They did not drop the name. They changed the name of the Pala Luiseno to the Pala Band. The Pala Luiseno are the Pala Luiseno and were listed on the Federal Register as the Pala Band of Luiseno Mission Indians, now they are known as the Pala Band of Mission Indians - a Luiseno Band - which is why Robert Smith is referred to on all sorts of documentation as Chairman of the Luisenos, see link at end of post.

Re-read it slowly, this is how it went down. Back in the 1800's the pala band of luiseno mission indians (a federally recognized indian tribe) was granted a reservation of 300+ acres south of the San Luis Rey river, this is known as old pala,
Once the Indians occupying Warner's Ranch were evicted the United States purchased 900+ acres of land in the pala valley adjacent to the already established small reservation already here occupied by the pala band of luiseno mission indians.
The people moved from Warner's to the 900+ acres purchased in pala eventually became known as the pala band of mission indians.
Now here's where it gets tricky, people think the new 900+ acre reservation was just a extension of the pala band of luieno's reservation, IT IS NOT! there is and has been 2 separate reservations in pala, (old pala) and the land occupied by the P.B.M.I.
Now I'm not sure of the , date, but there was a vote of the 2 reservations in the pala valley to merge under the Indian Reorganization Act, (IRA). The vote to combine all the tribes in pala failed almost unanimously, therefor the situation stayed status quo, 2 distinct reservations, one occupied by the pala luiseno (old pala) and the larger reservation occupied by P.B.M.I.
Now stay with me here. The B.I.A. maintains a list of all federally recognized indian tribes. Since the lists inception the pala band of luiseno mission Indians (old pala) always appeared on the list, P.B.M.I. was never listed, although the Agua Caliente tribe moved from Warner's was federally recognized at the time of their removal, somehow they just got overlooked as a recognized TRIBE once they became part of the association of groups moved to pala (P.B.M.I.).
Robert Smith's attorneys and probably his bought off b.i.a. employees, (Amy Douchbag) realized that his fake constitution states p.b.m.i. as a federally recognized indian tribe, the fact is they are not! And the fact p.b.m.i. never appeared on the list confirms that fact.
So for the right amount of your dwindling per capita the B.I.A. put on the dunce cap, put the blinders on and played stupid by acting like resolution 14-15 was accurate and that they (the B.I.A.) was wrong with the list.
The fact is, they were right, but Robert Smith needs federal recognition.
The solution?, change the name of the pala band of luiseno mission Indians to the pala band of mission Indians.
The problem? P.B.M.I. is now the band that belongs in old pala. They have taken the luiseno's place on the list, the pala luiseno have disappeared from the list.
Problem #2, only Congress can terminate a tribes federal recognition, so it's my guess that it cost p.b.m.i. a shit load of $$$ for the B.I.A. to put their necks on a chopping block and bypass Congress by terminating the pala,band of luiseno mission Indians, in favor of Robert Smith and the P.b.m.i., it's just not how it's done.

He is gearing up to build a new Casino for the old Pala Reservation
is what I think he is doing.
There would be less members to divide the profits with and the Cupeno side will be left outside looking in.
The current Casino will be boarded up and closed for good.
There will be no per capita for the Cupeno side only the small membership of the new Tribe will profit and Smith and Nieto have already been placed in charge of every thing with the old Pala Luiseno Tribe.
Boy what a scam he and Nieto have pulled on the Cupa Members and they are close to getting away with it with the help of one of their new Tribal members Amy Douchbag.

Please keep us informed on the IBIA'S decision regarding Sara Dutchske Setshwaelo's attempt to horn in on this case. She represents herself and her firm as "Attorneys for Interested Party - Pala Band of Mission Indians," so did the Pala Band have her attorney contract approved by the General Council? Why would they allow her to be a representative for an interested party, when she's Amy Dutchske's niece. Wouldn't it be quicker for her to get inside information from her Aunt? It just doesn't sit right with me, all the people who are in bed with each other. I hope she get's denied, but fate hasn't been kind to the just.

Actually the first land purchased for the Warner Ranch Indians was 3,353 acres. The land was purchased from the Salmon family. The 900 acres was added later. The Morgan Hill transfer was between Pauma, Old Pala and the Warner Ranch Indians. Approximately 5,000 acres going to Pauma and 5,000 acres going to Old Pala and the Warner Ranch Indians.

