White Man by the name of Henry Smith

Below is a letter dated December 11, 1935 from BIA Superintendent John W. Dady.  Apparently this Henry E. Smith bought some jewelry on credit and did not pay off the loan.  The jeweler then contacted the BIA hoping they could could garnish Henry Smith's wages in order to recoup the loss.
John Dady states

"...there is a white man by the name of Henry Smith married to Agnes Moro, a Pala Indian.  These people live on the Pala Reservation.  I presume he is the same man as the Henry E. Smith you mention in your letter.  He lives at Pala by right of sufferage only on account of being married to an Indian..."

If smith and nieto were smart they would reinstate the disenrolled and ban all and future disenrollment. There is this letter and the Remijo Lugo letter about paying his wages for work on bringing the Cupeno down from Warner Springs and he is Cahuilla. These can be used against their families in the future when someone else is in power. Don’t throw stones when you live in a glass house and they threw the fist stone when they disenrolled. They will not be Chairman and treasurer for ever so they should think about fixing this while they can do it doesn’t come back to bite them. The Brittains have shown enough evidence that even the tribe used when they enrolled them but somehow Robert has paperwork (that he will not show anyone) that says MB is half Cupeno. Really then show it and be done with all this, it’s that easy rob. He has and never will show it just say it because he has nothing and what he has tried to us was disproved quickly so he stopped giving a reason.

Robert knows this truth, that is why he hides behind cameras, guns, and goons.

Fuck Robert Smith and Theresa Nieto their Karma will get the best of them and their Family members that know the truth about what they are guilty of and they will ALL pay for it sooner or later.
Just think how much the per capita will rise up when the Smith's and the Nieto's are out and the roles are gone through and fixed.
But first things first, vote them out this election and find and support a new person that will replace them.
Pala really needs a change and there is no time better than the present to make that change.

Fucking Robert Smith is the same as Elizabeth Warren, a fake Indian
who claim native blood but is full of German blood topped off with a
little bit of Citizen Indian blood.
Which equals= no blood of the band.
Agnes Moro who is Robert Smiths Grandmother had no Cupa blood to be passed down to her children because of her Father being a Citizen Indian, so that's where the blood line for that Family should have been cut off.
Which in reality means that Robert Smith doesn't have the Blood of the Band to be enrolled in Pala.
His grandfather Henry Smith was a full blooded German.
And plus the fact that on his Mothers Birth certificate (Roberts)it states that her father is unknown.

That is very true about the above post concerning Robert Smith and his family.
By him being the chairman of Pala would be like the Mayor of Escondido running the Tribe, NO BLOOD OF THE BAND.

So in reality if Smiths Grandmother had no blood line to claim because of her father being a citizen Indian and Smith's grandfather had no Indian blood being a full blooded German and Smiths Mother had no idea who her father was then that would make Robert Smith a full blooded white man, is that correct ?.
WOW.
One little fat white man running the Pala Reservation like he owns it and no one will stop him.
What's up with you Tribal Members?

Very accurate deduction 8:07 p.m. Maybe instead of expending energy wondering how you can get him out in a rigged election why not inquire why the B.I.A. is recognizing a direct descendent of a citizen indian? Robert has no rights in pala let alone being a elected official of the band.

And maybe that unknown father of his mother is actually a wild boar, there is a bit of a piggy look to the boy

The BIA is not on Roberts side they are on the BIA’s side. They will not acknowledge past mistakes like allowing a citizen Indian to be enrolled or in San Pasquale allow Frank Trask a white man caretaker’s descendants to be enrolled and sit on council because it shows their incompetence and they are libel. The BIA will continue to omit documents and deny FOIA to keep their 100 years of mistakes and liability closed. They are a useless corrupt organization. There are certain people I’m the BIA ie: Amy Doosh and Francis Munchies who take sides “Robert Smith side” because they are either friendly or getting something on the side. The government has tried to change and clean up the BIA by moving around top officials and bringing in new ASIA but that never seems to work as the ASIA end up leaving after a few months after seeing what a corrupt mess the BIA is and they either want no part of it or realize it’s too much work to correct. If the BIA’s mistakes over the past 100 years were ever outed there will be many more Corbel sized lawsuits to go through and will cost the government BILLIONS! Now that is a reason to keep on hiding the BIA’s mistakes and allowing it to continue. So don’t expect the government or BIA to step up anytime soon unless they are forced/outed. Which is what Emilio Reyes is doing and I hope he keeps it up. Don’t ever stop Emilio and keep getting results. One more thing for Emilio “ Can you look into what’s going on at Pala??”

I think Roberts mothers father is a kin to the Buffalo that he keeps on the Ranch
near the new campsite.

