In 1903 the Agua Caleinte Cupeno were removed from their ancestral tribal home, the Village of Kupa also known as Warner's Hot Springs. The Cupeno were forced onto the Pala Indian Reservation. This is known as the Cupeno Trail of Tears.
On June 1st, 2011 and February 1st, 2012 162 Warner Ranch Evictee Agua Caliente Cupeno were removed from the PBMI Association by the Pala Enrollment Committee. This is our Second Trail of Tears.

Does anyone know why for the election results announcement Robert stated Pala had 900 members and for the Pharma lawsuits and during the mews interview for the Pharma lawsuit Robert said both times Pala had around 1300 members?? Is this because he is paying out that many percap checks since his supporters get 2 percap checks that’s why they support someone who is powering percap because it doesn’t effect them. We had 700 adults and around 200 minors so around 900 members when the disenrolled 264 members in 2012 so that leaves 636 members. So Robert has enrolled either another 264 or over 500 members since 2012? What is the truth?? If we have almost 1300 members like he states then about 1,000 adults so the drop in percap saves the tribe $2 million a month?? Is this how bad off we are that they need to save another $2 million a month. Where is that savings going ?? We need to know how many members our tribe has and how many Robert supporters he has enrolled of their kids and grandkids to keep them on his side. That’s why our percap is going down because he has enrolled so many more supporters to get the votes that he has to cut the rest of us true members to pay for his supporters!!! We need answers!!
I totally agree with you it seems kind of fishy that when he needs more members to serve his agenda the number of Tribal members seems to always change. I have an appointment with the Riverside office after the Holidays and i will see what they say about how many adult members are enrolled and how many children/minors there are are on the Pala Roles. We will see how many names don't belong on the Tribes Roles if they let me have a copy then we can post it here for everyone to see.
So you have to go to BIA So-Cal Agency to find out how many PBMI members there are? Don't just ask them. File a complaint with Superintendent saying that the PBMI won't verify equitable distribution of revenue and conceal dollar amounts and number of members from the General Council. The allocation plan is approved by the BIA and all details should be made.available to members on request. See if the BIA tries to hide the details too. If they do there is evidence of conspiracy to commit fraud. You can also submit a FOIA request for the federal roll of the PBMI and any financial statement that proves the PBMI is in compliance with the revenue allocation plan.
When the judges asked if there would be turmoil, what? There is already turmoil, this might cause a little more, but that would be on Robert and the EC's part and they are the ones causing it now, so once they are out, the tribe can try to heal from the horrendous damage that Robert, Teresa, The BIA and Howard Dickstein have caused.