This is pala and almost everyone is suffering from Stockholm syndrome. Pala is facing a big challenge. Will the General Council allow the Executive Committee to lower per capita (AGAIN) or will they finally stand up to them. There is plenty of room for cuts in tribal administration and economic development. When was the last time any of us has received a payment or bonus from all the businesses the Executive Committee has started. The answer is never. So force the Executive Committee to sell off the business assets like online gaming and the real estate investments. Close Pala Raceway and let the avocados dry up. Why keep paying for them if we are not going to benefit from them. Sell the extra security vehicles and tribal admin vehicles. Don't let the Executive Committee lies keep you in captivity. It is time to stop the runaway spending by Smith and Nieto. Stop it now. Tell the Executive Committee we want our per cap at $16,000 per month where it should be and a $30,000 Christmas bonus. Now those are real numbers not the bs smith and nieto are going to feed us.

Normal people recognize when something is not right, and you must think that these people see something wrong, but in their heart, it they place material things before what is right, you won't see any change. Most likely, a weak minded person will easily crumble to Roberts lies and bribes. Where are all the iron willed people? What will it take for more people to be outraged, more deaths, more lies, more loss of revenue? What is your limit, people and why did it even have to sink down so far?

Like it or not if a motion is made to not lower the per cap at a meeting and the motion caries the EC will not have choice but to honor the will of the people.
The dame goes for a Christmas bonus, if a motion is made to give out a 15-20,000 dollars to all adult members and the motion passes the EC will have no choice but to find the funds somewhere to pay out the bonus.
Its high time that the members take control of these issues NOW and don't Smith or Nieto tell you that there is money because that's a down right lie.
When was the last time that either one of them told the truth about any thing to do with financial dealings concerning the Tribe?
The money is there and Smith and Nieto just need more money to do some other things that they want to do and figure that the fastest way to get the money is to lie to the members and cut the per capita.
If you believe other wise then you are really brain washed or brain dead.
They always pull this shit at the same time every year so people will think that we are broke so no one will ask for a Christmas bonus.
Ask them to see a financial statement of the investments that the Tribe has and you will see how fast they will stumble and stutter trying to explain their cover

And also demand the financial audit of the Casino that is performed annually for the NIGC. Those numbers must agree with the electronic tracking of the slot machines. If the members really want answers to the financial status of the Band then go for it.
There is know reason for a cut to the members because the Casino is doing better than better know matter what Nieto says.
Everyone knows that she is a liar by the way she motioned to disenroll true members of the PBMI.
This is her way to get what she wants and it doesn't matter to her who she hurts by doing so.
Call them out at the next meeting and see for your self how they react when the people want something that they are entitled to have.
Make the motion to not cut the per capita and motion for a 10,000 dollar bonus to be paid to all adult members no later than Dec. 10th
of this year, and listen to the lies that they will tell you.

Here are some numbers that should have you scratching your head. When we shifted to general welfare payments that meant the tribe/EC was no longer deducting half your income tax. This meant that there was a $1,000,000 savings to the Tribe every month, $12,000,000 per year and $48,000,000 over the last 4 years. These numbers are actually low. These number belong in the per cap portion of the Revenue Allocation Plan. So where did the money go? Time to ask. It is your money. That is a bonus of about $50,000 per tribal member that we are due. Don't let Smith/Nieto lies rule anymore. Demand what is yours by law. Federal law and tribal law.

when the elders made enrollment criteria in the 60’s wasn’t it stated that ALL Warner ranch evictees would be considered 4/4 (including Margarita Brittain & Rocinda Nolasquez) then work down from there 4 generations??? Then leave enrollment alone. All this is brought up because of the unfair targeted disenrollments which has caused everyone to look back and study the history of tribal members and you find things you may not like. Re-enroll and then leave enrollment and families alone. This is the only thing that will end all this BS forever.
Having another family on the EC in a couple years that disenroll’s the Lugos or lowers the Lavato blood will just keep this BS going and going. There is only 1 way to end this. RE-Enroll and ban all disenrollments. Graton Rancheria did it because they had the foresight to see what could happen.

Yes it was stated that ALL evictees would be considered Full 4/4 blood, and Margarita came over with her daughter and grand-daughter.so that would make her daughter and her grand-daughter to be considered full blood.

