract with the Tribe, the original ordinances stand. That contract or ordinance can ONLY be broken by the homeowner, NOT the Tribe, Robert, high paid lawyers can break them. The only way the 2 items can be voted on by the Tribe is if the business or surviving spouse is considered a threat to the community. It's Robert's vendetta again, are we willing and stupid enough to let him cost us more money and hurt more families because of his grudges?

Anonymous said...

What needs to be addressed is the casino having a jet(s) on standby. Wasn't Robert told to get rid of them? Judging by the small amount of people gambling, I sincerely doubt there are enough high rollers to justify this. Also the grape orchard and all the trash around it needs to be eliminated.

Anonymous said...

How about all the Limo's that we have also.
You know the ones that take Robs fat ass daughters to events all over hell.
We don't need 4 of them.
And that big lifted Ford truck that was more than likely
purchased with the Tribes American Express car,
Sell that piece of shit

And that tow truck that only Goodpasture drives and uses it for his own personal use and Tribal members have to pay them to get towed when needed.
Also we have to many tractors that we bought or leased
so certain people can clean their yards, and Tribal Members have to pay a fee when they need any tractor work done.
Make the workers buy and wash their own uniforms or buy a couple of washing machines and put them in the maint. yard or better yet let smith wash them at his launder
mat at no charge ,
These petty things seem like nothing but when they are all added up it saves thousands of dollars for the Tribe
and that's our money not theirs.
Just like all the vinyl fencing that was put up that no one seems to know about that cost hundreds upon hundreds of the Memberships money.

Anonymous said...

There has got to be a way to stop the EC from spending the Bands money like it belongs to them and them only.
They buy whatever they want and justify it by lying about
it was needed to the members.
Then they sit up there at the meeting like sad little puppies looking for someone to pet their ugly asses.
They are a bunch of mean pit bulls looking for that next chance to attack the members and take another bite out of your per capita.
They are all corrupt and need to be taken off the governing body of the PBMI before they destroy the entire Reservation which they are close to doing right now.
If you don't believe me just look into their finances and explain how they could have so many investments in their name and still pay for all the shit that they supposedly own,
It almost impossible when you add it all up with their financial statements which are very easy to obtain through running a credit report on them.
They way over spend and according to Perez's credit he and his wife had to file Bankrupt papers a few years ago
and this filing was just a smoke screen by Dion Perez according to Bank of America who lost a bit of money on this issue.
The IRS should do something about these people in stead of just sitting on their big government asses collecting that pay check.
It doesn't take much to find out who is doing what and what level they are doing it at.
Sometimes just running a simple credit report will tell you a lot about where they bank and how many bank accounts they have and where they invest some of their money.

Good old Cupa Days another big joke in history.
The Native American singers and dancers seemed a little out of place with all the Mexican vendors at the event.
It should have been called Cinco DE Mayo Days with Native American singers and dancers as honored guest.
As i walked through the flow of people i noticed that most of them were speaking Spanish to each other.
Hardly no one was speaking English and for sure no Cupeno
was being spoken.
Good old Customs and Traditions are long gone.

MAY THE CREATER BLESS THE LOST CUPENO PEOPLE AND RESTORE THEIR FAITH IN YOU.

Anonymous said...

I hear what you are saying.
When i was in line for some food all i heard was 2 tacos
con 2 coca's
And the dancers were all dancing to the Mexican hat dance. OLE

Anonymous said...

There were Native American vendors there. With the way things are going, the Tribe was probably charging an arm and leg for them to sell their goods. No one wants to cook anymore, it's a lot of hard work. Be happy someone was selling food.

REMEMBER PEOPLE, PALA TRIBE HAS NOTHING TO VOTE ON FOR EITHER HOWIE'S HOME OR BUSINESS LEASES ON ALLOTMENTS. Why Robert is bringing it to the tribe is not right. The Tribal/BIA leases on the old AMIHA homes are legal and binding where the non Pala spouse can remain in the home, also business leases would only apply to Tribal land, NOT allotments unless the business is proven to be dangerous to the Tribe.

Anonymous said...