THINK ABOUT IT: why would people that know the incumbent EC spent all the tribes money is not giving them a Christmas bonus and is lowering percap vote them back into office? The only reasons I can think of are: 1) Those members are getting something the rest of us are not like a second check. 2) Those members and some of their family are only enrolled because of Robert and their support of him so they will vote to keep him in power because any percap is better than none. Which they should have NoNe! 3) Elections are fake and they didn’t really win they swapped the mail in ballots to show they won. 4) Those members gets perks like running a certain department for Pala and collecting an easy paycheck and perks as long as the current EC is in power so they will always vote for them. The way the incumbents have run the tribe and especially what has happened over the past few years for any logical person would not get them the majority of the votes. They announce they spent all the tribes money and have to lower our income and then 2 months later they are voted back into office?? How does this make senator anyone??
Change in person capita requires a change in the Revenue Allocation Plan. This must be approved by a majority vote at a GC meeting. Then a resolution must be submitted to the BIA showing that there was vote to revise TRAP.
If it isn't voted on at a meeting and a Resolution is submitted it is fraud. If it is not presented as a revision to TRAP then it is fraud. If the EC reduces per capita without BIA and NIGC approval it is an IGRA violation.
Make sure it is done in compliance with the law. If it isn't then file a complaint with the BIA. The more people that complain the better. Amy Dutschke will not act on complaints against Smith. Send those certified mail and keep a copy. If there is no response after 30 days file an appeal with IBIA for inaction of a BIA official.
Now I know so many complaints are going to filed that Amy Dutschke will be confused about what to do. Haha. No one from PBMI ever does anything about anything. Gotta focus on opioid use, right?
Members just received a notice that the per capita is being cut by $2,025.00 starting in January 2019. Also states that Tribal departments will decreasing expenses by 25%. How are we supposed to know how much 25 % of their expenses are because they play with the numbers to much at their budget meetings. I don't see any decrease in pay for the EC, which are way over paid for the work that do. Robert Smith pays himself #200,000.00 per year for being the chairman and Nieto pays herself over $150,000.00 per year for her being the treasurer. Where are their cuts on this notice that we received in the mail. The spending habits of the EC will not decrease in the coming year, if any thing they will increase by 25% the amount that the members pay was cut. But who the cares right, that's why you voted them back in. You people that voted for them have made the biggest mistake in your life by doing so. You can blame no one but your self for this cut.
We the people never get to see the yearly expenses that should equal the budget requested for each department. How much was spent of the approved budget amount, was it more or was it less than approved budget. If it was more why, if it was less then where is the remaining money. Show us where the money went, show us where the 25% cut of the Tribal members pay will be spent. Show us why all the other departments including the Casino were not cut first before the members were. Show us how much the income was from the groves that we own here and in Pauma Valley. Show us a list with detailed income for all the Tribal investments that we are supposed to have. This is all a big smoke signal by the EC to blind the members of the truth and cover ups for their corruption.
162 members received notice their per capita was being cut 100% and I don't recall anyone crying or sniveling around about it. Changes to the revenue allocation plan must be approved by the GC, and a Resolution submitted to the BIA stating the date the changes a record of the vote. If there is no resolution then the change can't be made legally. If they submit a resolution without a vote then it is an IGRA violation.
Is the GC going to sit back and let it happen again? Probably.
Sorry but you are wrong r&r. Since the EC is lowering the revenue equally across the board then they do not have to go back to the NIGC. The percentages remain the same so there is no change in the TRAP. I know of only one tribe that follows their TRAP to the letter. Every month their per cap is different because they monthly revenues are different. Most tribes average and most use a low figure then the balance is paid as a bonus at the end of the year if their is residual funds.
The way to affect the EC is lower the percentage on Economic Development and put that percentage in to per cap. The EC has not been successful with developing any extra revenues for the tribe through their blunders of various investments for the tribe. Everyone should demand that any revenues not associated with the casino be distributed annually as per cap to the membership. The Constitution authorizes the BIA to conduct audits to make sure the properties and rights of the tribal members are being protected and administered equally. The GC can do this and override the EC and the report should be made available to the GC. If the BIA denies to do and audit then the BIA can be sued. A court audit would be nice because it would uncover all of the collusion and RICO violations. Sorry if this message is a bit over most peoples heads but if you use more than 3 words in a sentence most people at Pala don't understand it. Time for them to step up. Tired of having to step down for the Robert followers.
The allocation plan does not change and the percentage’s stay the same the difference is the amount Robert says the casino is bringing in which lowers everything. People need to ask what results the millions a year for the economic development fund has produced and to see if they need that much money and if it’s worth it. If not than lower the economic development fund percentage and move it over to percap. Of course smith and nieto will not allow this but it’s a thought. Then again we are asking the same people who voted in the very same people who told them we are taking away your money to have a thought so let’s see how far that goes. So the EC has submitted an audited financial report to the NIGC that shows 25% lower revenue than last year? And there is a new financial report for the GC that shows reductions across the board?
I guess it doesn't matter anyway. The reports are always phoney. No one verifies the report, audits the income and expenses, and makes sure the EC is acting legally.
A 25% reduction should be visible though. Fewer employees, vehicles, trips on the jets and such. My guess is Smith will say there have been cuts, but the only thing cut will be per capita, and the BIA will turn their eyes the other way.
The Pala EC hasn't legally in over 20 plus years. If it were possible for them to act and do things according to the Customs and Traditions of the Tribe they would be so confused they would have to seek medical treatment and mental treatment. In other words they wouldn't know what to do. They have no clue what Customs and Traditions are.
Because they did a great job hiding the money off of the top that the EC took and their bonus was a percentage of that but the EC called it a Christmas Bonus.

I was siting at the bar tonight at the Casino and heard that the CEO/ General Manager Bill B. is no longer the GM at the Casino he was let go for unknown reasons. Maybe know the EC won't cut the per capita. Or maybe Robert Smith will make Jimbo Goodpasture the new GM at the Casino or Eric Garcia/Ortega.
Robert has already demonstrated that he can cut administration funds by 25%. So let him do that and save per capita. What about tribal taxes that are collected from the store and other places. Are the business on Mexipino corner collecting taxes for the tribe? Remember that we fully fund all of the tribal projects every year so that means the avocado project is earning 100% every year because the expenses are being covered by casino moneys. Same with the store and the other businesses of the tribe. Every year they are funded 100% of their operational costs from casino moneys so where do the 100% of profits go? Any guesses? Definitely not per capita. Take away the economic development fund since no project has benefitted the tribe. Per cap should be going up not down. Vote down the EC and up per cap. This can be done at the meeting. Robert cant restrict what motions are made if they are relevant to the agenda item. Of course his trick is not to put it on the agenda. He will probably put it in the chair report and just tell everyone to fuck off while he laughs and cant wait for the meeting to be over so he and his treasury bitch can go do themselves in the back room. By doing what Robert Smith did concerning the #100,000 dollar check could be considered a felony if the people would push it legally. That is fraud against an Indian Tribe and is punishable through the Federal Court system according to Federal Crimes website. It has happened before in other Tribes in Indian Country and the person and persons involved were sent to Federal Prison for the same type of fraud. However the PBMI must make the complaint and i truly doubt that anyone will. They will probably just say that it is just another fraud in the daily life of Robert Smith.