It’s Peligrino Saubel. There is a probate of Carolina Nolasquez I believe from 1920’s stating she and Margarita Brittain were half sisters with the same father Peligrino Saubel but different mother who we all know was Cupeno as was Peligrino. Margarita also used the name Margarita Saubel early on which more verifies what Carolina Nolasquez states about Peligrino being their father. Now we all know this is one rumor Robert used to say MB wasn only half Cupeno. This probate has been shown to Robert and the EC but they chose to ignore it because it goes against the outcome they wanted. But it shouldn’t matter anyway since ALL WARNER RANCH EVICTEES are considered 4/4 for enrollment purposes.This is why Robert will not show or give a definitive reason why he lowered MB blood degree because then the Brittains can easily disprove any reason he gives. He only says everyone knows she was white are only half but will not show a document proving this. Have you seen a picture of MB?? That woman has No white in her at all straight up Native all the way. Only her kids had white because she married a white man named Brittain which isn’t even her maiden name. It was Owlinguish I believe. Her descendants have light skin because she and some of her kids married white people not Mexicans like other families which is the only reason they still have dark features not cause they are more native. Look at their last names Mexican last names because many natives hooked up with Mexicans and their descendants maintained dark features. There are enrolled Asians at Pechanga cause members had kids with Asians. So if MB married a mexican “Lopez” and had kids then they would be the Margarita Lopez descendants and probably still have dark features and according to some idiots on here be more native.

All Warner Ranch evjctees are not considered 4/4. That was a considered criteria, but was voted against. My great-great grandma and great grandma were removed from Warners and thry are listed as 1/2 and 1/4.

The people wanted to list everyone as 4/4ths but the BIA wouldn't allow it. What the people wanted and the BIA did are two different things. It wasn't the BIA that changed Margarita Brittens blood degree from 4/4 to 1/2 it was Patricia Nelson that did it. She was the one that made the pen changes to the rolls. If you people would take the time to read the documents that are posted on here the history if clear and the final determination of the BIA that Margarita Britten is indeed 4/4ths is fact based not bullshit based.

The BIA also wouldn't allow the people to put Kupa and Pala as tribal affiliation in the membership section of the Articles of Association. The Pala Band Business Committee started working on a.Constitution back in 1955. They did this because the California Tribal Termination Act was being discussed and felt if they organized under a Constitution that they might not be terminated. Theven Pala Band at this time was the Warner Ranch Evictees. They did not include Old Pala. This is clear from the minutes of the meetings. In 1957 they asked for assistance from the BIA. The BIA forced them into an association because they have a fiduciary trust duty to all the Indians of the Pala Valley, not just the Cupeno.

Can anyone tell me why the EC disenrolled these Members.
With all the evidence posted here and the fact that the U.S. Government did a full investigation as for the blood issue of this woman and determined that she was in fact a full blood Cupeno why were her family members ousted and why has NO ONE tried to fix this issue with the EC and the general membership.
All this is doing is harming innocent people and leaving the doors off of its hinges for future disenrollments.
This is a very big problem I see here and anyone with a little common
knowledge can see this is wrong and totally unfair for this to be put into limbo status as it remain as of today.
And why are members of another Reservation like Morongo able to sit on the Pala EC. All the evidence here supports that the family of Lugo's belongs in the Morongo Valley Tribe and not Pala.
This disenrollment issue is going to blow up in your faces if it is not corrected ASAP.
And another issue I see here is the Chairman of your Tribe is claiming a bloodline that has legally stopped with his Great grand father who gave up all of his Indian rights to become a citizen so he could be a land owner at some point making him a citizen Indian so future generations could not claim his bloodline for any and all purposes.
This also should be addressed ASAP.
Don't you people have any Attorneys to help you with this major mess?

Somebody please tell me where and in what law does an Indian who once lived off the reservation and who know can get an allotment, as a citizen Indian, no longer has the right to be an Indian. There is no law that states that bloodline ends.

Domingo Moro was a Citizen Indian because he took an Indian Homestead at Warner. This is why he was not allotted at Pala. Check your records. The law was the Indian Homestead Act which said that if you accepted land under the Act you gave up all of your rights as an Indian to include your heirs. Domingo Moro did this and yes under the law. Domingo Moro argued that Salvador Nolasquez was also a citizen Indian and was not entitled to an allotment at Pala. All you need to do is a little research in the archives and you will find this history.