Robert said that it is on a bases to bases about who stays in the homes after an enrolled member of house hold passes away he wouldn't really call the people that had their hands raised for questions or to talk about anything concerning the AMIHA homes.
But the people voted to let her stay in the home at the rate of $200.00 per month as a land lease as sort and she will have to pay non member rates for water and trash.
By doing this it seems that it still give the EC control of the home because if they find any little fault they will kick them out which is wrong.
And Andrew Smith was able to say a few negative words.
He said that before you people vote on this think about these non members living in these homes they are taking these homes from our kids and our grand kids that might need this land for their own homes.
With any kind of luck he and his kids will be looking for a place to live before to long which would serve him right.
Nothing was even brought up about George Eagleton being able to stay in his home after his wife passed away.
Sorry he is probably an enrolled member of the Band by now.
I hope someone beats the shit out of Andrew Smith real soon he is as evil as his brother and niether on of them belong on the Roles of PBMI but he always gets to talk at the meetings without any problem.

Anonymous said...

Shouldn’t the son get a job and pay rent to the tribe

Anonymous said...

Why? It is the responsibility of the wife to come up with the $200. She can have whoever's she wants living there as long as the rent is paid and the health and welfare of the community is not threatened.

Thankful said...

I really think that Nona Nejo is doing a great job by questioning the EC about certain issues that the EC is trying to get passed.
She is finally putting things in prospective on issues.
She has some good points and is not afraid to bring them out for the people to see.
I don't blame her after the way that Smith and Nieto have bad mouthed her lately. Rob is always saying that Nona is a trouble maker and people shouldn't listen to her BS,but i have to disagree with with him because i think that she is trying to do the best for the people of Pala and for her daughters.
Great job Nona, keep it up you are earning a lot of respect from the people. Thank you.

Anonymous said...

Did anyone notice how Nieto and Smith kept side stepping
the motions about having a rep. from the financial
institutions come to a meeting and explain issues concerning the Trust accounts for the minors made by Nona.
They kept saying that they didn't know if they could arrange it or not.
But it is our money that the EC is supposedly invested
so why would the financial company's not be able to come and answer questions of the people.
If they can't do it for some reason or another then pull the investments and find someone else who will be honest
and will not be bought off by the EC.
The EC is hiding something from the people again and will say that the financial people were not able to come to a meeting with such short notice.
Even if they show up who's to say that the EC didn't tell them what to say to the people.
Another motion should have been made to have the FBI investigator to come to the meeting and answer questions concerning the EC issues then watch smiths and nieto's hair turn completely white.

Anonymous said...

Nieto will come up with some kind of an excuse as to why
the Reps from the financial institution could not make the meeting with a 30 day notice and Smith will confirm
what she says.
That's the way that they operate when they get caught up
with their lies and no one will question them except Nona
and Smith will shut her down unless the people at the meeting take her side and motion to let her have her say.
So it's very important that the people go to that meeting and back up Nona Scott because she is only trying to do the right thing by requesting answers that the EC won't give an honest effort to make.

Anonymous said...

OH, you mean like King tried to question?

Anonymous said...

That is all small potatoes compared to the scam Smith and Nieto are carrying out under the Indian Buy Back Program. Show me one piece of allotted land that was bought back for the tribe. There isn't any. Smith and Nieto have been purchasing the land for themselves. They are using the information provided by the BIA for the Buy Back Program to contact individual owners to see if they will sell their property interests. Smith has been sending out letters and making personal phone calls to owners and telling them that the tribe wants to buy your land. Under the Buy Back Program you should have received a formal appraisal and an offer based on the appraisal to buy the land. That is how it was done through the Buy Back Program. The program is now over so if you are still receiving letters and phone calls urging you to sell your property it is a scam. If you need to sell your land then sell it to family not smith and nieto. If you continue to receive these bogus offers you should report it to the BIA or the FBI because smith and nieto are using information that was intended for tribal use and not personal use.

Anonymous said...

It is good questioning the EC, BUT! lets not forget Nona was right there with the EC when they wrongfully dis enrolled, she would still be there if they had not wronged her, something with the land or their old house. Now she is getting a small taste of what its like to be on the other side. She has a long way to go to prove herself, Its ok to forgive but never forget!

Anonymous said...

So Smith and Nieto are using the Buy Back program to purchase allotted land. Are they using tribal funds for the purchases and then putting the land in their name? That is misappropriation of funds and conversion of assets. All land under the Buy Back program is supposed to be put into trust and returned to the reservation for tribal use. If not then it is fraud to claim that the Buy Back program is being used.

The GC should request a report on Buy Back program, with details about what land was acquired, the purchase price, and when it was returned to trust.

Hahaha. Bet the treasurer doesn't know any of the details. That's okay. Land into trust is public record. Submit a FOIA request for all lands returned to trust on the Pala Reservation. Anyone want to guess on how much land the BIA approved to return to the reservation.

My guess is none.

Anonymous said...