What proof is there that admin expenditures will be reduced by 25%? Can you trust any information coming from Nieto? It will probably be just like the economic development fund where Smith and Nieto say that the fund was invested and lost. No one really knows if the money was invested, what the investment was, what the performance or return on investment was projected to be, or where the money actually went.
Since everything they say is a lie the claim reduced budget or expenditures is meaningless. All the members will be able to verify is that per capita is lowered because they will get smaller checks.
Same with casino performance. No one knows how much the casino makes, or what happens to the money once Smith and Nieto get their hands on it. The EC doctors the reports that are sent to the NIGC too. They deduct loans and obligations which reduces revenue. Those loan numbers are easily inflated and thenot lower revenue reported. It is a scheme to increase the skim, and reduce the amount that is supposed to be shared with the members.

I heard a funny story today. Someone said that Robert Smith and Theresa Nieto are worried about the release of Andrew Castillo aka Hawka from jail because they leveled his home while he was locked up. Hawka is just crazy enough to do something to them for knocking down his house. Maybe our prayers will be answered after all. Hawka will be released on Jan.24, 16 more days.

The way to change things is to assert the authority of the General Council and remove Smith and Nieto from office. If a majority of the General Council wants Smith and Nieto, then there is no way to change things. The members have to want it.
Simple as that. It does mean that people will have to take a risk that they might get disenrolled, or have their per capita taken away, or be evicted from the reservation. That is the kind of power that Smith has convinced the General Council that they have given him. Such power is unconstitutional, and the General Council cannot approve laws that are unconstitutional no matter what Smith says.
PBMI has been completely and totally controlled by Smith and Nieto. It seems that the members are unwilling to call a meeting of their own, where Smith does not control the agenda, and make a motion to remove Smith and Nieto from office for fraud, malfeasance, breach of their oaths of office, conversion of assets, and embezzlement. There needs to be a record of the meeting, the motion, and the vote, and it needs to be presented to the BIA.
Then when Smith calls his Special Meeting to get rid of his opponents, the people that voted him out have to attend and vote down any retribution, and reaffirm the removal from office.
Judging from the meeting Roberts followers are finally starting to turn on him, it's about time. The plan above sounds good and well but people don't have the balls to do what is needed and that's what Robert is banking on. He's going to fight tooth and nail because once the truth is out about all his crimes many members of his family will go down too. Hold a GC tribunal a find him guilty of personal enrichment. The GC is the governing body. You may have given him the right to do business for the band but the band can still hold him accountable for acts against the tribe. There is nothing in the constitution or the articles that says you can't do it, so just like he dose things because its not in the law you can establish the presidency. Form a tribunal commuter and string him, teresa, Dion (that little shit) and anyone else you see fit. Nobody else has 30 cars, 5 houses, 20 concubines (all male) and private jets at their disposal. Don't take that nonsense that the jet is used for tribal business, the only thing its used for is whites and golf. The band is the law not him. The BIA has nothing to do with it, this is a tribal matter and SANTA CLARA PUEBLO MARTINEZ protects you in diciding thing at the tribal level. He has betrayed the band and you can convict him of what ever you agree he has done as a commitee. Personal enrichment, acting out of the office, theft, embezzelment, etc. If you try him on these things and he wants to defend himself there will need to be a forensic audit, not only for him but for the band. Quit wasting time, do it now.
It will be interesting to see if the 2019 tribal budget is 25% less than the 2018 tribal budget. Robert's salary should be reduced by 25%. Actually it should be reduced by 100% since all of his expenses are paid and he already receives per capita. No matter what the numbers are they should add up to 25% less than last years budget. Ask about end of the year savings and have those savings deducted from the departments budget and carried forward in to 2019 plus the 25% reduction. Eliminate the EPA and the Tribal Historic Preservation Officer positions. No attorney contracts without prior approval of the general council. Any money spent on attorneys without gc approval should be paid back to the tribe by the EC. All money from the sale of avocados and the 11% tribal sales tax should go for per capita since the casino revenues cover all the cost of administration and fixed costs. Sell off the property purchased by the EC and give everyone a bonus. Sell off the time shares in Warner Springs and give everyone a bonus. Oh yeah I forgot, we lost our time shares in the bankruptcy. Kiss that well managed $25 million good bye. Shut down the race track unless TN and RS turn the contract over to the tribe. Remember they are being paid $10,000 a month for the race track. Should be your money but you know how you are. Afraid to ask the real questions. And where is all that sand rock and gravel going. So has anyone thought of compiling a list of the missing income? This income should be reported to the GC, and it all should be distributed as per capita. None of it needs to divided into percentages according to TRAP because it is not regulated. Since all the costs and expenses of operating the Casino Resort and tribal administrative costs are covered by Casino revenue, this is all just extra money that disappears because it is embezzled by Smith and Nieto.
This list should include:
Targeted funding from the Federal Government Grant money from the Feds Profit from Avocado farming Proceeds from Pala Raceway Income from rental properties Interest income Sand and Gravel income Income from sales of used tribal vehicles Profit from the Pala Market Profit from Pala Interactive (if there is any)
I'm sure this is just scratching the surface, and feel free to add anything else you know of to this list. The point is that all of this money is being embezzled by Smith, and that is a federal crime. If the GC wanted to they could swear out a complaint against the Pala EC and bring them up on charges of embezzlement with the U.S. Attorney's Office. The specific law that is being violated is 18 U.S.C. 1163:
Whoever embezzles, steals, knowingly converts to his use or the use of another, willfully misapplies, or willfully permits to be misapplied, any of the moneys, funds, credits, goods, assets, or other property belonging to any Indian tribal organization or entrusted to the custody or care of any officer, employee, or agent of an Indian tribal organization; or
Whoever, knowing any such moneys, funds, credits, goods, assets, or other property to have been so embezzled, stolen, converted, misapplied or permitted to be misapplied, receives, conceals, or retains the same with intent to convert it to his use or the use of another-
Shall be fined under this title, or imprisoned not more than five years, or both; but if the value of such property does not exceed the sum of $1,000, he shall be fined under this title, or imprisoned not more than one year, or both.
As used in this section, the term "Indian tribal organization" means any tribe, band, or community of Indians which is subject to the laws of the United States relating to Indian affairs or any corporation, association, or group which is organized under any of such laws.
This penalty would apply to each count of embezzlement, and the Band could seek recovery in lieu of fines, while requesting only the prison terms.
So I have handed it to you. I have no idea why the FBI did not simply indict Smith and Nieto on embezzlement charges. The PBMI has income that should be reported and distributed as per capita and the Pala EC is embezzling it. However, the FBI is not required. The money that PBMI receives from the Federal Government is never reported to the GC. Take one of the phony financial reports, combine it with the public disclosure of federal funding and bring that to the U.S. Attorney along with the complaint and get the ball rolling. One of the attorneys that is retained by the tribe should be able to help you with this. Wouldn't it be funny to see if Sarah Setshwaelo actually does represent the PBMI? If she refuses to act on PBMI's behalf then you can have her disbarred.

