Robert Smith - Chariman of the Luisenos

Once again BIA Pacific Regional Director Amy Dutschke refers to Robert Smith as Chairman of the Luisenos in April of 2015.  Yesterday this video was published claiming Robert Smith to be Chairman of the Pala Band of Mission Indians.  In this video Robert says "As chairman of the Pala Band of Mission Indians, I am dedicated to preserving our place in California’s history."
What's your place in California History Robert?  Trying to claim the Cupeno and Luiseno are "one people"?  Disenrolling and disenfranchising descendants of Warner Ranch Evictees?  Conducting business as Chairman of the Luisenos and masquerading as Chairman of PBMI?

Here a slice of truth for you all. The US Supreme Court ruled in Carcieri v. Salazar (2004) that the AS-IA can only put land into trust for tribes that were recognized in 1934 when the Indian Reorganization Act was passed. This means that there is a difference between historic tribes that were recognized in 1934 and Indian entities that were created through the authority of the IRA. PBMI is a created Indian entity that was organized in 1961. It is not an historic tribe, is not federally recognized and therefore is not eligible to have lands put into trust for their benefit.

This may be the reason why Robert Smith was conferred the title of Chairman of the Pala Luisenos. PBLMI is an historic tribe and is federally recognized, and therefore is eligible to have lands put into trust for its benefit. The problem is that the Pala Luisenos are not organized, have no elected tribal officers, and no governing document. Also all the Pala Luisenos land was allotted to members. They have no standing to acquire more land and put it into trust.

The BIA is playing games with the fiduciary trust obligation to the members of PBMI. Amy Dutschke should have raised this issue about federal recognition and the impropriety of using the status of PBLMI with Robert Smith. Instead she circumvented the law. There will be repercussions.

This is an invitation for an investigation into the dealings between the BIA Regional and the Pala Band of Mission Indians. There is for sure some shady goings on there.
What Department should be contacted to do so?
Can anyone advise?

@November 13, 2015 at 7:47 PM Unless you got hundreds of millions of dollars and/or connections in high places good luck. The corruption runs from top to bottom and left to right. Go ahead and look into Amy Dutschke. There is still some stuff on the web but most has been scrubbed. You will quickly see how corrupt she is and then scratch your chin as to how she is still Pacific Regional Director. Then you will have to look higher up the chain and wonder what is going on. Who has got what on who? Who is the puppet master in this whole mess? Even if you get close you will probably get burned and walk away as everyone else has for the past 15 years.

Did you check the California Fee to Trust Consortium announcements?

I heard that Amy Dutschke's last actions before retirement were to put lands into trust for the Pala Luisenos, but such decisions have to pass the comments and disputes period. There may be disputes from local governments regarding removing lands from the tax base.

In the meantime somewhere in my records I have a list of proposed lands to be put into trust. I will look for the letter and see if I can share those records for public consumption.

Though I have a letter signed by Amy Dutschke with this information I think it best you get it from another source. I don't want to be subject to allegations of interference or unauthorized disclosure.