I heard from someone that Rob was trying to get a Pala Member to sell him his interest in a piece of land in Pechanga that the member got through a will from a relative.
It is supposed to be next to the highway before the entrance to the Reservation.
But the Pala member turned it down even though he needed the money.
The member said that it was part of the Buy Back program
that Rob learned of the piece of land.

Anonymous said...

I wonder if the land that Nieto bought at the old Cuca Ranch in La Jolla where the road splits and goes up to Palomar is in trust.
The rumor was that the Tribe arranged the financing on this property.
Also the home that she owns in Temecula/Red Hawk area.
She has so many investments according to her credit report.
More than likely the investments were done through Tribe.
If they cash out the investments in her name i will bet that the proceeds will be split between her and Robert
Nieto/ Smith.

Anonymous said...

Any land that a tribal member buys that is located within the reservation boundaries is in trust and will remain in trust.

Anonymous said...

Not really. Allotted land can be purchased, title cleared, and become fee simple land. That is how you get fee simple land within the reservation boundaries. Pretty basic stuff.

Anonymous said...

Fee simple land is land held by a nonindian. If a tribal member or a federally recognized Indian purchases land, then the land is held in trust, if within the reservation boundaries. This is a federal law, and is not controlled by the tribe. Fee simple land within reservation boundaries fall out of trust because they are owned, or purchased by nonIndians. In California, the BIA recognizes an Indian owner as anyone who owns an allotment and can traces ancestory prior to statehood, but for purposes of trust, 2nd generation descendancy is recognized, after that the land is no longer held in trust and the land be omes fee simple, u less another federally recognized Indian or tribal member buys or inherits the land, then it is converted back into trust.

Anonymous said...

Haha the joke is on the EC now regarding Bonnie Diaz now that the Tribe has become landlords. Because of their actions, now the TRIBE is responsible for the insurance, maintenance of the property, and repairs to the property not caused by the renter. So for example, the TRIBE must paint the outside and inside of the home every 5 years, maintain the roof, ensure that all the electrical, plumbing, gas is working properly, also all household appliances are the responsibility of the TRIBE. Legally all Bonnie is responsible for is to report any problems before any damage is done, and repairs caused by anyone in the home.

Anonymous said...

Also if they're allowing George to stay using the original land agreement on the basis that he is an essential part of the community, then the same land lease applies to all of the other AMIHA homes (which it should anyway because it is legally unbreakable). Something to think on people.

@ 3:39 pm
Also who's to say that Robert Smith won't hire some of his buddies to come to the meeting and pose as the guy;s from the financial institutions and be briefed by Nieto and Smith what to say to the people.
The members should request some form of solid ID's from the guy's of lady's before they are asked any questions about the trust accounts.
Ask them for their business cards and compare that to their California ID,or and identifying letter from the institution identify their Reps. on behalf of the financial offices that are controlling the Band's minor trust accounts.

Anonymous said...

Everyone knows damn well that the EC will have excuses as to why there are no reps. from the financial institutions on hand to answer questions from the people that want and deserve real answers, not a bunch of cover ups from Smith and Nieto. We need real proof in black and white for us to look at and study for ourselves.
Not a bunch talk and lies.
Request that all of your concerns be written out and answered on paper because remember talk is cheap especially at the Tribal meetings.
Because by the end of the meetings people are asking others at the meetings, what did they say and what did they mean.
But if you have it written out in plain lingo then everyone will be able to understand whats really going on with the trust funds of the minors.
You have that right and don't let the EC bullshit you with all of their excuses.

Anonymous said...

Also these financial investment firms should produce a statement every 60 to 90 days to all the parents of the minors that have trust accounts with them.
It should show an itemized account of the invested money
and the interest that it has earned and where the interest was placed or added to the said account.
By doing this it should stop all the lies from the EC concerning the minors trust accounts.
I am willing to bet that the interest earned on these accounts is split between the accounts and the EC general fund accounts, or paid directly to the EC.

Another thing that i think should change is having the Wells Fargo Bank in the Admin building.
It is to easy for the Chairman and the Treasurer to steal money from the accounts.
If someone or another business sends a check to the PBMI all Theresa or Smith has to do is deposit the check into the account and turn around a make a withdrawal for the same amount of the deposited check.
That would show that they in fact deposited the check in the bank and the canceled check would show that it was put through the proper channels and no one would question it because the members never get to see any of the Bands bank statements.
Thats just one easy way for them to steal from you.