Pala isn't a tribe, though, because if they were,they would be able to have access and answers to the questions they have. They are living within a plutocracy, where only the few wealthy players are in charge, who have the ways and the money to use as they see fit. They would have to completely restructure their government, where the people once again make the decisions in the interests of the tribe, where their voices aren't met with retribution (cutting them off, kicking them out), but it seems,no one there has the ability to do so. Rather than take a risk, and putting these questions to their elected council, they'd rather cower and stay quiet, or try and have the BIA intefere with their matters. I suppose we need to add all the houses that people bought with loans from Pala. Robert Smith treats those houses as though they are his own private property, and the loans default to him instead of to the PBMI. Probably the payments go to Robert too and the Band pays for the homes and the financing while Robert gets all the money. Not really. The PBMI Constitution says that membership is based on descent from the 1895 and 1913 allottees. There is no tribal affiliation in the PBMI Constitution. Just take a minute and think with your brain about all that the disenrolled members have endured because of Robert Smith and Theresa Nieto's hate for certain members of PBMI. It's time to do a DNA on EVERYONE. Start with the 1940 rolls. Have an outside source do the testing, make sure NONE of the EC or ANYBODY can interfere with the results. Since some members (won't say who) were allowed to use both parents blood even though 1 parent isn't a Pala member to enroll their children then a precedent has been established, so basically EVERYONE has the right to do this. Give them 1 month to do the DNA test, if they don't comply then no per capita.
That is true about some people being able to use both parents blood, while some of the Brittains are 3/8 Indian of Cahuilla,Luiseno,and Cupeno, but can't use their Luiseno blood, which is ridiculous, especially since Pala refers to themselves now as Luiseno. WHy did some people get special treatment and now their kids are all enrolled taking away the rightful place of the disenrolled, they should feel horrible that they got their kids enrolled illegally while the rightful people suffer. The General Council approved making all the Warner's Ranch Evictees full blood when the base membership roll was created in 1961. Funny how Roscinda Nolasquez was made full blood even though her father was Mexican, but someone crossed out Margarita Britten's full blood and wrote in 1/2, and suddenly that became true. No use arguing about it, but under handed actions appear to be matter of fact.
The General Council did not approve all evictees be full blood, that was one proposal that the enrollment committee looled at and suggested, but it was never implemented, otherwise my family would look a lot different as far as enrollment is concerned.
You're right. BIA forced the Band to use their calculated blood degree based on 1933 Court of Claims roll among other records. It was the BIA's way to get rid of tribal affiliations and create a new blood of the Band.
Then they decided Pala was Luiseno, and Robert Smith didn't argue because he wanted gaming and needed federal recognition. PBMI is not an historical tribe and could not petition under Part 83.