Anybody have a definition or link to an article that explains what a citizen indian is?

A Citizen Indian is a tribal member who relinquished membership in exchange for homestead land and American citizenship rights. Indian Citizens were allowed to own land, vote, retain attorneys, enter into contracts, and lead lives free of the oversight of the BIA. These newly made citizens were required to swear never to practice tribal culture and to lead lives off reservation on the lands they were given. They also relinquished any alloted land, participation in tribal settlement funds, and their children would not be considered Indian even if they met blood degree requirements and would also be US Citizens.

This was part of the policy of assimilation, and the land was often of much better quality than reservation lands. For those Indians willing to give up tribal life it was an opportunity to get away from harsh reservation conditions with 160 acres of land they could homestead and farm and make a better living for their families.

Shouldn’t this be brought to the attention of the BIA because they are receiving benefits that they(the descendants) shouldn’t be receiving. Not just percap but all the Grant money that tribes receive, that should be used on non members.

Good luck on that. Domingo Moro became a Citizen Indian when he received land at Warner's Springs sometime around 1905. His daughters were already adults by then and they received allotments despite the fact that their father had become a Citizen. Domingo himself could not be alloted but the BIA let him live on the reservation instead of his homestead. He partnered with Henry Smith and they tred to compete with the Pala Store. The venture was a failure but Domingo was later appointed to be the Tribal Policeman.

The BIA has known all along about the groups at Pala. The BIA area office was located on the Pala Reservations in 1910 and remained there until it was relocated to Riverside.

The historical record is being restored by the Agua Caliente Cupeno. Whether the BIA will fix the problems created by their errors is a different matter.

Do you have any sources, legal or scholarly, that discuss this issue that you can recommend?

Does anyone know if Robert Smith has a pissing booth set up at the Pow Wow this weekend in Pala where he charges 1.00 for people to watch him piss on plastic plants like the ones at the Casino.
And also Tribal Members are only charged .50 cents to watch and .25
cents extra to watch Erick Ortega and Nieto zip up his pants when he is done.
Jimbo Goodpasture will be doing his part by shaking it off for the crowd at no cost before Ortega and Nieto do their part.

It is a provision of the Dawes Act of 1887.

"Every member of the bands or tribes receiving a land allotment is subject to laws of the state or territory in which they reside. Every Indian who receives a land allotment "and has adopted the habits of civilized life" (lived separate and apart from the tribe) is bestowed with United States citizenship "without in any manner impairing or otherwise affecting the right of any such Indian to tribal or other property".[16]"

At a meeting at the old Tribal hall back in 1989 there was a motion made by someone at that meeting that Marie Smith or any of her children could not work for the Tribe in any manner including running for any type of office including any position on the Tribal council.
I believe it was made by Roy Lattin jr. and seconded by Mary jean Dial.
She is the daughter of Marion Scott.
A vote was taken and the notion past by a majority vote by raising your hand.
The taped minutes that were made were more than likely destroyed when Robert Smith had some of the Tribal workers destroy some of the Tribes paper trail about 6 years ago when he said that there was to much paper being stored in the storage container that the Tribe had behind the old Tribal hall so there was a lot of things destroyed by the workers and by Robert Smith.
Think back to those old days and remember that Stanley McGarr used to tape all the meetings back then so there were a lot of minutes taped and were destroyed.
The only person that may have written copies of the minutes from those meetings was Julie Rodriguez who id now deceased.
However her sister Emily Subish is said to have all of Julies papers stored in Julies room at Emily's house.

And you know damn well that POS stanley mcgarr hit the stop recording button when something wasn’t supposed to be recorded. Isn’t that right cousin stan.

So getting bestowed citizenship did not "impair or otherwise affect the right of any such I dian to tribal or other property?" I am confused as to where beckmjng a US citizen under the Dawes act takes away tribal rights.

Who was on the election committee back when Robert first ran for Office? They should have disqualified him from the get go.

The Smith clan has a past of getting away with Murder.
Roberts Grandfather, a white man named Henry Smith stabbed a man and the man died and Henry Smith was never charged with that crime.
Just like no one was charged with the death of the little Williams
girl that died at Robert Smiths house where Robert and Andrew were
watching her.
Then at the old campground where the Tribe built a man made pond and
Robert had bought a new seadoo and launched it in the pond and after that a Mexican man was found dead after Smith hit him with the seadoo.
Then there was the one at the old campground where people witnessed both Robert and Andrew Smith shove a mag light down a mans throat and the man died but neither of the Smiths were charged with that crime.
What is keeping these killers from being caught for their crimes, when will they finally get what's coming them.
And what about the Joe Scott who is still missing and was said to be a target for both Smith brother at some point .