You are right about the Wells Fargo being in the Admin building.
Why doesn't the Band lease the lot next to the security office to Wells Fargo and have them or the Band put up a building there.
It is right in the heart of the Reservation and there is plenty of space for a small bank location and would be more convenient for all the Tribal members and also outside Wells Fargo customers.
It would also ease the parking at the Admin building.
Someone should bring it up at a meeting and see if the members would agree to at least sit down and talk with Wells Fargo and see what they think of the idea.
It would help the image of the Reservation as far a scenery, instead of those security vehicles being parked there with there head lights all night long.

We don’t need a bank in the center of Pala. We need to focus on getting traffic under control. We need stop lights on every street from Trujillo to sycamore, The “Y” east on Pala mission, by the Pala Race Way and other streets . These lights can be turned off and on and should be utilized during heavy traffic hours. Or just keep them on to prevent people from speeding through Pala. Pala should not be a short cut for people, it’s a growing town, there are a lot of young families who feel that Pala is becoming an unsafe environment for their kids.

If all the fat asses that work for Security would get off their lazy asses and help with the traffic control at least for the Pala residents that are trying to get out of their driveways to get their kids from school or the bus stop would help a little bit.
Why do we pay over $86,000.00 a year for the CHP to come only once a week for traffic control. that seems to be a lot of money for nothing.
Tim Ravago said something a one meeting about not being able to control traffic on state highways.
So how do they get away with it on the Temecula grade when there is an accident or a bus breaks down.
They are always there directing traffic but they can't do on the Reservation, that's bullshit and we all know it.
If that is the case then Pala Security should be made to only patrol and assist on the Reservation and quit patrolling areas off the Reservation where they have no authority to enforce anything.
Also how about the contract that Pala has with the San Diego County Sheriff's Department why can't they help with the traffic control at least 2 time a week like maybe once one Monday and again on Wednesday and the CHP on Friday.
Then the Pala Security can remain sleeping until a bus breaks down on the grade.

Anonymous said...

And who dispatches Pala Security to those calls when there is a brake down on the grades or an accident.
They need to stop wasting our money paying the security
personal to cover any kind of traffic control other than what is needed for the Band.
I have always thought that the EC had the power to oversee what goes on on the Reservation, or does it only apply to people that they want gone.
Unless the CHP wants to have a contract with the Band that states that Pala Security can enforce traffic control for these accidents or brake downs Pala EC should tell Tim Ravago that they can not respond.
They made the Band have a contract for almost 100 thousand dollars so it is only fair to reverse the tables.

I have even seen Pala Security stop vehicles on Pala Mission rd. and on Pala Temecula rd. where they have no authority to do so.
But they can't help with traffic control on the Reservation.
I think it's a matter of lazy asses not wanting to do it.
If the CHP or the Sheriffs department won't do a better job to enforce the traffic conditions then the Band should look into a traffic control company and get prices from them.
There is a company in Escondido that does this and they should be contacted for there view as to what could be done to help ease the traffic problem.
They are located on Crest st. in Escondido.

Pala Security has jurisdiction over all County roads within the boundaries of the reservation i.e. Pala Temecula and Pala Mission. The grey area comes into play, legally, when dealing with State property and jurisdiction. Since California is a PL 280 State, meaning the State controls how criminal and civil jurisdictions are provided, the state would control the state highway 76. But, on the reservation, since 76 goes through the reservation, the tribe may gain access to some jurisdictional violations if the State allows, but it seems like they dont.

Anonymous said...

I meant to say all roads within the boundaries of the reservation, which includes county and public access private. The State highway is where the area in the law gets foggy.

Then that would seem that Pala Security would be able to do some traffic controll at Pala Mission rd.and Pala Temecula rd.

Seems that Pala has lost another good man.
Dennis (COPY) Magee has passed away sometime yesterday evening.
Copy was a good man and played baseball and softball for many years for Pala.
He will be missed by all that new him.
He was very well respected both on and off the Reservation and in the Fallbrook area where he worked for many years with Fallbrook utilities Dist.
Rest in peace Copy.

Also today Stan McGars wife Norma passed away at her home in Pala.

Anonymous said...

I hope that Copy left a will for his son Dennis to have Copy's house.
The home is off of Pala Temecula rd which makes it private property and also gives Dennis jr. a right of way
to the home because it was build on private property owned by Copy Magee. It is not built on Tribal Land.
It is the same as Delores Calac's home and her mothers place it is all on private property.