Does anyone know why for the election results announcement Robert stated Pala had 900 members and for the Pharma lawsuits and during the mews interview for the Pharma lawsuit Robert said both times Pala had around 1300 members?? Is this because he is paying out that many percap checks since his supporters get 2 percap checks that’s why they support someone who is powering percap because it doesn’t effect them. We had 700 adults and around 200 minors so around 900 members when the disenrolled 264 members in 2012 so that leaves 636 members. So Robert has enrolled either another 264 or over 500 members since 2012? What is the truth?? If we have almost 1300 members like he states then about 1,000 adults so the drop in percap saves the tribe $2 million a month?? Is this how bad off we are that they need to save another $2 million a month. Where is that savings going ?? We need to know how many members our tribe has and how many Robert supporters he has enrolled of their kids and grandkids to keep them on his side. So you have to go to BIA So-Cal Agency to find out how many PBMI members there are? Don't just ask them. File a complaint with Superintendent saying that the PBMI won't verify equitable distribution of revenue and conceal dollar amounts and number of members from the General Council. The allocation plan is approved by the BIA and all details should be made.available to members on request. See if the BIA tries to hide the details too. If they do there is evidence of conspiracy to commit fraud. You can also submit a FOIA request for the federal roll of the PBMI and any financial statement that proves the PBMI is in compliance with the revenue allocation plan.
When the judges asked if there would be turmoil, what? There is already turmoil, this might cause a little more, but that would be on Robert and the EC's part and they are the ones causing it now, so once they are out, the tribe can try to heal from the horrendous damage that Robert, Teresa, The BIA and Howard Dickstein have caused.

THINK ABOUT IT: why would people that know the incumbent EC spent all the tribes money is not giving them a Christmas bonus and is lowering percap vote them back into office? The only reasons I can think of are:
1) Those members are getting something the rest of us are not like a second check.
2) Those members and some of their family are only enrolled because of Robert and their support of him so they will vote to keep him in power because any percap is better than none. Which they should have NoNe!

The way the incumbents have run the tribe and especially what has happened over the past few years for any logical person would not get them the majority of the votes. They announce they spent all the tribes money and have to lower our income and then 2 months later they are voted back into office?? How does this make senator anyone??
Change in person capita requires a change in the Revenue Allocation Plan. This must be approved by a majority vote at a GC meeting. Then a resolution must be submitted to the BIA showing that there was vote to revise TRAP.
If it isn't voted on at a meeting and a Resolution is submitted it is fraud. If it is not presented as a revision to TRAP then it is fraud. If the EC reduces per capita without BIA and NIGC approval it is an IGRA violation.
Make sure it is done in compliance with the law. If it isn't then file a complaint with the BIA. The more people that complain the better. Amy Dutschke will not act on complaints against Smith. Send those certified mail and keep a copy. If there is no response after 30 days file an appeal with IBIA for inaction of a BIA official.
Now I know so many complaints are going to filed that Amy Dutschke will be confused about what to do. Haha. No one from PBMI ever does anything about anything. Gotta focus on opioid use, right?

Also states that Tribal departments will decreasing expenses by 25%.

I don’t know why the general council doesn’t impeach Robert and Theresa. You guys are dumb for letting them do this to you. You all just sit back and let them do whatever they want.
Changes to the revenue allocation plan must be approved by the GC, and a Resolution submitted to the BIA stating the date the changes a record of the vote. If there is no resolution then the change can't be made legally. If they submit a resolution without a vote then it is an IGRA violation.
Is the GC going to sit back and let it happen again? Probably.
Sorry but you are wrong r&r. Since the EC is lowering the revenue equally across the board then they do not have to go back to the NIGC. The percentages remain the same so there is no change in the TRAP. I know of only one tribe that follows their TRAP to the letter. Every month their per cap is different because they monthly revenues are different. Most tribes average and most use a low figure then the balance is paid as a bonus at the end of the year if their is residual funds.
The way to affect the EC is lower the percentage on Economic Development and put that percentage in to per cap. The EC has not been successful with developing any extra revenues for the tribe through their blunders of various investments for the tribe. Everyone should demand that any revenues not associated with the casino be distributed annually as per cap to the membership. The Constitution authorizes the BIA to conduct audits to make sure the properties and rights of the tribal members are being protected and administered equally. The GC can do this and override the EC and the report should be made available to the GC. If the BIA denies to do and audit then the BIA can be sued. A court audit would be nice because it would uncover all of the collusion and RICO violations. Sorry if this message is a bit over most peoples heads but if you use more than 3 words in a sentence most people at Pala don't understand it. Time for them to step up. Tired of having to step down for the Robert followers.