Why this whole thing is stupid is that the people reached a decision to put all of this type of stuff behind them and move forward as the Pala Band. Robert Smith, Patricia Nelson, Leroy Miranda and Mel Lavato couldn't go along with the program and just simply be Pala Indians. They had to upset the apple cart and the apples are now spoiling on the ground. Every family, and I do mean every family, has something to hide. The Britten family is way ahead of everyone else because they have been under the microscope for the last 100 years. It doesn't matter what Robert Smith thinks today because he will soon be gone. Then what? The Lugos will be challenged and they will lose because of Robert Smith. The Lavatos will be big losers because they can't hide their Yaqui blood. Then there is the issue of tribe versus homeless Indian and the homeless Indians will lose the protection of being part of a tribe. It is all coming in your future so I hope you are ready for it. It will be bad, very bad. So take the time to thank Robert, Pat, Leroy and Mel for what they have done. Lugos, you did it to yourselves for just being ignorant. I think Ignorant Fools really applies here. You guys made the bed but believe me it doesn't come with a cozy mattress.

Can anyone explain why the voting numbers are not typed in and seem to be hand written in after the fact?
it looks to me like these Resolutions are typed up in advance and the numbers are written in by hand and hurried off to the BIA before anyone sees what they are doing.
Can anyone say "forgery".
In order to be a sworn document it cannot contain two types of writing
like this, typed and hand written in numbers.
It should be all typed including the numbers and brought back to a General Membership and shown to the members when it involves changing certain issues of the Tribal Laws and Customs and Traditions of the Tribe, this is how I believe that Smith and Nieto get away with forging Tribal Resolutions that are sent to the BIA.

And when someone is asked about voting on certain issues at the meetings no one seems to remember voting on them and this is the reason for that.
The numbers never seem to add up to the sign-in sheet at the meetings
just like at the last one the sign in sheet was left on the table and no one was handing out the voting machines.
You had to sign in and take a machine by your self.
No ID check or nothing, there were people there that I never saw before in my seventy five years as a member of the Band.
So when they want something passed they just fill in the numbers and off it goes to the BIA, done deal.
We have no idea what the actual wording is on these Resolutions when they are finalized and sent to the BIA.

Stan McGarr said they had signature stamps made.at one time. That was when they had to worry about EC members that might not roll over for Smith. Nowadays most Resolutions are drafted by the EC, signed, and submitted to the BIA without the GC'S knowledge. It is pretty rare for the GC to participate in tribal government.

Smith told the GC that they voted to give the EC the authority. I guess people believe him. That is not what the Constitution says though.

You are wrong. The Homestead Act was only open to non-Indians to claim 160 acres of land west of the Mississipi. Most Indians were removed from lands and forced onto reservations. The "Indian Homestead Act" or more famously known as the General Allotment Act or Dawes Act, gave tribal members the choice to take allotments and the rest was sold to non-Indians. If, an Indian wanted he coukd become a citizen under the Dawes Act, but did not lose any rights of being a tribal member, which was 2/3rds of the total population. The Citizenzhip Act of 1924 gave all non-citizen Indians, the other 1/3 who did not want citizenship but still received allotment, US citizenship. The most important thing to understand about these federal laws is the following:

"That every Indian born within the territorial limits of the United States who has voluntarily taken up within said limits his residence, separate and apart from any tribe of Indians therein, and has adopted the habits of civilized life is hereby declared to be a citizen of the United States, and is entitled to all the rights, privileges, and immunities of such citizens, whether said Indian has been
or not, by birth or otherwise, a member of any tribe of Indians within the territorial limits of the United States, without in any manner impairing or otherwise affecting the rights of any such Indian to tribal or other property."

The last sentence is the most important sentence in understanding current federal law concerning i herent rights to tribal property and rights regardless if or when citizenship was granted.

The Act of Congress of 1875 extended the Homestead Act of 1862 to Indians provided they give up their tribal affiliation.

Irregardless of which law was passed or when, the Dawes Act, and The Citizenship Act both override the Homestead act in terms of citizenship and tribal property rights, that is how federal law works.

Sounds like you must work for Denton's. There is such a thing as ex-post facto which means you can't pass laws that retroactively change the status of situations resulting from previous laws or actions. The Indian Citizenship Act was passed in 1924. Domingo Moro sold his homestead in 1919. The Dawes Act applied to allotments not homesteads so the language regarding citizenship did not apply to Indian homesteads. There is no override. Those people that chose to accept Indian homesteads became citizens and relinquished their tribal rights. In the case of Pauma, Pauma was created as a result of three Pauma Indians giving up their Indian Homesteads in exchange for the creation of the Pauma Reservation and having their tribal rights restored. Otherwise there would not be a Pauma Reservation today. You can't read the laws just to satisfy your need to just hate. Nice try though.