Copy Magee was a great man who believed that there is good in everyone.
He so loved his only son Dennis JR.
He used to brag about his son all of the time.Copy was a man that many of today's youth looked up to when playing either baseball or soft ball.
They knew that Copy was very good at both sports.
Even when Copy got older he still would talk to the young ones when they had questions concerning ball playing.
That's what made Copy special to a lot of of the ball players today.
I remember as a youth looking up to Copy and hoped that someday i would grow up to be just like him.
After years of trying to do so i came to realize that it was not an easy task and i couldn't figure out how Copy made it look so easy.
A few years ago Copy and i used to go to the Valley Fort in Fallbrook and eat and have a few beers and listen to the music, those were some of the good times that i will never forget.
Copy would always look out for me at the Valley Fort to make sure that i didn't drink to much because i had to drive back home to Pala and i would do the same for him even though he only lived about 2 miles from the Fort.
I for one will miss Copy very much and hope that Dennis jr. will recover from this great lose of a great Father,
Friend and mentor.
Rest in Copy.
Your cousin, Pete Trujillo Sr.

I can't wait when the comes for when Nieto and Smith
"WILL BE ASKED TO SHOW PROOF THAT THEY BELONG ON THE ROLES OF PBMI".
It will happen sooner or later and the sooner the better.
This is the open door that the current EC has opened for the future use by a new EC that wants someone gone and off the Tribal Roles.
It will be so satisfying to sit and watch as they are striped of everything that they thought was secure.
Including their right to belong, their income, their
healthcare, their homes.
I forgot, this will also affect their kids and their enrolled grand kids as well.
Wow there will be plenty of vacant homes on the Reservation once a new EC takes over and the corruption is stopped.
A plan is already being made to correct the Tribal Roles of PBMI and the name mentioned above are not on the list
of those that will remain og the roles.
Along with the likes of Goodpasture = (gone), Cindy Leal and daughters(gone), Dion Perez and daughters (gone)and the list is bigger than anyone can phantom.
Wow per capita will will finally increase to where it should be plus all the bonuses will be brought back into play and all it takes is standing up to the current EC and not be bullied anymore.
They made their beds with dirty sheets and now they will have to sleep in them.
Impeach them and replace them now.
Why wait for the riches that you all deserve.
All it would take is a motion to be made at a meeting to impeach smith and nieto and perez and seconded and if passed it is a done deal.

Anonymous said...

I can't phantom it. Maybe I can fathom it. It depends on if this is real news or fake news.

But hey, I heard the FBI was moving in to make arrests. The DOJ is ready to prosecute. The BIA wants to conduct an independent audit. The NIGC is prepared to investigate the Pala Gaming Authority.

The federal government really cares!, The Pala General Council will stand up to the EC! Pigs fly, and their wings taste better than chicken wings!

It's all true!

Anonymous said...

Part of the biggest problem in Pala is no one has the balls/guts to make this motion at a meeting so all of this talk is just that, talk.
Action speak louder than words.
Just get your family members and friends behind you and have them all go to a meeting and back you up.make sure that they all come and vote for your motion in favor of impeachment and an Audit.
Or just sit there with your thumbs up your asses and continue to support the EC that is raping you big time.

The only way that things will change in Pala is if the General Membership grows some brass balls and takes control of the EC members that are destroying the Reservation.
Other than that nothing will change for the good.
Things will only get worse before they get better if the General Membership doesn't do something soon.

Anonymous said...

That's a very true statement 2:06 AM.
I have seen a few people that were willing to take the risk of running against some of the current EC members in that last couple of elections but no one backed them up or were brain washed by smith and nieto.
You Band members should have taken the bull by the horns and made the change while you had the chance to do so.
Or maybe you just like the lies and the excuses that the EC dishes out to you.
If you ever want the true answers to your questions you can't be afraid to vote for change no matter who it is that running against any of the current EC.
It would be better than what we have now.

That letter from the BIA recommending that Pala reverse
the disenrollments should prove to you that the disenrollments were done illegally.
It proves the the records at the BIA offices prove that MB was 4/4 cupeno.

Anonymous said...

And the disenrolled have pledged to not let it go and that they are ready and willing to fight Smith and Nieto
with tooth and nail until they are back on the Tribes roles as they should be.
They are risking every thing to bring out the truth about the corruption that is spreading through the Pala Reservation like a wild fire.
There is so much evidence compiled here that it is likely to put Smith and Nieto in Federal Prison if they are every arrested, which is the goal for them.
All they want is justice for the treatment that they have endured under the powers of Robert Smith and Theresa Nieto all because of the hate for two of the members of their family, willy Pink and King Freeman
before they inflict this rage on another family of the PBMI.
So they are not only fighting for their family but also for the entire membership of the Pala Band of Mission Indians because they firmly believe in the Customs and Traditions of the Tribe.