The allocation plan does not change and the percentage’s stay the same the difference is the amount Robert says the casino is bringing in which lowers everything. People need to ask what results the millions a year for the economic development fund has produced and to see if they need that much money and if it’s worth it. If not than lower the economic development fund percentage and move it over to percap. Of course smith and nieto will not allow this but it’s a thought. Then again we are asking the same people who voted in the very same people who told them we are taking away your money to have a thought so let’s see how far that goes. So the EC has submitted an audited financial report to the NIGC that shows 25% lower revenue than last year? And there is a new financial report for the GC that shows reductions across the board?
I guess it doesn't matter anyway. The reports are always phoney. No one verifies the report, audits the income and expenses, and makes sure the EC is acting legally.
A 25% reduction should be visible though. Fewer employees, vehicles, trips on the jets and such. My guess is Smith will say there have been cuts, but the only thing cut will be per capita, and the BIA will turn their eyes the other way.

The Casino management is not very happy being accused by the EC for the rumors spreading around about mismanaging
the money because it suddenly becomes short after it is turned over to the Tribe by the Casino.
I was siting at the bar tonight at the Casino and heard
that the CEO/ General Manager Bill B. is no longer the GM at the Casino he was let go for unknown reasons.
Maybe know the EC won't cut the per capita.
Or maybe Robert Smith will make Jimbo Goodpasture the new GM at the Casino or Eric Garcia/Ortega.
Robert has already demonstrated that he can cut administration funds by 25%. So let him do that and save per capita. What about tribal taxes that are collected from the store and other places. Are the business on Mexipino corner collecting taxes for the tribe? Remember that we fully fund all of the tribal projects every year so that means the avocado project is earning 100% every year because the expenses are being covered by casino moneys. Same with the store and the other businesses of the tribe. Every year they are funded 100% of their operational costs from casino moneys so where do the 100% of profits go? Any guesses? Definitely not per capita. Take away the economic development fund since no project has benefitted the tribe. Per cap should be going up not down. Vote down the EC and up per cap. This can be done at the meeting. Robert cant restrict what motions are made if they are relevant to the agenda item. Of course his trick is not to put it on the agenda. He will probably put it in the chair report and just tell everyone to fuck off while he laughs and cant wait for the meeting to be over so he and his treasury bitch can go do themselves in the back room. Yes it is that bad and yes you have let it happen. Not for long though. This nightmare in pala is coming to an end for sure in 2019. It will be one of the more significant years in Pala since the removal in 1903. It will be happening.
What is sad is they continually divert the blame to the casino management so everyone forgets the real reason why the people are upset. By doing what Robert Smith did concerning the #100,000
dollar check could be considered a felony if the people would push it legally.

What proof is there that admin expenditures will be reduced by 25%? Can you trust any information coming from Nieto? It will probably be just like the economic development fund where Smith and Nieto say that the fund was invested and lost. No one really knows if the money was invested, what the investment was, what the performance or return on investment was projected to be, or where the money actually went.
Since everything they say is a lie the claim reduced budget or expenditures is meaningless. All the members will be able to verify is that per capita is lowered because they will get smaller checks.
Same with casino performance. No one knows how much the casino makes, or what happens to the money once Smith and Nieto get their hands on it. The EC doctors the reports that are sent to the NIGC too. They deduct loans and obligations which reduces revenue. Those loan numbers are easily inflated and thenot lower revenue reported. It is a scheme to increase the skim, and reduce the amount that is supposed to be shared with the members.

The way to change things is to assert the authority of the General Council and remove Smith and Nieto from office. If a majority of the General Council wants Smith and Nieto, then there is no way to change things. The members have to want it.
Simple as that. It does mean that people will have to take a risk that they might get disenrolled, or have their per capita taken away, or be evicted from the reservation. That is the kind of power that Smith has convinced the General Council that they have given him. Such power is unconstitutional, and the General Council cannot approve laws that are unconstitutional no matter what Smith says.
PBMI has been completely and totally controlled by Smith and Nieto. It seems that the members are unwilling to call a meeting of their own, where Smith does not control the agenda, and make a motion to remove Smith and Nieto from office for fraud, malfeasance, breach of their oaths of office, conversion of assets, and embezzlement. There needs to be a record of the meeting, the motion, and the vote, and it needs to be presented to the BIA.
Then when Smith calls his Special Meeting to get rid of his opponents, the people that voted him out have to attend and vote down any retribution, and reaffirm the removal from office.
That will get it done.
All you would need is more than half the general membership. And Robert can’t dissenroll half the membership.