The above link is a history of Pauma Reservation. For those who do not want to read it I will summarize. Pauma Reservation was a Rancho owned by a Mexican citizen that was then converted to a reservation after the Mexican-American war. Ex post facto law means that laws are retroactive, in federal law, especially when dealing with Indians all laws are ex post facto. In regards to Indian Citizenship, the Native American Citizenship Act of 1924 sulercedes previous laws concerning citizenship and would restore, if any were taken, all tribal property rights.

Sorry to hear that King Freeman has passed away this morning.
King was a fighter and a believer of the Customs and Traditions of the Pala "CUPENO" people.
He fought a very hard battle against a corrupt leadership that now controls the Pala Indian Reservation.
He will leave that legacy behind and will be missed by all the Cupeno people that he believed in.
It's very sad that Robert Smith and Theresa Nieto caused such hell for King when they disenrolled his kids because of King speaking up against the Evil things that Robert Smith and Theresa Nieto are doing to the Pala Band of Mission Indians.
His legacy will live on forever for fighting for the right thing.
Please pray for his children to heal from this tragedy of loosing their Father, Grandfather and friend.

Just to clear up the confusion over Indian Citizens, even though the Dawes Act says it doesn't interfere with tribal land rights, the reality is that Indians that received off reservation homestead land in exchange for tribal membership were not allowed to receive allotments. That is because only tribal members could receive allotments. If an Indian Citizen had an allotment before receiving homestead land they most likely would lose their allotment because the patents were 25 years long and contingent on continual habitation. Indians had to live on their allotments or lose them.

Indian Citizens and their descendants were no longer tribal, no longer counted on Indian census, no longer eligible for federal benefits and services. They became taxpayers, could vote, retain attorneys, enter into contracts, etc. All the aspects of life that were managed for Indians by the BIA were available to them.

We have explained this over and over again. It is not that hard to understand. Natural born children of citizens become citizens also.

The Indianew citizenship act of 1924 did not affect the status of Indian Citizens. They were already citizens. The Act of 1924 was for those Indians that weren't citizens.

Now go ahead and get confused about it again. We're used to it.

That's very sad for PALA, they lost a great man yesterday when King Freeman past away.
Some of Pala's Members have vowed to carry on the fight for justice that King Freeman was fighting until his death yesterday.
They have said that Robert Smith, Theresa Nieto and Dion Perez will be brought answer for their corruption one way or another.
It's just not right that King fought this battle by himself.
We all know where King is resting now, in Heaven where he secured his spot with the Creator.

All they have done is cause trouble for the people and divide the Tribe, caused hate between members,disenrolled people that do without any doubt belong on the Tribal poles, stolen the minors trust accounts, lied to the people to serve their own agenda, taken the homes of some of the members, lowered the income of tribal members,
turned away some elders from getting work done on their homes,tells lies about people to make them look like saints, fixing the elections so that the incumbents will always be re-elected, notified the credit agencies that the disenrolled did not pay off their depts. to the Tribe and therefore ruining their credit ratings so that they can't even rent a home or apartment in any town.
Have made up bullshit about people to get them evicted from the Reservation.
There is so much that has happened while Smith and Nieto have been on the EC and most of it is to hurt people that they don't like or are afraid of because they stood up to them for things that they have done
or for their own personal gain.
And the Members still let it go on and on.
As far as the death of King Freeman they should be honored to even have known him and respect his family, but you all know without any doubt that Robert Smith and Theresa Nieto are happy the that the one man that called them out is no longer here.
That in it self is so disrespectful for the ones that are supposed to treat all members as equal.
But that is not going to happen and I hope that neither Smith or Nieto show up at any part of the service for King.

You will never be the Chairman of Pala like King Freeman was.
There is a huge difference between a good man and a corrupt man.
You do not fall under the title of a good man, not even close.
King Freeman has helped more Pala people than anyone has as Chairman.
The legacy that he has left will not be broken by you at any point of your chairmanship.
You are to evil of a person to do good for anyone living in Pala.

King said that he did not want any kind escort or any kind of fuss for his burial.
I was told that he just wanted to have his Mass and taken to his resting place in the back of his 2000 and be buried with no special fuss. By his 2000 he was talking about his grey pickup truck.
He was an old school type of guy with a heart as big as Texas and full of love for his Reservation and its members.
Rest in peace King, it was a pleasure knowing you and learning from you about the ways of the Cupeno people.
We will never forget who you were and always tell our kids and grandchildren how you fought a war to make things right again for all of Pala.