I can not believe all the direct evidence on this blog and on the Pechanga blog that proves the corruption and misdeeds of the Pala EC members.
I have printed out all the facts and evidence that show intentional wrong doings and direct harm to family members of the Britten family that was disenrolled and the reasons why the wrong Roles were used by Smith and Nieto to do so.
I have 923 page of facts and evidence that prove that the disenrollments were done illegally by the current EC leaders and i am giving a copy to the Department of Justice and my Attorney to go over the evidence and see what can be done to bring justice to the people that have been wronged by the Leaders of the PBMI.
If nothing else i will find a media outlet that is willing to publicize the evidence and expose Robert Smith and Theaesa Nieto for what kind of people that they really are.
I am just fed up and tired of nothing being done about anything concerning the way the people are being mistreated by the EC.

Anonymous said...

P/S to above post.
Why am i doing this?, because the EC has made no effort
to make things right.
And the General Membership is also doing nothing to make things right either, they just go to the meetings and believe everything that they are told by the EC and that is wrong and they know it but are to chickenshit to do anything.

Anonymous said...

Someday someone else is going to need help keeping their family on the roles at PBMI, and at that time they will understand all the hurt that comes with being disenrolled
from your tribe because the corrupt leaders needed more money to do illegal things and to hurt more families that have been on the Tribal roles for many years.
The EC will use fake documents to justify their actions against you as they have done in the Britten case and there will be nothing that you can do once the action starts.
The BIA won't help, the Courts won't help, the U.S.Government won't help and the sadist part is you Tribal Members won't help either. they will turn their backs on you even though you were once a very close friend who would have done any thing to help a friend in need.
So prepare yourselves for future disenrollment's because they are going to happen even if you think that they won't.
As long as ROBERT "ElPigo" Smith and Theresa "EL OWL FACE" Nieto are in charge no one is safe.

Anonymous said...

Nieto should have never moved to Pala and the EC should have never enrolled her in Pala in the first place. She does not have the true blood line to be enrolled in PBMI.
Send her back to Escondido where she was raised in the white mans world.
She never even visited Pala when she lived in Escondido
not until the Casino was being talked about did she even show any interest in the Tribe and now she runs it like it belongs to her.
I can hardly for the day when a real rez woman gets in Nieto's face and make her back down or gets her ass kicked real good and then see how fast she gets out of town and doesn't look back.
She is nothing but a lying bitch who doesn't care who she hurts as long as she gets her way.
nothing but a scumbag liar.

Anonymous said...

And don't forget to take her long legged husband with you.
The man that has to walk on stilts to be 5 feet tall.

OLE OLE OLE OLE OLE.

Anonymous said...

I wonder how she would react to having a real man at least 5'10" tall and at least a six and a half inch penis
to enjoy.
Instead of a little mexican jumping bean with no more that three and a half inches of manhood.

Maybe he will get deported by ICE one of these days.
I think Theresa just feels sorry for him because he had such a hard time catching up to the other students in school because of the short legs.
Or she just has a thing for men half the size of a real man, like she does for Rob.

Anonymous said...

Ok people, you can't blame one person for another's actions. I fully understand where you're coming from but to talk smack about one of the nicest people I've ever known makes you just as vile as Robert and Theresa.

Anonymous said...

You must be retarded or you don't know to many people if you think that this is the nicest person you ever known.
If you are talking about to Theresa Nieto's husband you don't really know him very well.
He thinks he can walk on water as does his wife.
They are 2 of the most two faced people that ever lived in our "once happy Reservation".
She made so many promises to the people when she first ran for the seat on the EC.
After she won she became one of the rudest bitches that there ever was and continues to do so as time lingers on.
She tries to buy her way into heaven by fooling the Priest at the old Indian Church where no many attend services anymore because of her.
She is so evil and corrupt that the devil himself doesn't like her because he is afraid that when dies and goes to hell she will try to take over.
I bet when her family and ex friends look at her they wish her mother would have aborted her.

Anonymous said...

You know whats funny?
The current EC thinks that as long as they get what they want from the general membership, either by hook or by crook that everything is all good.
But what they don't realize is that the more that they use the people for their own corrupt agenda the more power they are giving the future EC members power to use against the current EC family members as a way to get even for their treatment of people that they have intentionally hurt.