Hold a GC tribunal a find him guilty of personal enrichment. The GC is the governing body. You may have given him the right to do business for the band but the band can still hold him accountable for acts against the tribe. There is nothing in the constitution or the articles that says you can't do it, so just like he dose things because its not in the law you can establish the presidency. Form a tribunal commuter and string him, teresa, Dion (that little shit) and anyone else you see fit. Nobody else has 30 cars, 5 houses, 20 concubines (all male) and private jets at their disposal. Don't take that nonsense that the jet is used for tribal business, the only thing its used for is whites and golf. The band is the law not him. When he wants to kick people off he doesent do it by the EC he takes it to the band. That's because the EC is the law not him. Form a tribunal and hang him.
The BIA has nothing to do with it, this is a tribal matter and SANTA CLARA PUEBLO MARTINEZ protects you in diciding thing at the tribal level. He has betrayed the band and you can convict him of what ever you agree he has done as a commitee. Personal enrichment, acting out of the office, theft, embezzelment, etc. If you try him on these things and he wants to defend himself there will need to be a forensic audit, not only for him but for the band. It will be interesting to see if the 2019 tribal budget is 25% less than the 2018 tribal budget. Robert's salary should be reduced by 25%. Actually it should be reduced by 100% since all of his expenses are paid and he already receives per capita. No matter what the numbers are they should add up to 25% less than last years budget. Ask about end of the year savings and have those savings deducted from the departments budget and carried forward in to 2019 plus the 25% reduction. Eliminate the EPA and the Tribal Historic Preservation Officer positions. No attorney contracts without prior approval of the general council. Any money spent on attorneys without gc approval should be paid back to the tribe by the EC. All money from the sale of avocados and the 11% tribal sales tax should go for per capita since the casino revenues cover all the cost of administration and fixed costs. Sell off the property purchased by the EC and give everyone a bonus. Sell off the time shares in Warner Springs and give everyone a bonus. Oh yeah I forgot, we lost our time shares in the bankruptcy. Kiss that well managed $25 million good bye. Shut down the race track unless TN and RS turn the contract over to the tribe. Remember they are being paid $10,000 a month for the race track. Should be your money but you know how you are. Afraid to ask the real questions. And where is all that sand rock and gravel going. So has anyone thought of compiling a list of the missing income? This income should be reported to the GC, and it all should be distributed as per capita. None of it needs to divided into percentages according to TRAP because it is not regulated. Since all the costs and expenses of operating the Casino Resort and tribal administrative costs are covered by Casino revenue, this is all just extra money that disappears because it is embezzled by Smith and Nieto.

Profit from Avocado farming
Proceeds from Pala Raceway
Income from rental properties
Interest income
Sand and Gravel income
Income from sales of used tribal vehicles
Profit from the Pala Market
Profit from Pala Interactive (if there is any)
I'm sure this is just scratching the surface, and feel free to add anything else you know of to this list. The point is that all of this money is being embezzled by Smith, and that is a federal crime. If the GC wanted to they could swear out a complaint against the Pala EC and bring them up on charges of embezzlement with the U.S. Attorney's Office. The specific law that is being violated is 18 U.S.C. 1163:
Whoever embezzles, steals, knowingly converts to his use or the use of another, willfully misapplies, or willfully permits to be misapplied, any of the moneys, funds, credits, goods, assets, or other property belonging to any Indian tribal organization or entrusted to the custody or care of any officer, employee, or agent of an Indian tribal organization; or
Whoever, knowing any such moneys, funds, credits, goods, assets, or other property to have been so embezzled, stolen, converted, misapplied or permitted to be misapplied, receives, conceals, or retains the same with intent to convert it to his use or the use of another-
Shall be fined under this title, or imprisoned not more than five years, or both; but if the value of such property does not exceed the sum of $1,000, he shall be fined under this title, or imprisoned not more than one year, or both.
As used in this section, the term "Indian tribal organization" means any tribe, band, or community of Indians which is subject to the laws of the United States relating to Indian affairs or any corporation, association, or group which is organized under any of such laws.
This penalty would apply to each count of embezzlement, and the Band could seek recovery in lieu of fines, while requesting only the prison terms.
So I have handed it to you. I have no idea why the FBI did not simply indict Smith and Nieto on embezzlement charges. The PBMI has income that should be reported and distributed as per capita and the Pala EC is embezzling it. However, the FBI is not required. The money that PBMI receives from the Federal Government is never reported to the GC. Take one of the phony financial reports, combine it with the public disclosure of federal funding and bring that to the U.S. Attorney along with the complaint and get the ball rolling. One of the attorneys that is retained by the tribe should be able to help you with this. Wouldn't it be funny to see if Sarah Setshwaelo actually does represent the PBMI? If she refuses to act on PBMI's behalf then you can have her disbarred.

They are living within a plutocracy, where only the few wealthy players are in charge, who have the ways and the money to use as they see fit. They would have to completely restructure their government, where the people once again make the decisions in the interests of the tribe, where their voices aren't met with retribution (cutting them off, kicking them out), but it seems,no one there has the ability to do so. Rather than take a risk, and putting these questions to their elected council, they'd rather cower and stay quiet, or try and have the BIA intefere with their matters. I suppose we need to add all the houses that people bought with loans from Pala. Robert Smith treats those houses as though they are his own private property, and the loans default to him instead of to the PBMI. Probably the payments go to Robert too and the Band pays for the homes and the financing while Robert gets all the money. He even puts leins on per capita if people default on the loans and three guesses as to who gets that money.
.Pala is headed straight in to the gutter and the members don't seem to care enough to act on any and all of the crimes that Smith and Nieto are guilty of against the members of PBMI.

People are just as fed up with some of the members as they are with the corrupt EC members for just sitting
and doing nothing to save the Tribe.

The casino is not the issue. Robert Smith is bankrupting the casino and Pala so that doesn't matter anyway. The Cupeno are not a new tribe. They are a tribe and always have been.
PBMI is very new, just had their name changed from the Pala Luiseno to PBMI a few years ago.
The Pala Band everyone knew from the Articles of Association was formed around 1961, certainly not new.
The Luiseno and Cupeno are tribes. PBMI is not.

If the case is lost then there are no cupeno people so if the court rules that way everyone becomes luiseno. Most of the enrollees have luiseno blood so they would be eligible to be enrolled in pbmi so it is a win win for the disenrollees. Chew on that turd for awhile.
Not really. The PBMI Constitution says that membership is based on descent from the 1895 and 1913 allottees. There is no tribal affiliation in the PBMI Constitution. I don't want to talk about land that was intended for Cupeno use taken without statutory authority or compensation. I really don't want to talk about liability. Just leave it at that.

Just take a minute and think with your brain about all
that the disenrolled members have endured because of Robert Smith and Theresa Nieto's hate for certain members
of PBMI.
Think about all the court cases that have done nothing to help these members in their fight to be placed back on the Tribes roles.
Now think about what if your family or loved ones are put in the same spot as them do you really think that you would have a chance to be put back on the Tribal roles.
No way possible because of all the decisions made in the
courts favor the EC.
So if you are thinking you can win against the corruption of the Pala EC you are wrong.
The one and only way to put a stop to this kind of abuse is to stop it on a Tribal level because they courts have made many statements about how they can not do anything
because it is an internal tribal matter which means that it will have to be solved within the Tribe itself.
So it is clear as day that you the members of PBMI are the only ones that have this power to stop Smith and Nieto from hurting any other family like they hurt the Britten family members for no reason other than hate.
So if you chose to sit there on your asses and do nothing because of your fear of the EC it is all on you
for not fixing this problem.

It's time to do a DNA on EVERYONE. Start with the 1940 rolls. Have an outside source do the testing, make sure NONE of the EC or ANYBODY can interfere with the results. Since some members (won't say who) were allowed to use both parents blood even though 1 parent isn't a Pala member to enroll their children then a precedent has been established, so basically EVERYONE has the right to do this. Give them 1 month to do the DNA test, if they don't comply then no per capita.
That is true about some people being able to use both parents blood, while some of the Brittains are 3/8 Indian of Cahuilla,Luiseno,and Cupeno, but can't use their Luiseno blood, which is ridiculous, especially since Pala refers to themselves now as Luiseno. WHy did some people get special treatment and now their kids are all enrolled taking away the rightful place of the disenrolled, they should feel horrible that they got their kids enrolled illegally while the rightful people suffer. It is not right, that is why Pala is going to just get worse, the people are doing wrong and not being spiritually native, they have become docile sloths, waiting for the money to come into their accounts.
This is why Robert still has supporters because he allows them and their kids to be enrolled and in return they vote his way and for him.
Who nominated Robert Smith and who closed nominations immediately after he was selected as a candidate. This action was well planned in order to protect his lies, conceal his fraud to the tribe and those people should be held accountable for participating and aiding in the defrauding of the Pala Tribe, using those actions to support a criminal who is stealing from the people. The General Council approved making all the Warner's Ranch Evictees full blood when the base membership roll was created in 1961. Funny how Roscinda Nolasquez was made full blood even though her father was Mexican, but someone crossed out Margarita Britten's full blood and wrote in 1/2, and suddenly that became true. No use arguing about it, but under handed actions appear to be matter of fact.

The General Council did not approve all evictees be full blood, that was one proposal that the enrollment committee looled at and suggested, but it was never implemented, otherwise my family would look a lot different as far as enrollment is concerned.
You're right. BIA forced the Band to use their calculated blood degree based on 1933 Court of Claims roll among other records. It was the BIA's way to get rid of tribal affiliations and create a new blood of the Band.
Then they decided Pala was Luiseno, and Robert Smith didn't argue because he wanted gaming and needed federal recognition. PBMI is not an historical tribe and could not petition under Part 83.
